AN ORDINANCE AMENDING CHAPTER 46, CODE OF ORDINANCES (2010 EDITION),
CITY OF ROUND ROCK, TEXAS, REGARDING THE COMPATIBILITY BUFFER AND
FENCING REQUIREMENTS FOR NON-RESIDENTIAL DEVELOPMENTS ADJACENT
TO RESIDENTIALLY ZONED PROPERTY, AND AMENDING CHAPTER 32,
REGARDING COMMERCIAL REFUSE CONTAINERS ADJACENT TO RESIDENTIALLY
ZONED PROPERTY; PROVIDING A PENALTY CLAUSE; PROVIDING FOR A SAVINGS
CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS
That Chapter 46, Section 46-140(c)(1), of the Code of Ordinances, City of Round Rock, Texas, is
hereby amended to read as follows:

That Chapter 46 of the Code of Ordinances, City of Round Rock, Texas, is hereby amended by
adding a section to be numbered Section 46-140(e)(4), which said section shall read as follows:
(e) Multifamily compatibility standards. Compatibility standards are intended to protect adjacent properties and residential
neighborhoods from the adverse impacts sometimes associated with higher intensity development.
(4) Compatibility Buffer Requirement. All MF (Multifamily) uses which abut SF (Single Family) or TF (Two Family) zoned
property shall be required to install and maintain a compatibility buffer which meets the requirements of Sec. 46-200
along every property line which abuts said uses.

hereby amended to read as follows:

additional setback requirements set forth herein. For each one foot of height in excess of twenty feet, the structure shall
be set back from said abutting property line one extra foot in addition to the minimums set forth in the Density and
Development Standards Table above.
VI.

XI.
That Chapter 46-143(c)(7), of the Code of Ordinances, City of Round Rock, Texas, is hereby
deleted from said Code of Ordinances, and Chapter 46-143(8) shall be renumbered to read 46-
143(c)(7).

Signage. Signs should be in harmony with the style and character of the development and should be an integral design
component of the building architecture, building materials, landscaping and overall site development.
a. Attached signs shall be integrated with the primary physical features of the building and shall complement the
building architecture. Attached signs shall be mounted so that the attachment device is not visible or
discernable. Attached cabinet or box signs are not permitted. Roof mounted signs are not permitted.
b. Sign coverage shall not exceed 25 percent of the wall area located above doors and windows on a one-story
building or between the first and second floor of a two-story building. Signs attached to multi -tenant buildings
shall be of a single design and scale.

perimeter parking lot landscaping. Parking shall be allowed in the setback more than 15 feet from the property
line. A compatibility buffer shall be allowed in the setback in accordance with Sec. 46-200. Perimeter parking lot
landscaping shall be allowed in the setback in accordance with Sec. 46-195 (c) (1).

That Chapter 46, Section 46-195(d), of the Code of Ordinances, City of Round Rock, Texas, is
hereby amended to read as follows:
Sec. 46-195. - Landscaping.
(d) Screening. The purpose of this section is to establish requirements to screen specific uses or structures from public view. All
landscape material required in this section shall be provided in areas unencumbered by easements. Screening and buffers shall
provide a visual barrier between land uses, enhance the streetscape, and provide privacy. The spacing requirements between
trees in the City of Round Rock Tree Technical Manual: Standards and Specifications shall not apply to this section.
(1) Screening. Compliance with this section requires that all detention ponds, water quality ponds, ground mounted
equipment (i.e., transformers, air conditioner units), dumpsters, trash receptacles, refuse storage containers, outdoor
storage, loading docks, substations, large utility cabinets, water and waste water pumping stations, storage sites, and
other similar uses be sufficiently screened from all public views.
a. Detention and/or water quality ponds. All proposed detention and water quality facilities shall be screened by
means of the following landscape elements:
1. One medium tree shall be planted for every 30 linear feet around the boundary of the detention and/or
water quality pond;
2. One small size shall be planted for every 15 linear feet around the boundary of the detention pond
and/or water quality pond;
3. One large shrub (minimum five gallon size) shall be planted for every four linear feet around the
boundary of the detention pond and/or water quality pond; and
4. Landscaped berm (minimum three feet in height); or
5. Masonry wall (minimum three feet in height);
6. Required trees shall be located to maximize the screening of the ponds.

