(r1361-2,54,81 A ORDINANCE OF THE CITY OF ROUND ROCK, TEXAS, CALLING A SPECIAL ELECTION FOR NOVEMBER 8, 2011 FOR THE PURPOSE OF SUBMITTING TO THE VOTERS (1) CERTAIN PROPOSED AMENDMENTS TO THE HOME RULE CHARTER OF THE CITY, (2) THE PROPOSAL FOR THE APPROVAL OF A SPORTS AND COMMUNITY VENUE PROJECT PURSUANT TO CHAPTER 334, LOCAL GOVERNMENT CODE AND FOR A TWO PERCENT HOTEL OCCUPANCY TAX; AND (3) THE PROPOSAL FOR IMPLEMENTING AND EXPANDING THE PURPOSES FOR WHICH PROCEEDS OF THE EXISTING SALES AND USE TAX PREVIOUSLY ADOPTED PURSUANT TO CHAPTER 501, SUBCHAPTER B, LOCAL GOVERNMENT CODE MAY BE USED; DESIGNATING ELECTION PRECINCTS AND POLLING PLACES; PROVIDING FOR EARLY VOTING AND ELECTION DAY VOTING; PROVIDING FOR PERFORMANCE OF REQUIRED ADMINISTRATIVE DUTIES; PROVIDING FOR CONDUCT OF THE ELECTION; CERTIFYING PROVISION OF REQUIRED ACCESSIBLE VOTING SYSTEMS AT EACH POLLING PLACE; AND PROVIDING FOR OTHER MATTERS RELATED TO SUCH ELECTION. WHEREAS, the City Council wishes to submit to the voters certain proposed amendments to the Home Rule Charter of the City of Round Rock, (the "City"); and WHEREAS, Section 13.11 of the Charter provides that proposed amendments to such Charter may be framed and submitted to the voters of the City in the manner provided by Tex.Loc.Gov't. Code Ann., Chapter 9, as amended; and WHEREAS, §9.004(b) Texas Local Government Code requires the charter amendment election to be held on the first authorized uniform election date prescribed by the Election Code which allows sufficient time to comply with other requirements of law and which occurs on or after the thirtieth (30th) day after the date on which the Ordinance is adopted; and WHEREAS, in Resolution No. R -11-05-26-11B4 the City Council designated a Sports and Community Venue Project (referred to herein as the "Venue Project", more particularly described in Section 10 below) and declared its intention to finance and to provide for the 00230883.DOC/sls planning, acquisition, establishment, development, construction, renovation, operation or maintenance thereof, all pursuant to the authority granted by Chapter 334; and WHEREAS, the City has received a determination from the Comptroller of Public Accounts that the Venue Project will not have a significant negative fiscal impact on state revenue; and WHEREAS, pursuant to Chapter 334 of the Local Government Code, the City Council deems it advisable to call a special election on the question of authorizing the Venue Project and authorizing an additional hotel occupancy tax at a rate not to exceed two percent (2%); and WHEREAS, pursuant to an election held within the City on August 9, 1997, the voters within the City approved the adoption of an additional sales and use tax (the "Existing Sales and Use Tax") within the City at the rate of one-half of one percent as authorized by Section 4B, Article 5190.6 Vernon's Texas Civil Statutes, now codified as Chapters 501 and 505, Texas Local Government Code (collectively, the "Act"); and WHEREAS, the proposition and ballot language approved by the voters restricted the use of the Existing Sales and Use Tax for streets, roads, drainage and other transportation system improvements including the payment of maintenance and operating expenses associated with such authorized projects; and WHEREAS, restricting the use of the Existing Sales and Use Tax only to City transportation system purposes has limited the ability of the City to encourage and promote economic development, recreational and community facilities, and other projects as authorized by the Act; and 2 WHEREAS, the City Council now deems it to be in the best interest of the City to call an election pursuant to Section 505.2575 of the Act to expand the purposes for which the proceeds of the Existing Sales and Use Tax may be used to include all purposes authorized by the Act; and WHEREAS, the City Council has determined that November 8, 2011 is the appropriate date for holding such special elections, and that date allows sufficient time to comply with requirements of law; and WHEREAS, the City Council wishes to encourage all registered voters in the City to vote in this election; and WHEREAS, it is hereby officially found and determined that the written public notice of the date, hour, place, purpose and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof where discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551 of the Texas Government Code (as amended); Now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS THAT: Section 1. ELECTION DATE, PRECINCTS AND POLLING PLACES, AND ELECTION JUDGES. Joint Election. The City is located in more than one County and therefore the Williamson County Elections Administrator and Travis County Clerk are conducting the election pursuant to election agreements (the "Election Agreements") between the City and Williamson County and Travis County, respectively, as authorized under Section 31.092 of the Texas Election Code. The election shall be held as a joint election pursuant to Chapter 271 of the Texas Election Code and a joint election agreement to be entered into between the City and the other participating entities located in Williamson County and Travis County, respectively, which are holding an election on November 8, 2011. Election Date. An election shall be held in the City as prescribed by applicable law between the hours of 7:00 A.M. and 7:00 P.M. on November 8, 2011. 