WHEREAS, by Resolution No. R -11-03-10-10A1, this City Council ordered an election for
May 14, 2011 for the purpose of electing Mayor, Councilmember Place 1, and Councilmember Place
4; and
WHEREAS, pursuant to §2.053 Texas Election Code, the City Secretary, who is responsible
for having the official ballot for City Council elections prepared, has certified in writing that each
candidate office in the May 14, 2011 election is unopposed; and
WHEREAS, a copy of the said certificate is ordered to be attached to this Resolution as an
exhibit; and
WHEREAS, §2.053 Texas Election Code provides that upon receipt of such a certificate that
the Council may by order declare each unopposed candidate elected to the office; Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That, pursuant to §2.053 Texas Election Code, the Order Cancelling Election, attached hereto is
hereby adopted and approved.
The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

EN VISTA DE QUE mediante la Resolucion Nro. R -11-03-10-10A1, este Consejo
Municipal ordeno una eleccion para el 14 de mayo de 2011 con el fin de elegir un Alcalde y
Concejal para la Posicion 1 y un Concejal para la Posicion 4; y
EN VISTA DE QUE en conformidad con §2.053 del Codigo Electoral de Texas, la
Secretaria de la Ciudad, persona responsable de hacer preparar la boleta oficial de votacion para
las elecciones del Consejo Municipal, ha certificado por escrito que ningun candidato para los
cargos de la eleccion del 14 de mayo de 2011 tiene oponentes; y
EN VISTA DE QUE se ordena que una copia de dicho certificado sea adjuntada a esta
resolucion en forma de anexo; y
EN VISTA DE QUE §2.053 del Codigo Electoral de Texas dispone que al recibir tal
certificado, el Consejo puede, mediante una orden, declarar elegido al cargo a cada candidato sin

Que, en conformidad con §2.053 del Codigo Electoral de Texas, la Orden de Cancelacion
de la Eleccion adjunta al presente es por la presente adoptada y aprobada.
El Consejo Municipal por la presente halla y declara que fue colocado un aviso por
escrito con la fecha, hora, lugar y asunto a tratar de la asamblea en la cual fue adoptada esta
Resolucion, y que tal como lo requiere la ley la asamblea estuvo abierta al publico en todo
momento en que esta Resolucion y el asunto a tratar en la misma fue deliberado, considerado y

Consider a resolution approving an Election Cancellation Order for the City of Round Rock
Agenda Caption: General Election on May 14, 2011.
Meeting Date: March 24, 2011
Section 2.053 of the Texas Election Code provides that if each candidate running in the election is unopposed and
the City Secretary, who is responsible for having the official ballot for City Council elections prepared, has certified in
writing that each candidate office in the election is unopposed, then the governing body may cancel the election.
This will save the City approximately $40,000 which would have been the approximate cost of holding the election.
Once the election is canceled, the newly elected officials will be sworn in at the end of May in accordance with the
proper timing set out by the Texas Election Code.
