R -11-09-08-10C2 WHEREAS, the City of Round Rock has previously entered into a Community Development Block Grant Agreement ("Agreement") with Round Rock Housing Authority; and WHEREAS, Round Rock Housing Authority has submitted Supplemental Agreement No. 1 to the Agreement to perform additional eligible activities utilizing the remaining budgeted amount under the Agreement; and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 1 with Round Rock Housing Authority, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 1 to the Community Development Block Grant Agreement with Round Rock Housing Authority, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. WHEREAS, City and RRHA executed the original Community Development Block Grant Agreement (hereinafter referred to as the "Agreement") on May 12, 2011; and WHEREAS, RRHA has been able to procure all materials and services necessary to perform all activities set forth in the Agreement at a cost below the budgeted amount; and WHEREAS, RRHA desires to perform additional eligible activities utilizing the remaining budgeted amount under the Agreement; and WHEREAS, the City desires the RRHA to conduct the additional eligible activities; NOW THEREFORE, premises considered, City and RRHA agree that the original Agreement is amended as follows: I. Section 1.1. Activities is amended to read as follows: HOUSING AUTHORITY will be responsible for administering a Community Development Block Grant ("CDBG") Year 2010-2011 program known as the Playground Improvement program in a manner satisfactory to CITY and consistent with any standards required as a condition of providing these funds. Such program will include the following activities eligible under the CDBG Program: Program Delivery Activity: Install a play structure, a gazebo/pavilion, basketball court/pavilion and related improvements on HOUSING AUTHORITY property located at 1505 Lance Lane, Round Rock, Texas. Meeting Date: September 8, 2011 Department: Finance Staff Person making presentation: Cheryl Delaney Finance Director Item Summary: On October 4, 2010 the Community Development Advisory Commission (CDAC) recommended to the City Council that the CDBG 2010 Annual Plan be amended in order to reallocate Home Repair Funds to Facility Improvements and Park Improvements in order to expend the funds in a timely manner. Public hearings were held and the CDBG 2010 Annual Plan was amended and Home Repair Funds were reallocated in the amount of $226,052 to Facility Improvements and Parks Projects. On May 12, 2011 the City Council approved an agreement with the Round Rock Housing Authority in the amount of $136,052 by Resolution R -11-05-12-12C2 for the following facility improvements at the three housing authority locations: *1505 Lance Lane -installation of a shaded playscape, gazebo/pavilion, picnic tables and benches, bike rack, trash receptacles *1100 Westwood -installation of a bike rack, swing set *1007 Cushing Drive -installation of a gazebo/pavilion This amendment incorporates the construction of a basketball court and pavilion at the 1505 Lance Lance location and the deletion of the swing set at 1100 Westwood. This additional work will not increase the original contract amount.
