Z'D4 `2, ,'ft2_ AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 46-132(b)(1), CODE OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK, TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID OFFICIAL ZONING MAP, TO WIT: TO ORIGINALLY ZONE 9.82 ACRES OF LAND OUT OF THE WILLIS DONAHO SURVEY, ABSTRACT NO. 173, IN ROUND ROCK, WILLIAMSON COUNTY, TEXAS, AS DISTRICT LI (LIGHT INDUSTRIAL). WHEREAS, the City of Round Rock, Texas has annexed 9.82 acres of land out of the Willis Donaho Survey, Abstract No. 173 in Round Rock, Williamson County, I 4 Texas, being more fully described in Exhibit "A" (the "Property"), attached hereto and incorporated herein, and WHEREAS, the Planning and Zoning Commission held a public hearing concerning the original zoning of the Property on the 20th day of June, 2012, following lawful publication of the notice of said public hearing, and WHEREAS, after considering the public testimony received at such hearing, the : Planning and Zoning Commission has recommended that the Official Zoning Map be amended so that the Property in Exhibit "A" be originally zoned as District LI (Light Industrial), and F R Y WHEREAS, on the 26th day of July, 2012, after proper notification, the City Council held a public hearing on the proposed original zoning, and l: WHEREAS, the City Council determines that the zoning provided for herein promotes the health, safety, morals and protects and preserves the general welfare of the community, and WHEREAS, each and every requirement set forth in Chapter 211, Sub-Chapter E 4 A., Texas Local Government Code, and Section 46-92 and Section 46-132, Code of F 0.Awdox\SCCIn[s\0112V1204WUNICIPALV00254324.DOC `s Original Zoning Ordinance 6/06 i ei Ordinances (2010 Edition), City of Round Rock, Texas concerning public notices, hearings, and other procedural matters has been fully complied with, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That the City Council has considered and hereby makes the following findings regarding this amendment: 1. It is consistent with the general plan; 2. It is compatible with the present zoning and conforming uses of nearby property and with the character of the neighborhood; 3. The affected property is suitable for existing uses that are and would be permitted by District L-1 (Light Industrial); and F 4. Water, wastewater, and stormwater facilities are suitable and adequate and are available for the existing uses in District L-1 (Light Industrial). f 1 II. I That the Official Zoning Map adopted in Section 46-132(b)(1), Code of # Ordinances (2010 Edition), City of Round Rock, Texas, is hereby amended so that the zoning classification of the property described in Exhibit "A" is hereafter designated as i District LI (Light Industrial). The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider public testimony regarding and an ordinance zoning 9.82 acres of land, out of the Willis Donaho Survey,Abstract No. 173, and located on E. Old Settlers Boulevard, as LI Agenda Caption: (Light Industrial) zoning district. (First Reading) Meeting Date: July 26, 2012 Department: Planning and Development Services Staff Person making presentation: Peter Wysocki Planning and Development Services Director Item Summary: The property was annexed in 2006 and has remained unzoned since that time. Roadway improvements were since made to extend Old Settlers Boulevard to the east of A.W. Grimes, improving access to the properties. The tract to be zoned is developed with offices and a storage yard for a construction company. The General Plan Future Land Use Map designates this area for industrial uses. The LI (Light Industrial) zoning district allows for manufacturing and assembly, office, wholesale trade, research and development, outdoor storage of goods, auto and large vehicle and equipment repair and other related uses. Any new development will meet the standards of the LI district. Those standards are reviewed during site development and building permit reviews. Pursuant to Section 46-105 of the Zoning Code, zoning map amendments must meet the following findings: 1. It is consistent with the General Plan. As previously discussed,the proposed LI Zoning allows for industrial uses in conformance with the General Plan. 2. It is compatible with the present zoning, uses of nearby property and with the character of the neighborhood. The light industrial uses are compatible with the adjacent and existing uses on the site. 3. The affected property is suitable for existing uses that are and would be permitted by the new district. There have been no site constraints identified that would limit the existing or expanded operation of the construction company already located on the site. 4. Water, wastewater, and stormwater facilities are suitable and adequate and are available for the existing uses in the proposed district. Services are available for the allowable uses in the LI district. In tandem with the platting of the tract, wastewater capacity will be evaluated to ensure capacity in the existing lines. Off-site improvements to the existing wastewater lines may be required during the construction phase of development. Staff and the Planning and Zoning Commission believe that the proposed LI zoning meets the required findings.
