R -11-03-24-11C4 WHEREAS, Section 395.042 of the Texas Local Government Code requires a municipality desiring to adopt road impact fees to adopt a resolution setting a public hearing date to consider a land use assumptions and capital improvements plan for road impact fees for a designated service area, and WHEREAS, the City has determined the land use assumptions, capital improvements plan and road impact fees for a designated service area need to be considered for adoption, and WHEREAS, it is necessary for the City Council to set a date, time, and place for the holding of the public hearing in order to comply with said Texas Local Government Code requirements for same, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That a public hearing to consider land use assumptions and a capital improvements plan for impact fees for the designated service area be held on the 28th day of April, 2011, at 7:00 o'clock p.m. at 221 E. Main Street, Round Rock, Williamson County, Texas. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Chief of Public Works Operations Item Summary: Many of the arterial roadways on the City of Round Rock's Transportation Master Plan are dependent on developer participation through contributions to the construction of the roadway and/or donation of right-of-way (R.O.W.). Either case, developer participation is critical in the development of Round Rock's Ultimate Roadway Network. Kenney Fort Boulevard (Arterial A) is a major arterial roadway shown on the current Transportation Master Plan which will eventually provide connectivity from SH 45 north into Georgetown by connecting to Williamson County Road 110. In addition to providing much needed connectivity and an alternate travel route to IH 35, the first phase of this roadway between Joe DiMaggio Boulevard and Forest Creek Drive will facilitate the development of several parcels, which are currently landlocked just south of US 79 and the Union Pacific Railroad. Staff has worked for several years to evaluate scenarios, which will allow the land owners to participate in the construction of this roadway. In cooperation with the land owners, staff has determined that the best option for landowner participation is a Road Impact Fee, which is regulated under Chapter 395 of the Texas Local Government Code. This proposed road impact fee is specific to the subject properties and will not apply to any other properties in the City. The current estimated fee is $690/p.m. trip. The fee will be adjusted based upon actual R.O.W. costs and construction costs prior to adoption by the City Council. Upon approval the impact fee becomes collectable as building permits are issued. As the first step to implementing a Road Impact Fee, the City contracted with HDR, Inc. to develop land use assumptions and a capital improvements plan for these properties. Pursuant to Chapter 395, the next step in this process is the adoption of a resolution establishing a date for a public hearing to consider the land use assumptions and capital improvements plan. The proposed public hearing date is April 28, 2011. The tentative schedule of Council meetings related to the consideration and adoption of the roadway impact fee is as follows: 1. March 24, 2011 Council resolves to hold a public meeting regarding the land use assumptions and capital improvements plan on April 28, 2011. 2. April 28, 2011— a) Council holds a public hearing regarding the land use assumptions and capital improvements plan. b) Following the public hearing, the Council considers the approval of the land use assumptions and the capital improvements plan. c) Council resolves to hold a public hearing regarding the imposition of the impact fee on June 9, 2011.
