AN ORDINANCE AMENDING CHAPTER 42, SECTION 42-127, CODE
OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK, TEXAS,
CHANGING THE SPEED ZONE ON A PORTION OF MAYS STREET;
PROVIDING FOR A SAVINGS CLAUSE AND REPEALING
CONFLICTING ORDINANCES OR RESOLUTIONS.
WHEREAS, Section 545.352 of the Texas Transportation Code establishes
prima facie reasonable and prudent speed limits for streets and highways situated in the
state of Texas, and
WHEREAS, Section 545.356 of the Texas Transportation Code authorizes the
governing body of a municipality to alter, by ordinance, prima facie speed limits
pursuant to an engineering and traffic investigation, and
WHEREAS, an engineering and traffic investigation was conducted on a portion
of Mays Street (north and southbound) from Northwest Drive to West Nash Street on
the 14th day of May, 2007, and
WHEREAS, a copy of said engineering and traffic study is attached hereto and
incorporated herein for all purposes as Exhibit "A", and
WHEREAS, the results of said engineering and traffic investigation indicate that
the speed limit on a portion of Mays Street (north and southbound) from Sunset Drive to
West Nash Street should be 35 miles per hour, and
WHEREAS, the results of said engineering and traffic investigation further
indicates that the speed limit on a portion of Mays Street (north and southbound) from
Northwest Drive to Sunset Drive should be 45 miles per hour, Now Therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:

That Chapter 42, Section 42-127, subsection (5), of the Code of Ordinances
(2010 Edition), City of Round Rock, Texas, is hereby amended by adding the following:
(5) The maximum prima facie speed limit shall be thirty-five (35) miles per hour along the
following streets:

Mays Street
north and southbound
FROM TO
Sunset Drive West Nash Street

That Chapter 42, Section 42-127, subsection (7), of the Code of Ordinances
(2010 Edition), City of Round Rock, Texas, is hereby amended by adding the following:
(7)
The maximum prima facie speed limit shall be forty-five (45) miles per hour along the
following streets:

Northwest Drive Sunset Drive

A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
expressly repealed.
B. The invalidity of any section or provision of this ordinance shall not
invalidate other sections or provisions thereof.
C. The City Council hereby finds and declares that written notice of the date,
hour, place and subject of the meeting at which this Ordinance was adopted was posted
and that such meeting was open to the public as required by law at all times during
which this Ordinance and the subject matter hereof were discussed, considered and

formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

Item Summary:
At the City's request, the Texas Department of Transportation (TxDOT) performed an engineering study in order to
determine the appropriate speed limits on Business IH -35 (Mays Street) between US 79 (Palm Valley) and Hester's
Crossing. The study showed that Mays Street from West Nash Street to Sunset Drive should be amended to 35
MPH, and that between Sunset Drive and Northwest Drive should be amended to 45 MPH. The signed speed limit of
40 MPH south of West Nash Street will remain as is, as will the 45 MPH signed speed limit north of Northwest Drive.
These changes will create a more concise series of speed zones by eliminating the existing 40 MPH zone between
Sunset Drive south of Palm Valley and Northwest Drive north of Palm Valley. Also, the increase from 30 MPH to 35
MPH between West Nash Street and Sunset Drive will not require any changes to the school safety zone for student
pedestrian traffic traveling to and from the Berkman Elementary School and the CD Fulkes Middle School campuses.