Exceptions to the screening requirement for detention and/or water quality ponds may be administratively
granted by the DSO Planner for a facility designed as a site amenity feature (i.e., pond with fountain, ball field,
etc.).
b. Dumpster and trash receptacles. All proposed dumpsters, trash receptacles, and refuse storage containers shall
be located within an enclosure providing screening by means of combining the following landscape elements:
1. Decorative masonry wall (minimum six feet in height). If the wall includes a gate, it shall be constructed
with an opaque non -masonry material. The construction materials of the wall shall match material used
on the principal building located on the same lot; and
2. Large shrubs and small trees shall be arranged as foundation planting around the perimeter of the pad
area. One small tree shall be planted on each of three sides of the enclosure, except the side where
the gate is located. One large shrub shall be planted for every four linear feet of wall constructed. The
opening for the equipment, however, shall not be obstructed. (Minimum shrub height at installation shall
be 2.5 feet.) The landscape requirements of this subsection do not apply when the enclosure is an
architectural extension of a principal building.
c. Ground mounted equipment. All proposed ground mounted equipment shall be screened by planting one five
gallon or larger size shrub for every three linear feet around the boundary of the equipment. Shrubs shall be a
minimum height of 2.5 feet at installation.
d. Substations, water/wastewater stations. Proposed electric substations, water pump stations and wastewater lift
stations shall be screened from public views by means of a six-foot masonry wall on all three sides (minimum)
combined with the following landscape elements:
1. A 15 -foot landscape buffer shall be provided in which the following shall be incorporated:
(i) One large tree per 50 linear feet (75 percent of selected material shall be of an evergreen
species);
(ii) Two medium size trees per 30 linear feet (75 percent of selected material shall be of an
evergreen species);
(iii) One small tree per 15 linear feet (75 percent of selected material shall be of an evergreen
species); and
(iv) One five gallon container size large shrub per four linear feet. (75 percent of selected material
shall be of an evergreen species).
2. Loading areas shall be screened with a three-foot landscape berm and landscaping or a solid six-foot
fence and landscaping.
e. Outdoor storage. All outdoor storage shall be screened in accordance with the requirements of section 46-199.
In addition, outdoor storage shall be screened by the following landscape elements:
1. Limited outdoor storage.
(1) One small tree per 15 linear feet of wall constructed (75 percent of selected trees shall be of
an evergreen species); and
(ii) One large shrub per four linear feet of wall constructed.
2. General outdoor storage.
(1) One medium tree per 30 linear feet of wall constructed (75 percent of selected trees shall be
of an evergreen species);
(ii) One small tree per 15 linear feet of wall constructed (75 percent of selected trees shall be of
an evergreen species); and
(iii) One large shrub per four linear feet of wall constructed.
f. Loading docks and loading spaces.
1. All loading docks shall be screened by means of the following screening and landscaping elements:
(i) Decorative masonry wall (minimum six feet in height). If the wall includes a gate, it shall be
constructed with an opaque non -masonry material. The construction materials of the wall shall
match material used on the principal building located on the same lot;
(ii) One medium tree per 30 linear feet of wall constructed (75 percent of selected trees shall be
of an evergreen species);
(iii) One small tree per 15 linear feet of wall constructed (75 percent of selected trees shall be of
an evergreen species); and
(iv) One large shrub per four linear feet of wall constructed.
2. All loading spaces within a street yard shall be screened by means of the following screening and
landscape elements:

