"�� 0+- 2 3 AN ORDINANCE AMENDING CHAPTER 2, SECTIONS 2-19, 2-22, AND 2-26, CODE 4 OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK, TEXAS, REGARDING 5 THE CITY COUNCIL MEETINGS; AND PROVIDING FOR A SAVINGS CLAUSE AND 6 REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. 7 8 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, 9 TEXAS: 10 I. 11 That Chapter 2, Section 2-19, Code of Ordinances (2010 Edition), City of Round 12 Rock, Texas, is hereby amended to read as follows: 13 Sec. 2-19. Regular meetings. 14 15 Under authority of section 3.09 of the city Charter, the city council has designated the following days and 16 times to conduct its two regular monthly meetings: 17 18 (1) Except for the month of December, the two regular monthly meetings of the city council 19 shall be held on the second and fourth Thursdays of each month at 7:00 p.m. 20 21 (2) During the month of December, the two regular monthly meetings of the city council shall 22 be held on the first Thursday at 7:00 p.m. and the third Thursdays at-75:00 p.m. 23 24 25 II. 26 That Chapter 2, Section 2-22, Code of Ordinances (2010 Edition), City of Round 27 Rock, Texas, is hereby amended to read as follows: 28 Sec. 2-22. Council work sessions. 29 30 If required, city council work sessions will generally be held on the Tuesday prior to the Thursday council 31 meeting of each month and will generally commence at 7:030 pa.m. City council work sessions may be 32 held at such other times as may be necessary or beneficial. Public notice of all city council work sessions 33 shall be given as required by the Texas Open Meetings Act, V.T.C.A., Government Code ch. 551. 34 35 36 III. 37 That Chapter 2, Section 2-26, Code of Ordinances (2010 Edition), City of Round 38 Rock, Texas, is hereby amended to read as follows: 0:4dox\,SCC I..\0112\1204\MUNICIPAL\00247294.DOCIII I I Sec. 2-26. -Agenda and rules of procedure for council meetings. 2 (a) Agenda. 3 4 (1) Preparation. The city manager shall prepare or cause to be prepared an agenda for each 5 city council meeting, work session, or retreat. 6 7 (2) Placement of agenda items by council members. The city manager shall include on such 8 agenda any item, other than a proclamation, which is requested by two or more council 9 members, provided that such requests are timely and in writing. The city manager shall 10 include on such agenda any proclamation which is requested by any council member. 11 12 (3) Public availability of agenda. In addition to the requirements of the Texas Open Meetings 13 Act, V.T.C.A., Government Code ch. 551, the city council agenda and supporting 14 materials, excluding exempt materials, shall be made available to any member of the 15 public who properly requests same. However, any member of the public requesting the 16 city council agenda and/or supporting materials, excluding exempt materials, shall pay all 17 costs associated with the reproduction of the city council agenda and/or supporting 18 materials, excluding exempt materials, in accordance with the standards established by 19 the general services commission. The city council agenda shall also be made available to 20 the public on the city's internet website. 21 22 (4) Consent agenda. 23 24 a. Definition. Any items to be brought before city council which are considered by 25 the city manager to be routine, noncontroversial, and needing no discussion may 26 be placed on the consent agenda. For purposes of example only, the following 27 are routine items which may be considered for placement on the consent 28 agenda: approval of minutes, approval of license applications and bonds, 29 approval of payment of contracts, approval of annexations, approval of the 30 unanimous recommendations of advisory committees, setting dates for hearings, 31 accepting deeds, easements, final reading and adoption of ordinances, 32 resolutions, approval of publishing notices, and leases/agreements previously 33 approved in principle. All of the foregoing examples are demonstrative only and 34 are not meant or intended to be exclusive. 35 36 b. Placement on consent agenda. 37 38 I 1. All items placed on the consent agenda shall he m.,...e ,.,;.h an ,s4ericL 39 * , shall be treated as one agenda item. Each item included on the 40 consent agenda shall be numbered separately and be reasonably 41 explained. 42 43 2. All second readings of ordinances approved unanimously on first reading 44 shall presumptively be placed on the consent agenda. 45 46 3. The consent agenda portion of the printed agenda shall be preceded by 47 an explanatory note to the public, in substantially the same wording as 48 follows: "All matters listed hereunder as the consent agenda are 49 considered to be routine by the city council and will be enacted by one 50 motion in the form listed below. There will be no separate discussion of 51 these items. If discussion is desired, that item will be removed from the 52 consent agenda upon the request of any council member and will be 53 considered separately." 54 55 C. Consideration of items on consent agenda. 56 2 1 1. Questions and explanation of consent agenda items will be permitted, 2 but there shall be no general discussion or debate. 3 4 2. The city council shall vote on the consent agenda as one item, so 5 passage of the consent agenda will be passage of each item included 6 thereon. Failure to pass the consent agenda will not defeat each item 7 included thereon; in such event, each item shall be considered 8 individually. 9 10 3. Prior to the consent agenda being voted upon, any item included thereon 11 shall be removed upon the request of any council member. A request for 12 removal from the consent agenda may be made either in writing or 13 verbally. Any item removed from the consent agenda shall be considered 14 as a separate action item at the meeting on which such item appears on 15 the consent agenda. 16 17 (b) Rules of procedure and conduct of council meetings. 18 19 (1) Chair. All city council meetings shall be presided over and conducted by the mayor or, in 20 his absence, the mayor pro tem. 21 22 (2) Rules of order. All meetings of the city council shall be conducted generally in 23 accordance with Robert's Rules of Order, in its most current revised edition. 