3 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE
4 CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 46-132(b)(1),
5 CODE OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK,
6 TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID
7 OFFICIAL ZONING MAP, TO WIT: TO ORIGINALLY ZONE 11.27
8 ACRES OF LAND OUT OF THE WILLIS DONAHO SURVEY,
9 ABSTRACT NO. 173, IN ROUND ROCK, WILLIAMSON COUNTY,
10 TEXAS, AS DISTRICT LI (LIGHT INDUSTRIAL).

12 WHEREAS, the City of Round Rock, Texas has annexed 11.27 acres of land out
13 of the Willis Donaho Survey, Abstract No. 173 in Round Rock, Williamson County,
14 Texas, being more fully described in Exhibit "A" (the "Property"), attached hereto and
15 incorporated herein, and
16 WHEREAS, the Planning and Zoning Commission held a public hearing
17 concerning the original zoning of the Property on the 14th day of December, 2011,
18 following lawful publication of the notice of said public hearing, and
19 WHEREAS, after considering the public testimony received at such hearing, the
20 Planning and Zoning Commission has recommended that the Official Zoning Map be
21 amended so that the Property in Exhibit "A" be originally zoned as District LI (Light
22 Industrial), and
23 WHEREAS, on the 12th day of January, 2012, after proper notification, the City
24 Council held a public hearing on the proposed original zoning, and
25 WHEREAS, the City Council determines that the zoning provided for herein
26 promotes the health, safety, morals and protects and preserves the general welfare of
27 the community, and
28 WHEREAS, each and every requirement set forth in Chapter 211, Sub-Chapter
29 A., Texas Local Government Code, and Section 46-92 and Section 46-132, Code of

2 hearings, and other procedural matters has been fully complied with, Now Therefore
3 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
4 TEXAS:
5 I.
6 That the City Council has considered and hereby makes the following findings
7 regarding this original zoning:
8 1. It is consistent with the general plan;
9 2. It is compatible with the present zoning and conforming uses of nearby
10 property and with the character of the neighborhood;
11 3. The affected property is suitable for existing uses that are and would be
12 permitted by District L-1 (Light Industrial); and
13 4. Water, wastewater, and stormwater facilities are suitable and adequate
14 and are available for the existing uses in District L-1 (Light Industrial).
15 II.
16 That the Official Zoning Map adopted in Section 46-132(b)(1), Code of
17 Ordinances (2010 Edition), City of Round Rock, Texas, is hereby amended so that the
18 zoning classification of the property described in Exhibit "A" is hereafter designated as
19 District LI (Light Industrial).
20 III.
21 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
22 expressly repealed.
23 B. The invalidity of any section or provision of this ordinance shall not
24 invalidate other sections or provisions thereof.

I C. The City Council hereby finds and declares that written notice of the date,
2 hour, place and subject of the meeting at which this Ordinance was adopted was posted
3 and that such meeting was open to the public as required by law at all times during
4 which this Ordinance and the subject matter hereof were discussed, considered and
5 formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas
6 Government Code, as amended.

8 By motion duly made, seconded and passed with an affirmative vote of all the
9 Council members present, the requirement for reading this ordinance on two separate
10 days was dispensed with.

Item Summary:
The property is home to CASA Mechanical Services,which is an HVAC and plumbing business. The property was annexed
in 2006 without assignment of zoning and has remained unzoned. The owner is proposing to zone the property Light
Industrial,which allows for the existing use to continue. The General Plan Future Land Use Map designates this property
as Industrial;therefore,the LI zoning is also consistent with the General Plan. The property is being zoned now in order to
facilitate platting of the property so that it can connect to city water and sewer. Because the site was developed when it
was outside the City, it may or may not meet all site development standards currently found in the Zoning Code (e.g.
landscaping, parking and metal building). At such time the site is expanded or redeveloped,the standards in effect at that
time will apply. Annexation and original zoning do not warrant upgrades to site development standards set forth by the
Zoning Code.
The portion of East Old Settlers Blvd.on which this property takes frontage was realigned and improved in 2011.Since the
property is already developed and given the recent improvements to East Old Settlers Blvd., a Traffic Impact Analysis was
not warranted with this application.
There is an existing 24-inch waterline on the north side of Old Settlers Blvd. and an 8-inch waterline south of the site
within Chandler Creek Section 13.Wastewater will be extended from Chandler Creek Section 13.
Pursuant to Zoning Code Section 46-105(d),the Council shall consider and make findings regarding the following criteria:
1. Consistency(or lack thereof)with the general plan;
2. Compatibility with the present zoning and conforming uses of nearby property and with the character of the
neighborhood;
3. Suitability of the property affected by the amendment for uses permitted by the district that would be made
applicable by the proposed amendment;
4. Suitability of the property affected by the amendment for uses permitted by the district applicable to the property at
the time of the proposed amendment;and
S. Availability of water,wastewater and stormwater facilities suitable and adequate for the proposed use.
Staff believes that the proposed zoning meets the above criteria. The Planning and Zoning Commission unanimously
recommended approval of this zoning at the December 14,2011 meeting.