g.
(1) Decorative masonry wall (minimum six feet in height). If the wall includes a gate, it shall be
constructed with an opaque non -masonry material. The construction materials of the wall shall
match material used on the principal building located on the same lot; or
(ii) Altemative landscape screening to ensure screening from the right-of-way, as approved by the
DSO Planner in accordance with subsections (d)(2)g and (e) of this section.
Alternative screening requirements. In lieu of the screening requirements listed in this subsection (d)(2) of this
section, applicant may screen the entire service area with a landscape berm and landscaping or with a solid
fence and landscaping. Landscaping of the entire service area shall be installed in accordance with the
landscape buffer requirements listed in subsection (d)(1) of this section plus the requirement of one five -gallon
container size large shrub per four linear feet.
(2) Planting criteria for screening. Planted material used for the purposes of screening shall comply with the following
minimum standards in addition to the general planting requirements:
a. Selected plant material shall be evergreen for screening or may be a combination of evergreen and deciduous
for other uses. Shrubs used for the purpose of screening shall be a minimum five -gallon container size at the
time of installation.
b. The mature height of a plant shall meet or exceed a sufficient height to effectively obscure views.
c. Growth habits of selected plant materials shall provide a dense foliage pattern that will effectively obscure views.
Irrigation. All required landscape areas shall be irrigated by an underground automatic system that may include a drip
irrigation system. This system shall adhere to manufacturer specifications and the rules and regulations established by
TCEQ or successor agency. In addition, an irrigation system must be designed by a landscape architect or irrigator
licensed by the state. An irrigation system shall comply with the following guidelines:
a. Sprinkler head spacing shall be designed for head-to-head coverage and adjusted for prevailing winds. The
system shall promote minimum run-off and minimum over spray onto non -irrigated areas (i.e., paving, walkway,
building).
(3)
b. Sprinkler heads shall have matched precipitation rates within each control valve circuit.
c. Adjustable flow controls shall be required on circuit remote control valves. Pressure regulation components shall
be required where static pressure exceeds manufacturer's recommended operating range.
d. Valves and circuits shall be separated based on water use requirements, so that turf areas can be watered
separately from shrubs, trees, and groundcover areas. A minimum of one bubbler each shall be provided for all
large and medium size trees.
e. Serviceable check valves shall be required where elevation differential may cause low head drainage adjacent
to paving areas.
f. All automatic irrigation systems shall be equipped with an electronic controller capable of dual or multiple
programming. Controller(s) shall have multiple cycle start capacity and a flexible calendar program, including the
capability of being set to water every five days. All automatic irrigation systems shall be equipped with a rain and
freeze sensor shut-off device.
XXXVIII.
That Chapter 46 of the Code of Ordinances, City of Round Rock, Texas, is hereby amended by
adding a section to be numbered Section 46-200, which said section shall read as follows:
Sec. 46-200. — Compatibility Buffer.
(a) Purpose and Intent. The purpose of this Section is to set forth requirements regarding the design, installation,
construction and maintenance of compatibility buffers for all property other than those specifically exempted below. A compatibility
buffer shall be composed of a landscape buffer and a compatibility fence as provided below. Compatibility buffering is intended to
minimize the effects of MF (Multifamily), C-1 (General Commercial), C-1 a (General Commercial — Limited), C-2 (Local
Commercial), OF (Office), BP (Business Park), LI (Light Industrial), I (Industrial), PF -1 (Public Facilities), PF -2 (Public Facilities —
Medium Intensity), PF -3 (Public Facilities — High Intensity), and SR (Senior), land uses which are adjacent SF (Single Family) and
TF (Two Family) uses, while maintaining the flexibility of allowing such more intense land uses in appropriate circumstances.
(b) Applicability. This Section shall apply to all land within the City limits and in areas where this Section is in effect by
contractual agreement.