3 Precincts and Polling Places. For voters in Williamson County, the City hereby designates the election precincts and polling places designated by the Williamson County Elections Administrator and approved by the Williamson County Commissioners Court for Election Day voting, and same are delineated on Exhibit "A-1" attached hereto and incorporated herein by reverence for all purposes. For voters in Travis County, the City hereby designates the election precincts and polling places designated by the Travis County Elections Administrator and approved by the Travis County Commissioners Court for Election Day voting, and same are delineated on Exhibit "A-2" attached hereto and incorporated herein by reverence for all purposes. Election Judges. The election judges shall be appointed in accordance with the Election Agreements and the Texas Election Code, as amended. For voters in Williamson County, the Williamson County Elections Administrator is conducting such election for the City pursuant to the terms of the Election Agreement. The City Council hereby appoints, for the term of such election, the presiding election judge(s) and alternate election judge(s) as being those designated by the Williamson County Elections Administrator. For voters in Travis County, the Travis County Clerk is conducting such election for the City pursuant to the terms of the Election Agreement. The City Council hereby appoints, for the term of such election, the presiding election judge(s) and alternate election judge(s) as being those designated by the Travis County Clerk. Section 2. ELECTION CLERKS. Unless otherwise directed by the respective County, the Presiding Judge shall appoint not less than two nor more than five resident qualified voters of the City to act as clerks to properly conduct the election. However, if the Presiding Judge appointed actually serves, the Alternate Presiding Judge shall serve as one of the clerks. The appointment of such clerks must include a person fluent in the Spanish language to serve as a clerk to render oral aid in the Spanish language to any voter desiring such aid at the polls on the Election Day. In the absence of the Presiding Judge, the Alternate Presiding Judge shall perform the duties of the Presiding Judge. Section 3. EARLY VOTING. Dates, Times, and Places for Early Voting. For voters in Williamson County, early voting shall be conducted by personal appearance and by mail at the early voting polling places and temporary polling places designated by the Williamson County Elections Administrator and approved by the Williamson County Commissioners Court for early voting, and the same are delineated on Exhibit `B-1" attached hereto and incorporated herein for all purposes. 4 The main early voting place for Williamson County shall be as follows: Williamson County Inner Loop Annex 301 SE Inner Loop Georgetown, Texas For voters in Travis County, early voting shall be conducted by personal appearance and by mail at the early voting polling places and temporary polling places designated by the Travis County Elections Administrator and approved by the Travis County Commissioners Court for early voting, and the same are delineated on Exhibit "B-2" attached hereto and incorporated herein for all purposes. The main early voting place for Travis County shall be as follows: Travis County Clerks Office 5501 Airport Blvd. Austin, Texas Early Voting Clerk. For voters in Williamson County, the City Council hereby appoints the Williamson County Elections Administrator as the City of Round Rock Election Officer and Early Voting Clerk. The Early Voting Clerk's mailing address to which applications for ballots by mail may be sent, for voters residing in Williamson County, is as follows: Rick Barron Post Office Box 209 Georgetown, TX 78627 For voters in Travis County, the City Council hereby appoints the Travis County Clerk as the City of Round Rock Election Officer and Early Voting Clerk. The Early Voting Clerk's mailing address to which applications for ballots by mail may be sent, for voters residing in Travis County, is as follows: Gail Fisher 5501 Airport Road Austin, TX 78751 Applications for ballots by mail must be received not later than 5:00 PM on Tuesday, November 1, 2011. Section 4. EARLY VOTING BALLOT BOARDS. Early voting ballot boards are hereby created to process early voting results, and the Presiding Judge of the boards will be appointed by the Williamson County Elections Administrator and Travis County Clerk, respectively. The Presiding Judge shall appoint not less than two nor more than eighteen resident qualified voters to serve as members of the Early Voting Ballot Boards. 