AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE
CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 46-132(b)(1),
CODE OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK,
TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID
OFFICIAL ZONING MAP, TO WIT: TO REZONE 7.075 ACRES OF
LAND, OUT OF THE DAVID CURRY SURVEY, ABSTRACT NO. 130, IN
ROUND ROCK, WILLIAMSON COUNTY, TEXAS, FROM DISTRICT LI
(LIGHT INDUSTRIAL) TO DISTRICT C-1 (GENERAL COMMERCIAL).
WHEREAS, an application has been made to the City Council of the City of
Round Rock, Texas to amend the Official Zoning Map to rezone 7.075 acres of land, out
of the David Curry Survey, Abstract No. 130, in Round Rock, Williamson County, Texas,
being more fully described in Exhibit "A" attached hereto, from District LI (Light
Industrial) to District C-1 (General Commercial), and
WHEREAS, the City Council has submitted the requested change in the Official
Zoning Map to the Planning and Zoning Commission for its recommendation and report,
and
WHEREAS, the Planning and Zoning Commission held a public hearing
concerning the requested change on the 27th day of July 2011, following lawful
publication of the notice of said public hearing, and
WHEREAS, after considering the public testimony received at such hearing, the
Planning and Zoning Commission has recommended that the Official Zoning Map be
amended so that the property described in Exhibit "A" be zoned District C-1 (General
Commercial), and
WHEREAS, on the 25th day of August, 2011, after proper notification, the City
Council held a public hearing on the requested amendment, and

WHEREAS, the City Council determines that the zoning provided for herein
promotes the health, safety, morals and protects and preserves the general welfare of
the community, and
WHEREAS, each and every requirement set forth in Chapter 211, Sub -Chapter
A., Texas Local Government Code, and Section 46-92 and Section 46-132, Code of
Ordinances (2010 Edition), City of Round Rock, Texas concerning public notices,
hearings, and other procedural matters has been fully complied with, Now Therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
I.
That the Official Zoning Map adopted in Section 46-132(b)(1), Code of
Ordinances (2010 Edition), City of Round Rock, Texas, is hereby amended so that the
zoning classification of the property described in Exhibit "A" is hereafter designated as
District C-1 (General Commercial).
II.
A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
expressly repealed.
B. The invalidity of any section or provision of this ordinance shall not
invalidate other sections or provisions thereof.
C. The City Council hereby finds and declares that written notice of the date,
hour, place and subject of the meeting at which this Ordinance was adopted was posted
and that such meeting was open to the public as required by law at all times during
which this Ordinance and the subject matter hereof were discussed, considered and
formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

BEGINNING at a 1/2 inch iron rod found for the northeast corner
of said Tract III and an interior corner of that certain tract

Item Summary:
This rezoning is being requested by William A. Behrens. The parent tract contains approximately 36 acres of land
along the western side of Chisholm Trail Road wrapping around to the northwest corner of Chisholm Trail and the IH
35 southbound access. The easternmost portion of the tract north of Chisholm Trail and IH 35 is shown on the
Future Land Use Plan as commercial, as is the adjacent land with IH 35 frontage. General Commercial is desirable
along the IH 35 corridor as it allows for highway commercial development. The proposed rezoning request from
Light Industrial (LI) to General Commercial (C-1) is consistent with the General Plan.
The undeveloped subject tract contains 7.075 acres and proposes a new car dealership, which is allowed in the
General Commercial District by right. The applicant is proposing a paint and body shop as the first phase of
development with the dealership being the second phase of development. While a paint and body shop is allowed
by -right in the existing Light Industrial zoning district, the ultimate goal of developing a car dealership necessitates
the rezoning request. Should the rezoning request be approved, the applicant will submit a special use permit
application for consideration and approval of a special use permit for the paint and body shop through the Zoning
Board of Adjustment.

Public notice was posted and a public hearing was held in accordance with
the City of Round Rock's Zoning Ordinance at the Planning and Zoning
Commission meeting on July 27, 2011.
Approval - the Planning and Zoning Commission also recommended approval
of the proposed zoning change at their July 27, 2011 meeting.