(1) Except as provided in (c) below, the requirements of this Section shall apply to:
a. Any new development or construction requiring a permit;
b. Any change of land use from a residential use to a non-residential use; or
c. Any change, conversion, or addition of commercial land uses that result in an increase in the parking
requirements.
(c) Exemptions.
The following shall be exempt from the requirements of this Section:
(1) Restoration of a building or structure which has been damaged, destroyed or demolished to an extent less than
fifty percent (50%) of its fair market value (as determined by the most recent appraisal of land value of the
appraisal district in which the building or structure is located);
(2) Exterior or interior renovation of a structure; or
(3) Land located within the Central Business District.
(d) Landscape Buffer. A landscape buffer of at least eight (8) feet wide shall be provided for all sites subject to this Section.
(See Article III of this chapter for district specific compatibility standards.) Based on the linear footage that extends along
the length of the property line between higher and lower intensity land uses, the minimum quantity of landscaping shall be
determined by the following requirements:
(1) One large tree per fifty (50) linear feet with a minimum caliper of three (3) inches, selected from the list of
approved evergreen tree species in Appendix B of the Tree Technical Manual. Or
(2) One medium tree per twenty-five (25) linear feet with a minimum caliper of two (2) inches, selected from the list
of approved evergreen tree species in Appendix B of the Tree Technical Manual; and
(3)
One -hundred percent (100%) of trees utilized shall be of an evergreen species.
Other than the required landscaping, nothing shall be placed within the landscape buffer, including without limitation,
accessory buildings, parking lots, storage of materials and refuse containers. The landscape buffer may not be used as a
utility easement.
(e) Compatibility Fence. In addition to the above landscaping requirement, a compatibility buffer shall also have a
compatibility fence installed on the applicable property boundaries Materials and installation of the compatibility fence shall
comply with the most recent edition of Selected ASTM Standards for Fence Materials and Products, a copy of which shall be
maintained by the Development Services Office. Structural plans and specifications for fences shall be submitted at the same time
as other construction plans required by this Section. In approving said plans and specifications, the Development Services
manager shall consider the site's soil characteristics, wind loadings, and other environmental considerations.
A landowner may select from two (2) options for complying with the requirements for a compatibility fence required by this Section.
The two (2) options are set forth below.
(1) Pre -cast Concrete Panel Fence Option.
a. Pre -cast concrete panel fence materials, construction standards, and miscellaneous requirements shall
be as follows:
1. Pre -cast concrete panels shall be installed per manufacturer's specifications;
2. Construction details or shop drawings must be sealed by a civil engineer, structural engineer,
or landscape architect and provided prior to the issuance of a building permit;
3. Both sides of the fence shall have a finished face; and
4, The fence shall have a height of a minimum of six feet (6').
b. The pre -cast concrete panel fence shall include accent columns installed at each end and/or comer. If
the fence exceeds two hundred (200) feet in length, one or more additional columns shall be required.
The additional column(s) shall be constructed so that no column is more than one hundred ten (110)

feet from another column. The columns shall be at least sixteen (16) inches in width and shall be
constructed of brick or stone with a top cap.
(2) Masonry Fence Option.
a. For the purposes of this paragraph (b), "Masonry fence" shall mean a fence constructed of brick or
natural stone. The term shall not include cement based siding such as HardiPlank, Fencecrete, or
similar construction materials.
b. Masonry materials, construction standards, and miscellaneous requirements shall be as follows:
1. Brick or natural stone;
2. A cast -in-place structural footing;
3. Top capped;
4. Both sides of the fence shall have a finished face;
5. The fence shall have a height of a minimum of six feet (6'); and
6. Construction details or shop drawings must be sealed by a civil engineer, structural engineer,
or landscape architect and provided prior to the issuance of a building permit.
c. If a landowner selects the masonry fence option, he shall be entitled to take advantage of reduced
setback requirements as set forth in the Density and Development Standards Table for the applicable
zoning district.
XXXIX.
That Chapter 32, Section 32-23(a), of the Code of Ordinances, City of Round Rock, Texas, is
hereby amended to read as follows:
Sec. 32-23. - Commercial refuse.
(a) Containers.
For non-residential customers, either the customer or its refuse collection contractor shall provide containers suitable for
dumping by mechanical means. Containers will be placed on private premises at locations agreed between the owner or
occupant and the commercial refuse collection contractor; provided however, no such container shall be placed within
fifteen (15) feet of the boundary of any abutting property with a SF (Single Family) or TF (Two Family) zoning designation.
The city will not be responsible for damages to paved surfaces on private property caused by commercial refuse
collection trucks. Sufficient containers will be placed to accommodate the Refuse from each business. Adjacent small
businesses may share containers.

the requirement for reading this ordinance on two separate days was dispensed with.

