R -11-04-28-12C5 WHEREAS, Section 395.047 of the Texas Local Government Code requires a municipality desiring to adopt road impact fees to adopt a resolution setting a public hearing date to consider adoption of road impact fees for a designated service area, and WHEREAS, the City has approved the land use assumptions and capital improvements plan as required by Section 395.042 of the Texas Local Government Code, and WHEREAS, it is necessary for the City Council to set a date, time, and place for the holding of the public hearing in order to adopt a road impact fee, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That a public hearing to consider adoption of a road impact fee for Kenney Fort Boulevard be held on the 9th day of June, 2011, at 7:00 o'clock p.m. at 221 E. Main Street, Round Rock, Williamson County, Texas. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. April 28, 2011 Infrastructure Development and Construction Management Staff Person making presentation: Tom Word Chief of Public Works Operations Item Summary: Many of the arterial roadways on the City of Round Rock's Transportation Master Plan are dependent on developer participation; some developers choose to contribute to the construction of the roadway, while others choose to donate right-of-way. In either case, developer participation is critical in the development of Round Rock's Ultimate Roadway Network. Kenney Fort Boulevard (Arterial A) is a major arterial roadway shown on the current Transportation Master Plan which will eventually provide connectivity from SH 45 north into Georgetown by connecting to Williamson County Road 110. In addition to providing much needed connectivity and an alternate travel route to IH 35, the first phase of this roadway between Joe DiMaggio Boulevard and Forest Creek Drive will facilitate the development of several parcels which are currently landlocked just south of US 79 and the Union Pacific Railroad. Staff has worked for several years to evaluate scenarios which will allow the land owners to participate in the construction of this roadway. In cooperation with the land owners, staff has determined that the best option is a Road Impact Fee, which is regulated under Chapter 395 of the Texas Local Government Code. This proposed road impact fee is specific to the subject properties, and upon approval becomes collectable as building permits are issued. The City contracted with HDR, Inc. to develop the road impact fee report; this report was provided to the Council on March 25, 2011. Previously, Council held a public hearing regarding the land use assumptions and capital improvements plan proposed for the service area which will be subject to the impact fee — Council subsequently adopted the land use assumptions and capital improvements plan. Pursuant to Chapter 395, the next step in the adoption of a Road Impact Fee is to set a date for a public hearing regarding the imposition of the impact fee.