5 Section 5. VOTERS. All resident, qualified voters of the City of Round Rock, Texas shall be entitled to vote at the election. Section 6. CUSTODIAN OF ELECTION RECORDS. The Williamson County Elections Administrator and Travis County Clerk, respectively, shall serve as the custodian of voted ballots, and the City Secretary of Round Rock, Texas shall be appointed as custodian of all other election records. Section 7. NOTICE. Posting. A substantial copy of this Ordinance shall serve as a proper notice of the election. This Ordinance, including a Spanish translation thereof, shall be posted on the bulletin board used by the City to post notices of meetings not less than twenty-one (21) days prior to the date the election is to be held, and shall remain posted through Election Day. Publication. A substantial copy of this Ordinance may serve as a proper notice of the election. The notice, including a Spanish translation thereof, shall be published in the Round Rock Leader, a newspaper of general circulation in the City, not earlier than the thirtieth (30th) day or later than the tenth (10th) day before Election Day. Authorization to City Secretary. The City Secretary is hereby authorized and directed to publish and post the required notices in the manner and for the time periods required by law. Section 8. VOTING DEVICES. Electronic optical scan voting devices may be used in conducting the election. The Williamson County Elections Administrator and the Travis County Clerk, respectively, may also utilize a central counting station as provided by Section 127.000 et seq., as amended, Texas Election Code. Any central counting station presiding judge and the alternate presiding judge shall be appointed in accordance with the Election Agreement and the Texas Election Code. The Williamson County Elections Administrator and Travis County Clerk are currently using election systems and software certified by the Texas Secretary of State. The City Council of the City of Round Rock, Texas, finds as follows: Section 61.012, Texas Election Code, requires that at least one accessible voting station must be provided in each polling place used in a Texas election on or after January 1, 2006. Such system must comply with state and federal laws setting the requirements for voting systems that (i) fully comply with applicable laws relating to accessible voting systems which make voting accessible for disabled voters; and (ii) provide a practical and effective means for voters with 6 physical disabilities to cast a secret ballot. The Office of the Texas Secretary of State has certified that the DRE - Election Systems and Software iVotronic is an accessible voting system that may legally be used in Texas elections. Sections 123.032 and 123.035, Texas Election Code, authorize the acquisition of voting systems by local political subdivisions and further mandate certain minimum requirements for contracts relating to the acquisition of such voting systems. For voters in Williamson County and for voters in Travis County, as chief elections officer for the City of Round Rock, the Williamson County Elections Administrator and Travis County Clerk shall provide at least one DRE - Election Systems and Software iVotronic in each polling place at every polling location used to conduct any election ordered on or after January 1, 2006. The DRE - Election Systems and Software iVotronic may be acquired by any legal means available to the City of Round Rock, including but not limited to lease or rental from Williamson County or Travis County or from any other legal source, as authorized or required by Sections 123.032 and 123.035 of the Texas Election Code. Section 9. CHARTER AMENDMENTS. At the election, the proposed amendments to amend the charter shall be set forth substantially in the form contained herein, and said proposed charter amendments shall be submitted to the qualified voters in accordance with applicable law. The official ballots shall be prepared so as to permit the qualified voters to vote on a proposed charter amendment by ballot title. The ballot title of a proposed charter amendment may differ from its legal title and shall be a clear, concise statement describing the substance of the proposed charter amendment without argument or prejudice. The official ballots for this charter amendment election shall be prepared so as to permit the qualified voters to vote "Yes" or "No" on the proposed charter amendments. Said proposed charter amendments shall be combined with other allowable matters on the same ballots, said ballots to contain such provisions, markings and language as required by law. The proposed charter amendments shall be expressed substantially as follows: PROPOSITION NO. 1 AMENDMENT TO THE HOME RULE CHARTER OF THE CITY OF ROUND ROCK, TEXAS, CLARIFYING THAT CERTAIN MATTERS REQUIRE AN AFFIRMATIVE VOTE OF MORE THAN FOUR MEMBERS OF THE CITY COUNCIL. For ( ) Against ( ) 7 PROPOSITION NO. 2 AMENDMENT TO THE HOME RULE CHARTER OF THE CITY OF ROUND ROCK, TEXAS, TO CHANGE THE TERM "CITY SECRETARY" TO "CITY CLERK." For ( ) Against ( ) PROPOSITION NO. 3 AMENDMENT TO THE HOME RULE CHARTER OF THE CITY OF ROUND ROCK, TEXAS, TO CHANGE THE TERM "TELECOPIER" TO "EMAIL