AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE
CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 46-132(b)(1),
CODE OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK,
TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID
OFFICIAL ZONING MAP, TO WIT: TO REZONE 5.30 ACRES OF
LAND, OUT OF THE ASA THOMAS SURVEY, ABSTRACT NO. 609, IN

ROUND ROCK, WILLIAMSON COUNTY, TEXAS, FROM DISTRICT PF-
1 (PUBLIC FACILITIES —LOW INTENSITY) TO DISTRICT PF-3 (PUBLIC
FACILITIES —HIGH INTENSITY).
WHEREAS, an application has been made to the City Council of the City of
Round Rock, Texas to amend the Official Zoning Map to rezone 5.30 acres of land, out
of the ASA Thomas Survey, Abstract No. 609, in Round Rock, Williamson County,
Texas, being more fully described in Exhibit "A" attached hereto, from District PF-1

(Public Facilities-Low Intensity) to District PF-3 (Public Facilities-High Intensity), and
WHEREAS, the City Council has submitted the requested change in the Official
Zoning Map to the Planning and Zoning Commission for its recommendation and report,

and
WHEREAS, the Planning and Zoning Commission held a public hearing
concerning the requested change on the 11th day of April 2012, following lawful

publication of the notice of said public hearing, and

WHEREAS, after considering the public testimony received at such hearing, the

Planning and Zoning Commission has recommended that the Official Zoning Map be
amended so that the property described in Exhibit "A" be zoned District PF-3 (Public

Facilities-High Intensity), and
WHEREAS, on the 10th day of May, 2012, after proper notification, the City
Council held a public hearing on the requested amendment, and

WHEREAS, the City Council determines that the zoning provided for herein
promotes the health, safety, morals and protects and preserves the general welfare of
the community, and
WHEREAS, each and every requirement set forth in Chapter 211, Sub-Chapter
A., Texas Local Government Code, and Section 46-92 and Section 46-105, Code of
Ordinances (2010 Edition), City of Round Rock, Texas concerning public notices,
hearings, consideration, findings, and other procedural matters has been fully complied
with, Now Therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
That the City Council has considered and hereby makes the following findings

regarding this amendment:
1. It is consistent with the general plan;
2. It is compatible with the present zoning and conforming uses of nearby
property and with the character of the neighborhood; 3
3. The affected property is suitable for uses that are and would be permitted

by District PF-3 (Public Facilities-High Intensity); and
4. Water, wastewater, and stormwater facilities are suitable and adequate
and are available for the permitted uses in District PF-3 (Public Facilities-
High Intensity).
II.
That the Official Zoning Map adopted in Section 46-132(b)(1), Code of
Ordinances (2010 Edition), City of Round Rock, Texas, is hereby amended so that the

zoning classification of the property described in Exhibit "A" is hereafter designated as
District PF-3 (Public Facilities-High Intensity).

A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
expressly repealed.
B. The invalidity of any section or provision of this ordinance shall not
invalidate other sections or provisions thereof.

C. The City Council hereby finds and declares that written notice of the date,

hour, place and subject of the meeting at which this Ordinance was adopted was posted
and that such meeting was open to the public as required by law at all times during
which this Ordinance and the subject matter hereof were discussed, considered and
formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas

Government Code, as amended.

Item Summary:
Fellowship Church was developed outside of City Limits and applied for voluntary annexation and was
subsequently zoned Public Facilities - Low Intensity (PF-1) in 2005.The church is located at the southwest corner of
Gattis School Road and Westview Drive. All three Fellowship Church tracts are on the agenda are requesting to be
zoned Public Facilities- High Intensity Zoning District.The purpose for the zoning request is to ensure all three tracts
have the same development standards allowing for the church and accessory uses. The General Plan indicates
public facility use for the property. The proposed rezoning to PF-3 (Public Facilities - High Intensity) allows for a
religious campus without constraints on accessory building sizes which is in conformance with the General Plan.
Water and wastewater services exist within Gattis School Road; however, wastewater services will G
necessitate off-site improvements. The Church is in the process of extending a waterline across the frontage and
connecting to the line.

A Development Agreement was approved by City Council requiring the church to extend a waterline main
across their property, pay impact fees for a domestic meter, and annex and zone the two adjacent tracts of land.

The Planning and Zoning Commission unanimously recommended approval of the rezoning at their April 11,
2012 meeting.
ZONING FINDINGS
Pursuant to the Zoning Code Section 46-105, approval of a zoning map amendment requires the following
findings: 4
1. It is consistent with the general plan.
Staff Response:The proposed rezoning to PF-3 (Public Facilities- High Intensity) is consistent with the Public
Facilities Land Use Classification of the General Plan.

2. It is compatible with the present zoning and conforming uses of nearby property and to the character of
the neighborhood.
Staff Response: The expansion of a church campus with accessory uses is compatible with the adjacent
existing single-family residential. The church has frontage on Gattis School Road and is not located internal to the
adjacent neighborhood, thus lessening potential traffic impacts of the use. Any expansion of the site is required to
comply with the design requirements of the Ordinance including setbacks, landscaping and parking, thus further
ensuring compatibility with existing residential uses.

Staff Response: Fellowship Church exists on the property. The PF-3 zoning district allows for the continued
operation and future expansion of the use. s
