AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 46-132(b)(1), CODE OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK, TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID OFFICIAL ZONING MAP, TO WIT: TO ORIGINALLY ZONE 10.62 ACRES OF LAND OUT OF THE ASA THOMAS SURVEY, ABSTRACT NO. 609, IN ROUND ROCK, WILLIAMSON COUNTY, TEXAS, AS DISTRICT PF-3 (PUBLIC FACILITIES—HIGH INTENSITY). WHEREAS, the City of Round Rock, Texas has recently annexed 10.62 acres of land out of the ASA Thomas Survey, Abstract No. 609 in Round Rock, Williamson 1 County, Texas, being more fully described in Exhibits "A" and "B" (the "Property"), y attached hereto and incorporated herein, and E r WHEREAS, the Planning and Zoning Commission held a public hearing concerning the original zoning of the Property on the 11th day of April, 2012, following lawful publication of the notice of said public hearing, and I WHEREAS, after considering the public testimony received at such hearing, the i 1 Planning and Zoning Commission has recommended that the Official Zoning Map be amended so that the Property in Exhibits "A" and "B" be originally zoned as District PF-3 (Public Facilities-High Intensity), and 1 WHEREAS, on the 10th day of May, 2012, after proper notification, the City Council held a public hearing on the proposed original zoning, and WHEREAS, the City Council determines that the zoning provided for herein promotes the health, safety, morals and protects and preserves the general welfare of s the community, and WHEREAS, each and every requirement set forth in Chapter 211, Sub-Chapter A., Texas Local Government Code, and Section 46-92 and Section 46-132, Code of O\wdoz\SCCIn[s\0112\1204MUNICIPAL\00249008.DOC/= Original Zoning Ordinance 1/12 R f } yy i-- { Ordinances (2010 Edition), City of Round Rock, Texas concerning public notices, hearings, and other procedural matters has been fully complied with, Now Therefore fi BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, k TEXAS: That the City Council has considered and hereby makes the following findings regarding this original zoning: k 1. It is consistent with the general plan; 3 l 2. It is compatible with the present zoning and conforming uses of nearby { property and with the character of the neighborhood; a f 3. The affected property is suitable for existing uses that are and would be permitted by District PF-3 (Public Facilities —High Intensity); and 4. Water, wastewater, and stormwater facilities are suitable and adequate F i and are available for the existing uses in District PF-3 (Public Facilities- High Intensity). IL That the Official Zoning Map adopted in Section 46-132(b)(1), Code of k. (First Reading) Meeting Date: May 10, 2012 Department: Planning and Development Services Staff Person making presentation: Peter Wysocki Planning and Development Services Director ' r Item Summary: This request is comprised of two tracts that flank the existing church on the south side of Gattis School Road in the E 4' vicinity of Westview Drive. All three Fellowship Church tracts are on the agenda are requesting to be zoned Public Facilities - High Intensity Zoning District. The purpose for the zoning request is to ensure all three tracts have the same development standards allowing for the church and accessory uses. These two tracts are currently in the ETJ, however,a voluntary annexation application is also on this agenda.The General Plan indicates residential use for the two tracts - places of worship are allowed in residential. The proposed rezoning to PF-3 (Public Facilities - High Intensity) allows for a religious campus without constraints on accessory building sizes which is in conformance with ; the General Plan. t Water and wastewater service will be determined during future development and platting. At this time, both tracts are undeveloped and do not require service. Water and wastewater services exist within Gattis School Road; however,wastewater services will necessitate off-site improvements. 6 t S A Development Agreement was approved by City Council requiring the church to extend a waterline main across their property, pay impact fees for a domestic meter, and annex and zone these two tracts of land. E t The Planning and Zoning Commission unanimously recommended approval of the zone change at their April 11, 2012 meeting. ZONING FINDINGS Pursuant to the Zoning Ordinance Section 46-105, approval of a zoning map amendment must meet the following findings: i 1. It is consistent with the general plan. Staff Response: As previously discussed, the proposed zoning to PF-3 (Public Facilities - High Intensity) is consistent with the Residential Land Use Classification established by the General Plan. It is compatible with the present zoning and conforming uses of nearby property and to the character of the neighborhood. Staff Response: The expansion of a church campus with accessory uses is compatible with the adjacent existing single-family residential. The church has frontage on Gattis School Road and is not located internal to the adjacent i neighborhood, thus lessening potential traffic impacts of the use. Any expansion of the site is required to comply r with the design requirements of the Ordinance including setbacks, landscaping and parking, thus further ensuring compatibility with existing residential uses. 3. The affected property is suitable for existing uses that are and would be permitted by District PF-3 (Public : Facilities- High Intensity). s i Staff Response: Fellowship Church exists on the adjacent property.The PF-3 zoning district allows for the continued operation and future expansion of the use. s` 4.
