R -11-09-08-10E1 WHEREAS, Business Interstate 35 and RM 620 are part of the roadway system of the State of Texas and are currently maintained by the Texas Department of Transportation ("TxDOT"); and WHEREAS, in the City of Round Rock, ("City") Business Interstate 35 is also named Hesters Crossing Blvd. and Mays Street; and WHEREAS, in the City RM 620 is also named Round Rock Avenue; and WHEREAS, a portion of Business Interstate 35 and a portion of RM 620 as described in Exhibit A serve more as city streets than state highways, and it would be beneficial to the City and to the State of Texas for the City to accept such streets for maintenance and repair; and WHEREAS, the City Council is agreeable to consider accepting from TxDOT all right, title, and interest in the above described roadways and the City will accept the responsibility for future repair and maintenance of said roadways; Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the City Council hereby authorizes and directs the City Manager and his staff to negotiate with TxDOT to convey its interest in the above described roadways to the City and the City will accept the responsibility for maintaining and repairing same. Consider a resolution authorizing the City Manager to negotiate an agreement with TxDOT for the assumption of operations and maintenance by the City of a portion of RM Agenda Caption: 620 and Business IH 35 (Mays Street). Meeting Date: September 8, 2011 Department: Transportation Staff Person making presentation: Gary Hudder Transportation Director Item Summary: Mays Street in Round Rock is presently part of the Texas Department of Transportation (TxDOT) highway system, also known as Business Interstate 35-L (BI 35). While this is a state highway, this roadway serves primarily as a local street, providing access to and from local businesses and properties; this is especially true between Brushy Creek and the bridge over the Union Pacific Railroad (UPRR)/Lake Creek. At various times the Council has expressed interest in making improvements to Mays Street, especially between Brushy Creek and the UPRR/Lake Creek bridge to promote economic development and to further emphasize the downtown area. Improvements are also desired that would increase the operational efficiency of this roadway, particularly at intersections. In order to receive approval to implement any of these changes, lengthy negotiations with TxDOT would be necessary, and in many cases the City's desires would have to be sacrificed to meet the state's design requirements. In exploring options of how to navigate this situation, one option which has been presented was that of the City assuming operations and maintenance of this roadway (also called "taking the road off the state system"). Once the road was under the jurisdiction of the City, the City would have ultimate control of the road, allowing the implementation of improvements and changes as deemed appropriate by the City. Accordingly, staff approached TxDOT officials about the possibility of taking Mays Street off of the state system, with the City assuming operations and maintenance of this roadway. TxDOT indicated that they would be amenable to this arrangement. However, TxDOT would require the City to take the road over between the limits of US 79 and Hester's Crossing, and they would also require the City to assume ownership of RM 620 between IH -35 and Mays Street. PROSPERITY City Council Agenda Surnmary Sheet The benefit of taking the road over from the state is the unfettered latitude it would afford the City in the design of this road: with City ownership the design of all features including but not limited to sidewalks, lighting, signage, landscaping, as well as such features as lane widths, roadside clearances, and signal operations would be under the ultimate control and jurisdiction of the City Council. The only identified detriment to this arrangement would be a recurring maintenance cost. Staff has estimated the cost of maintaining this road to be approximately $230,000 per year - this is an annualized cost. The assumptions of maintenance and operations is a multi -step process, with adoption of this resolution being the first step. The next steps include title research, survey and appraisals of the right-of-way to be conveyed, followed by action of the Texas Transportation Commission.
