3 AN ORDINANCE AMENDING CHAPTER 44, SECTION 44-32, CODE OF
4 ORDINANCES (2012 EDITION), CITY OF ROUND ROCK, TEXAS, BY f
5 AMENDING THE WATER AND WASTEWATER IMPACT FEES, AND
6 ADOPTING NEW LAND USE ASSUMPTIONS AND CAPITAL
7 IMPROVEMENT PLAN; PROVIDING FOR A SAVINGS CLAUSE AND
8 REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS.

10 WHEREAS, Sec. 395.052, Tex. Local Gov't Code, requires a municipality
11 imposing impact fees to review and evaluate its current land use assumptions and
12 capital improvements plan at least every five (5) years (dating from the day the initial
13 capital improvements plan is adopted); and

14 WHEREAS, the last time such land use assumptions and capital improvements
15 plan were review, evaluated and updated was two (2) years ago; and it
16 WHEREAS, the City Council has reviewed, evaluated, and now wishes to adopt ;
17 updated land use assumptions and a capital improvements plan in order to comply with
18 said Texas Local Government Code requirements for same; Now Therefore
19 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,

28 April 2012, are hereby adopted and incorporated by reference and shall be kept of record
29 in the office of the city secretary.

21 reference and shall be kept on record in the office of the city secretary.

27 (f) Impact fees per service unit.
28 (2) Beginning on jaRuary 1, 2 August 1, 2012, the city shall assess and collect per
29 service unit to be served by the city's water system a water impact fee of '
30 $4,446003.889.00.

32 (3) Beginning on jaRuary 1, 20WAugust 1, 2012, the city shall assess and collect per
33 service unit to be served by the city's wastewater system a wastewater impact fee of
34 $2383-00 2 073.00.

Item Summary:
The City last updated the Water and Wastewater Impact Fees in January 2009. At that time, the City made a
commitment to review the existing impact fees that new customers are charged for tying into the water and
wastewater systems every three years. The current impact fees charged to new customers connecting to the City's
water and wastewater system are $4,446 and $2,383 per Living Unit Equivalent (LUE) respectively. To update these
impact fees, it requires the City to review and update the existing land use plan, annexation plan, and the water and
wastewater system capital improvement/master plans.
The City has recently completed the update to the Water and Wastewater System Master Plans which identifies the
projects that are anticipated over the next ten years that have a direct influence on the new impact fees. These
improvements have been included in the new impact fee calculation which actually represents a decrease in both
the water and wastewater fees from the current fees. The proposed impact fees for new customers connecting to
the City's water and wastewater system would be $3,889 and $2,073 per LUE respectively. If approved, these new
impact fees will be assessed to new customers with plats recorded after August 1, 2012.
A presentation of the final report of the proposed impact fees was made to the City's Capital Improvements
Advisory Committee on April 11, 2012. The committee's comments are provided in the final report.
