R -11-09-08-10A1 WHEREAS, Chapter 791 of the Texas Government Code, V.T.C.A., authorizes local governments and agencies of the state to enter into agreements with one another to perform governmental functions and services, and WHEREAS, the City of Round Rock wishes to enter into an Interlocal Cooperation Contract with the Texas Department of Public Safety for intoxilyzer supplies, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City an Interlocal Cooperation Contract with the Texas Department of Public Safety, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. City Council Agenda Summary Sheet Consider a resolution authorizing the Mayor to execute an Interlocal Cooperation Agenda Caption: Contract with the Texas Department of Public Safety for intoxilyzer supplies. Meeting Date: September 8, 2011 Department: Police Staff Person making presentation: Bryan Williams Chief of Police Item Summary: This is a two-year renewal of an interlocal, cooperative purchasing agreement with the Texas Department of Public Safety. The agreement allows the Police Department to purchase a variety of printed materials and supplies from DPS. The primary reason the Police Department seeks renewal of this agreement is to continue purchasing alcohol blood test kits through DPS for use by police officers in the field. DPS requires police departments to use these kits in order to submit kits used in the field to the DPS laboratory for processing. This agreement does not commit the City to purchase a specific number of kits;•it simply allows the City to do so. The Department spends Tess than $500 on DPS kits annually. The Department also spends under $500 annually on printed DPS forms; the purchase of such forms is described in the agreement and supplemental material, but the Department can purchase printed DPS materials without the agreement. Alcohol blood test kits are among several supply items the DPS maintains for all Texas cities and counties. Using DPS supplies helps control the statewide uniformity of procedures and consistency of paperwork, which strengthens court prosecutions of DWI cases. It is mutually understood that this Contract shall be effective if signed by a person authorized to do so according to the normal operating procedure of said party. If the governing body of a party is required to approve this Contract, it shall not become effective until approved by the governing body of that party. In that event, this contract shall he executed by the duly authorized official(s) of the party as expressed in the approving resolution or order of the governing body of said party, a copy of which shall be attached to this Contract.