ADDRESS" AND TO CHANGE THE TERM "TELEPHONIC DOCUMENT" TO "ELECTRONIC DOCUMENT." For ( ) Against ( ) PROPOSITION NO. 4 AMENDMENT TO THE HOME RULE CHARTER OF THE CITY OF ROUND ROCK, TEXAS, TO AMEND SECTION 7.02 TO CORRECT A SPELLING ERROR AND TO CORRECT A PARAGRAPH REFERENCE. At the special election called herein, the following proposition shall be submitted in accordance with law: PROPOSITION Pursuant to Chapter 334 of the Texas Local Government Code, authorizing the City of Round Rock to fmance a Sports and Community Venue for a multi-purpose facility and related infrastructure that is used or is planned for use for one or more professional or amateur sports events, community events or other 9 sports events for which a fee for admission to the events is charged or is planned to be charged and will attract overnight stays and generate tourism revenue for the City and imposing an additional hotel occupancy tax at a rate not to exceed two percent (2%). The official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the voters to vote "For" or "Against" the aforesaid Proposition, with the ballots to contain such provisions, markings and language as required by law, and with such Proposition to be expressed substantially as follows: PROPOSITION 9 AUTHORIZING THE CITY OF ROUND ROCK TO FINANCE A SPORTS AND COMMUNITY VENUE PROJECT AND RELATED INFRASTRUCTURE AND TO IMPOSE A HOTEL OCCUPANCY TAX AT A RATE NOT TO EXCEED TWO PERCENT FOR THE PURPOSE OF FINANCING THE VENUE PROJECT. PROPOSITION RELATED TO TYPE B CORPORATION SALES TAX At the special election called herein, the following proposition shall be submitted in accordance with law: PROPOSITION Expand the purposes of the existing one half (%) of one percent Type B sales and use tax to authorize projects as described in Chapters 501 and 505, Texas Local Government Code, including but not limited to projects for the promotion of professional and amateur athletics and sports including stadiums, ball parks, auditoriums, projects related to entertainment, convention, tourist, and exhibition facilities, amphitheaters, concert halls, and public parks, park facilities and events, open space improvements, military facilities, including closed or realigned military bases, primary job training facilities for use by institutions of higher education, research and development facilities, regional or national corporate headquarters facilities, museums and related stores, restaurant, concession, and automobile parking facilities, related area transportation facilities, and related roads, streets, and water and sewer facilities, recycling facilities, and projects to promote new or expanded business enterprises that create or retain primary jobs, and public safety facilities, streets and roads, drainage, and related improvements, demolition of existing structures, development and expansion of affordable 10 housing, and targeted infrastructure and any other improvements, expenditures, or facilities that are related to any of the above projects and any other project that the board determines will promote new or expanded business enterprises that create or retain primary jobs, and the maintenance and operation expenses for any of the above described projects as now or hereafter authorized by law. The official ballot for the election shall be prepared in accordance with the Texas Election Code so as to permit the voters to vote "For" or "Against" the above PROPOSITION, with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITION to be expressed substantially as follows: PROPOSITION NO. 10 AUTHORIZING THE EXISTING TYPE B SALES AND USE TAX TO BE USED FOR ADDITIONAL PURPOSES AS PROVIDED BY STATE LAW. For ( ) Against ( ) Section 12. EXISTING SALES AND USE TAX. Should the aforesaid Proposition No. 10 not be approved by the voters of the City, the Existing Sales and Use Tax shall continue to be levied in accordance with the August 9, 1997 election. Section 13. CONDUCT ACCORDING TO TEXAS ELECTION CODE. In all substantive respects, the election shall be conducted in accordance with the Texas Election Code and any other applicable statutes. Section 14. ELECTION RESULTS. The Williamson County Elections Administrator and Travis County Clerk, respectively, shall conduct an unofficial tabulation of results after the closing of the polls on November 8, 2011. The official canvass and tabulation of the results of the Special Election shall be conducted by the City Council at a Special Council Meeting in accordance with the Election Code. 11 Section 15. MISCELLANEOUS PROVISIONS. The provisions of this Ordinance are severable; and in case any one or more of the provisions of this Ordinance or the application thereof to any person or circumstance should be held to be invalid, unconstitutional, or ineffective as to any person or circumstance, the remainder of this Ordinance nevertheless shall be valid, and the application of any such invalid provision to persons or circumstances other than those as to which it is held invalid shall not be affected thereby. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended.
