R-12-03-08-9A1 WHEREAS,the U.S. Endangered Species Act(the"Act")was enacted in 1973; and WHEREAS, the original intent of the Act was to conserve and protect species of plant and wildlife that are imminently threatened with extinction; and WHEREAS, the Act has been increasingly used to block development projects and to deter the legal use of privately owned land; and WHEREAS, the Act precludes federal agencies from considering economic impacts, thereby often resulting in significant negative consequences to the regional and national economies; and WHEREAS, the Act dramatically increases the taxpayer's cost of constructing needed infrastructure such as roads and utility lines, and often prohibits such construction altogether; and WHEREAS, agency rulings are often based on insufficient scientific evidence because of unrealistic legal deadlines and the threat of lawsuits;Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Round Rock City Council hereby urges Congressman Carter and Senators Hutchison and Cornyn to support amendments to the Endangered Species Act and related regulations so as to ensure that sound science, economic impacts, and cost-benefit considerations are the foundation of species-protection strategies; and the Round Rock City Council strongly opposes the listing of any Texas species and sub-species currently under consideration absent sound science, consideration of economic impact, and analyses of cost-benefit considerations. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject O:\wdox\SCC1nts\0112\1204\MUNICIPAL\00244752.DOCX/sls matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended.
