City Council Agenda Summary Sheet Consider an ordinance adopting Road Impact Fees for Kenney Fort Boulevard. (First Agenda Caption: Reading). Meeting Date: June 9, 2011 Department: Infrastructure Development and Construction Management Staff Person making presentation: John Dean Transportation Planner Item Summary: Kenney Fort Boulevard (Arterial A) is a major arterial roadway shown on the current Transportation Master Plan which will eventually provide connectivity from SH 45 north into Georgetown by connecting to Williamson County Road 110. In addition to providing much needed connectivity and an alternate parallel travel route to IH 35, the first phase of this roadway between Joe DiMaggio Boulevard and Forest Creek Drive will facilitate the development of several parcels which are currently landlocked just south of US 79 and the Union Pacific Railroad (termed the "Service Area"). Staff has worked for several years to evaluate scenarios which will allow the land owners to participate in the construction of this roadway. In cooperation with the land owners, staff determined that the best option to secure land owner participation in this road project was a Road Impact Fee, which is regulated under Chapter 395 of the Texas Local Government Code (TLGC). The City contracted with a local engineering firm, HDR, Inc., to develop a road impact fee report. This report outlined the land use assumptions and capital improvements for the service area subject to the impact fee, and it developed a proposed impact fee per vehicle trip based on estimated construction costs. This report was distributed to the Council on March 25, 2011. The capital improvements in this case consist of Kenney Fort Boulevard, a 6 -lane urban arterial roadway, between the Union Pacific Railroad (UPRR) right-of-way and the north side of Brushy Creek. While the entire project includes connections under UPRR and US 79 to Joe DiMaggio and a connection across Brushy Creek to Forest Creek Boulevard, for the purposes of this analysis the capital improvements consist only of the section of road between UPRR and Brushy Creek. Utilizing methods provided in the Transportation Research Board's Highway Capacity Manual 2000, it was determined that the maximum capacity of Kenney Fort Boulevard (based upon it's number of lanes, design speed, etc.) was 11,592 vehicles per hour (vph) At the same time, information obtained from the Planning Department and the General Plan 2020 projected that a combination of multi -family, office, business park and commercial uses would be the most likely types of land uses to develop in the Service Area. The Planning Department was also helpful in provided expected densities of these different types of uses. Using the Institute of Transportation Engineer's Trip Generation, 8th Edition, the traffic generated by these land uses was projected to be 7,270 vehicles during the PM Peak Hour. This number was then divided by the total capacity of Kenney Fort Boulevard to reveal that the development would utilize 62.7% of the capacity of the roadway (7,270 vph/11,592 vph = 62.7%). TLGC Chapter 395 allows a municipality to include all costs associated with the capital improvements (termed "Eligible Costs"), including construction, right-of-way, surveying and engineering, construction inspection, and consulting costs to develop the report. The total of these Eligible Costs was $8,165,835. From the analysis above, 62.7% of the Eligible Costs are recoverable with the impact fee, which equals $5,121,258. This number, divided by the number of anticipated trips ($5,121,258/7,270) equals $704 per vehicle trip. It should be noted these figures were based on estimates of the construction costs, and must be refined based upon actual bid prices. Furthermore, Chapter 395 requires a municipality that adopts an impact fee to update the fee at least every five years — during these intervals the actual fee must be adjusted to reflect actual costs as the road is completed and any changes to the land use plan. On May 18, 2011 the Capital Improvements Advisory Committee met to consider the road impact fee report, and to develop written comments about the report. The Committee adopted the report, and forwarded the following comments on to the City Council: 7) The land use assumptions for the service area are reasonable based on available information, and these assumptions are in conformance with the General Plan. 8) The recommended capital improvements will adequately serve the land uses proposed for the service area. 9) We believe the adoption of this roadway impact fee will facilitate development in this area, by eliminating the need for a specific Traffic Impact Analysis (TIA) for each property as development occurs. This will in turn reduce the application processing time and it will eliminate the cost to the developer of preparing a TIA. 10) The proposed impact fee of $704 per service unit represents a proportional share of the capacity the proposed land uses will use of Kenney Fort Boulevard. 11) At its final adoption, the impact fee should be set based on actual costs wherever possible, including received construction bid prices. 12) We believe that the adoption of this impact fee will allow the City to move forward with the roadway construction, thus opening the service area for development and providing alternate north/south access for Round Rock citizens. We find that the proposed impact fee is just and reasonable. Adoption of this impact fee will secure the land owners participation in the construction of this roadway, helping to defer some of the City's expenses. In addition, approval of this road impact fee will allow the City to move forward with this project, thus opening nearly 500 acres of previously inaccessible land to new development. To date, the steps which have been undertaken with regard to consideration of the road impact fees include: 4) HDR, Inc. prepared and submitted the Kenney Fort Boulevard Road Impact Fee Study 5) March 24, 2011 - Council set a public hearing date to consider the land use assumptions and capital improvements plan contained within the report. 6) April 28, 2011 a. Council held a public hearing to receive public testimony regarding the land use assumptions and capital improvements plan. b. Council adopted the land use assumptions and capital improvements plan. c. Council set a public hearing date to receive public testimony regarding the impact fee. 7) May 18, 2011— the Capital Improvements Advisory Committee met and approved the Roadway Impact Fee report, and forwarded their written comments on to the City Council. 8) June 9, 2011— Council held a public hearing to receive public testimony regarding the impact fee.
