Whereas, THE CITY OF ROUND ROCK, TEXAS ("City") is the beneficiary of a Public Utility
Easement across the entirety of Lot One (1), Block "B", ASHTON OAKS SECTION ONE, a subdivision
in Williamson County, Texas, according to the map or plat of record in Cabinet Y, Slides 139-141, Plat
Records of Williamson County, Texas ("PUE"); and
Whereas, BRUCE K. BELTRAN is the owner of Lot One (1), Block "B", ASHTON OAKS
SECTION ONE, a subdivision in Williamson County, Texas, according to the map or plat of record in
Cabinet Y, Slides 139-141, Plat Records of Williamson County, Texas (`Beltran Property"); and
Whereas, the City desires to release only the portion of the PUE dedicated by plat and shown as
the hatched area labeled "0.127 Acres HOA Lot 1 & PUE" on the survey map attached hereto as Exhibit
"A"• and
Whereas, the City does not desire to release any other easement rights affecting the Beltran
Property, whether granted via plat dedication or separate instrument; and
Now therefore, in consideration of the stun of Ten and No/100 Dollars ($10.00) and other good
and valuable consideration paid by Bruce K. Beltran, the receipt and sufficiency of which is hereby
acknowledged, the CITY OF ROUND ROCK, TEXAS does hereby ABANDON, RELEASE and
DISCHARGE the portion of the PUE dedicated by plat and shown as the hatched area labeled "0.127 Acres
HOA Lot 1 & PUE" on the survey map attached hereto as Exhibit "A".
This instrument is given specifically to release only the described portion of said easement, which
portion of said easement is terminated by abandonment, termination, vacation, and cessation of purpose,
and which portion of said easement will be of no further effect, whether legal or equitable. All other
easements affecting the described property remain unchanged by this instrument, and all portions of the
PUE not bordering the Beltran Property remain unchanged by this instrument.
IN WITNESS WHEREOF, the City of Round Rock, Texas has caused this instrument entitled
"Partial Re ase of Public Utility Easement" to be executed on this the 4 '= day of the month of

Consider executing a partial Release of Public Utility Easement affecting two lots in
Ashton Oaks Section One subdivision
This is an application to permanently release a 0.13 -acre Public Utility Easement (PUE)
located between AW Grimes and the subject site. Section 36-46 of the Subdivision
Ordinance allows a landowner to request the vacation of an easement established by an
approved plat or by separate instrument. The purpose of the requested vacation is to
allow the homeowner additional space for a remodel and additional square footage to an
existing single-family residence.
The City of Round Rock Utilities and Environmental Services Department has consented
to the proposed easement release. The outside third party utility companies (AT&T,
Spectrum, ATMOS and ONCOR) have also consented to the proposed easement release.
Recommended Action
Staff recommends approval of the easement release