24 25 (3) Parliamentarian. The city attorney shall be designated as parliamentarian and shall make 26 rulings on parliamentary procedure when requested to do so by a council member or 27 when the legality or validity of a council action might be affected. 28 29 (4) Presentation by city staff. With the exception of the consent agenda, city staff shall make 30 any presentation necessary for a public hearing or before consideration of a possible 31 action item. 32 33 (5) Citizen communications. 34 35 a. Opportunity to address council provided. An opportunity for any person to address 36 the city council at any regular meeting shall be provided under an agenda item 37 entitled"Citizen Communications." 38 39 b. Procedure for citizen placing item on agenda. To place an item on the agenda 40 I under "Citizen Communications," a written request therefor shall be filed with the 41 city secretary-clerk no later than six days prior to the day of the meeting for which 42 discussion of the matter is requested. Such written request shall contain the 43 following: 44 45 1. A brief, concise statement of the matter to be addressed; 46 47 2. The name, address, and telephone number of the person filing the 48 request; 49 50 3. The name of the group or organization, if any, that the person is 51 representing; 52 53 4. An estimate of the amount of time required to present the matter. 54 55 Except as authorized by a majority of the city council, discussion on each item 56 under "Citizen Communications" shall be limited to no longer than 15 minutes 57 total. 3 1 2 C. Limitation on council taking action. No matter brought before the city council 3 during "Citizen Communications" may be acted upon by the city council unless 4 the specific matter appears on the posted agenda as provided by law. 5 6 d. Procedure for citizen addressing council when item not on agenda. 7 8 1. Any person wishing to address the city council concerning a matter not 9 on the agenda under"Citizen Communications" may do so provided that 10 he limits such presentation to three minutes, and provided that he has 11 previously delivered to the city —clerk a registration card 12 identifying the topic on which the person desires to address the city 13 council. 14 15 2. The registration card shall include the following information: 16 17 (i) Full name; 18 (ii) Business and/or residential address; 19 (iii) Business and/or residential telephone number; 20 (iv) Representation; 21 (v) Agenda item or topic; 22 (vi) Brief statement of position, e.g., for or against an agenda item or 23 summary of communication. 24 25 3. Persons properly and timely submitting registration cards will be heard 26 after the items on the agenda have been heard. 27 28 4. Persons addressing the city council concerning a matter not on the 29 agenda shall be limited to no more than three minutes. However, the 30 mayor may expand the time limit set forth up to one additional three- 31 minute period if the presenter requests an extension and if no council 32 member objects. If a council member objects to the presenter's request 33 for an extension, then the city council shall vote to approve or disapprove 34 the request for extension. 35 36 5. If the number of persons signing up to address the council during 37 "Citizen Communications" exceeds a total of ten, the mayor may limit the 38 time for each person to less than three minutes unless a council member 39 objects. If a council member objects to the time limitation, then the city 40 council shall vote to approve or disapprove the time limitation. 41 42 6. Either the city 6e^ —clerk or the city attorney shall serve as 43 timekeeper for any presentation made to the city council. 44 45 7. The mayor may deny any presenter the opportunity to address the city 46 council if the presentation made or offered is substantially repetitive of a 47 presentation previously made. 48 49 e. Procedure for citizens addressing the council during public hearings. 50 51 1. Any person wishing to address the city council concerning a public 52 hearing may do so provided that he or she limits such presentation to 53 three minutes, and provided that he or she has previously delivered to 54 the city sesretafy-clerk a registration card identifying the public hearing 55 on which the person desires to address the city council. 56 57 2. The mayor may deny any person the opportunity to address the city 28 council if the presentation made or offered is substantially repetitive of a 29 presentation previously made or is not relevant to the matter for which 30 the public hearing is held. 31 32 (6) Call of agenda items. The mayor may call each agenda item by number or short caption 33 only. It shall not be necessary to call an agenda item by its complete caption. 34 35 (7) Council vote. The city seGre aprcIerk shall maintain, and the minutes shall reflect, all 36 votes made by the city council in open meeting. 37 38 39 IV. 40 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are 41 expressly repealed. 42 B. The invalidity of any section or provision of this ordinance shall not 43 invalidate other sections or provisions thereof. 44 C. Consider an ordinance amending Chapter 2, Sections 2-19, 2-20, 2-22 and 2-26, Code of Agenda Caption: Ordinances(2010 Edition) regarding the City Council meetings. (First Reading) Meeting Date: April 12,2012 Department: Administration Staff Person making presentation: Sara White City Clerk Item Summary: The following changes are being proposed in this ordinance: • Change the time of the 2nd meeting in December from 7:00 p.m. to 5:00 p.m.—we already do this annually by ordinance to allow City Staff and the Council to attend the Mayor's holiday party. This amendment just makes the time change official so an annual ordinance is not needed. • Changing all the "City Secretary" terms to "City Clerk" to be consistent with the charter amendment from November 2011. • Removing the requirement of consent items to be marked with an asterisk on the agenda. A redesign of the City Council agendas will follow upon approval on this ordinance in which all consent items will be listed together under the consent heading making it easier to know what items are on consent.
