R -11-04-14-10D2 WHEREAS, Texas Local Government Code, Section 271.113(a) allows governmental entities to use certain methods other than competitive bidding in entering into contracts for construction of facilities, as defined therein, and WHEREAS, the City of Round Rock is considering using an alternative method other than competitive bidding in entering into a contract for the remodel and construction of the City Hall Remodel Project located at 221 E. Main Street ("Project"), and WHEREAS, the statute requires that a project -by -project determination be made as to what method provides the best value for the governmental entity in relation to a particular project, and WHEREAS, the Council has determined that this Project would be best served by utilizing the "Competitive Sealed Proposal" method, and WHEREAS, Texas Local Government Code, Section 271.114(a) mandates a time requirement that the "governing body of a governmental entity that is considering a construction contract using a method specified by Section 271.113(a) other than competitive bidding must, before advertising, determine which method provides the best value for the governmental entity," and WHEREAS, the City Council desires to comply with all requirements of the statute, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, In accordance with Texas Local Government Code §271.114(a), the Council has determined that "Competitive Sealed Proposal" is the delivery method which provides the best value for the City for the remodel and construction of the City Hall Remodel Project located at 221 E. Chief of Public Works Operations Item Summary: On April 22, 2010 an agreement with KA Hickman Architects was executed for professional architectural and interior design services for the remodel of the City Hall building located at 221 E. Main Street. The City Hall Remodel project provides for remodeling all existing offices and City Hall Council Chambers. Offices to be staffed out of City Hall after the remodel will include Administration, Information Technology, Utility Billing and the Council Chambers. The Texas Local Government Code Section 271.113 (effective September 1, 2001) allows Cities to use certain methods other than competitive bidding in entering into contracts for construction of facilities. One such method is "Competitive Sealed Proposal." Section 271.114 (a) mandates that the "governing body of an entity that is considering a construction contract using a method specified by section 271.113 (a) other than competitive bidding must, before advertising, determine which method provides the best value to the government entity." By selecting the method for Competitive Sealed Proposals for this project would allow City staff the ability to negotiate the items in the contract for the best optimal value and use of funds. The alternative option of a straight bid only allows City staff to select the lowest bidder.