Item Summary:
At the public hearing for this proposed amendment, the Mayor directed City staff to meet with Councilmember John
Moman and other interested parties to discuss concerns raised by Mr. Moman. Members of the Planning
Department and the Planning and Zoning Commission, along with Terry Hagood, met with Mr. Moman and
discussed four of his concerns: (1) changing the width of the required accent column on concrete panel fences from
18" to 16"; (2) clarifying that the accent columns can be at intervals of 100 feet, within a variance of 10%; (3)
insuring that concrete -based siding is not an allowable fencing material; and (4) including an option for an enhanced
wood fence in the ordinance. The first three of these concerns have been addressed in the ordinance. The
enhanced wood fence option was previously considered by the Planning and Zoning Commission, but they decided
not to include it in their recommendation to the Council. It specified #1 grade Western Red Cedar boards with three
rails of framing and top and bottom capping, galvanized steel posts with 3 1/2 foot deep concrete footings, and a
concrete strip beneath the fence. Staff seeks direction from the Council as to whether or not to include the
enhanced wood fence option. If it is to be included, the ordinance will need to be amended and brought back for
consideration at the February 10, 2011 meeting.
The proposed changes to the compatibility fencing and buffer standards originated from a discussion held by the
City Council at the retreat in August 2009. In the context of Strategic Plan, Goal 4, the Council expressed a desire to
improve the aesthetics and quality of development by requiring 'Fencecrete' (pre -cast masonry panels) as a
minimum standard instead of the wood fencing that is the current minimum standard. In accordance with the
Council's adopted Development Philosophy, City staff worked with a group of local design professionals and
developers assigned to the task by the Chamber of Commerce. Staff met with this group and developed revised
standards and new incentives to be considered by the Planning and Zoning Commission. The Commission heard
presentations on the proposed standards and incentives on three occasions and they made several
recommendations. In addition, staff made a presentation and solicited comments from the Mayor's meeting of
homeowners association presidents. The Commission then recommended adoption of the standards at their
meeting on December 15, 2010.
Compatibility fences are required on the property line of non-residential development when it is adjacent to single
family or two family zoned developments. The fence is one component of a required compatibility buffer, designed
to provide a visual screen of the non-residential development. The current required buffer is a 15 -foot wide area
containing the fence and trees of a specified size and planting pattern. In addition to the buffer, the non-residential
building must be set back from the property line by a specified amount, depending upon the zoning district it is
located in. The most common building setback is 50 feet.

The cost of a pre -cast concrete panel fence is significantly higher than that of a typical wood fence. A stone or brick
wall has a significantly higher cost than a pre -cast concrete panel fence. The proposed changes provide incentives to
lessen the burden of this increased cost. These incentives are: (1) reducing the required compatibility buffer from
15 feet to 8 feet; (2) reducing the number of trees in the buffer; and (3) reducing the required building setback by
20%. These incentives provide both reduced buffer installation costs and a gain in usable site area for the non-
residential development.
The proposed ordinance requires a pre -cast concrete panel fence with an 8 -foot compatibility buffer. Within the
buffer, a tree must be planted every 25 feet, alternating between Targe species and medium species trees. If a
masonry wall is built, instead of a pre -cast concrete panel fence, the building setback is reduced by 20%.
Two provisions were added by the Planning and Zoning Commission prior to their recommendation: (1) more
specific structural requirements for the fences and walls in order to insure their structural integrity; these
requirements are the same as what the City currently requires for a wall that is required along major roadways for a
residential subdivision; and (2) a requirement for pre -cast concrete panel fences to have an accent column for every
100 feet of wall length to provide for greater attractiveness of long expanses of fencing; the accent column must be
a minimum of 18 inches wide and be constructed of stone or brick with a top cap.
The revision to Chapter 32 insures that commercial refuse containers can be located no closer than 15 feet from the
property line of a residentially zoned property.
