G-12-10-11-H2 - 10/11/2012 ti e f F 4 ORDINANCE NO. 4 j G AN ORDINANCE AMENDING THE ROUND ROCK COMPREHENSIVE PLAN, CODIFIED UNDER SECTION 46-8, CODE OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK, TEXAS, BY AMENDING THE FUTURE LAND USE MAP OF THE GENERAL PLAN 2020; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. WHEREAS, a request has been made to the City Council of the City of Round Rock, Texas to amend the Future Land Use Map of the General Plan 2020, by changing 3 the designation of 24.8 acres of land, out of the George W. Glasscock Survey, Abstract 267, in Round Rock, Williamson County, Texas, being more fully described in Exhibit I "A" attached hereto, from the Residential Designation to Business Park Designation, and WHEREAS, the City Council has submitted the requested change in the Future Land Use Map to the Planning and Zoning Commission for its recommendation and k 2 report, and WHEREAS, the Planning and Zoning Commission held a public hearing concerning the requested change on the 5th day of September 2012, following lawful publication of the notice of said public hearing, and WHEREAS, after considering the public testimony received at such hearing, the Planning and Zoning Commission has recommended that the Future Land Use Map of the General Plan 2020 be amended so that the property described in Exhibit "A" be E designated as Business Park, and s WHEREAS, on the 11th day of October, 2012, after proper notification, the City Council held a public hearing on the requested amendment, and fi x O:\wdox\SCC1nts\0112\1204MUN1C1PAL\00259367.DOC "- i t i a a 5 G WHEREAS, the City Council determines that the amended land use designation i amendment provided for herein promotes the health, safety, morals and protects and r preserves the general welfare of the community, and WHEREAS, each and every requirement concerning public notices, hearings, ' i f and other procedural matters has been fully complied with, Now Therefore is I BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, k f TEXAS: i L t. That the Future Land Use Map which is contained in Chapter 6, designated as Map 6.2 of the General Plan 2020, adopted in Section 46-8, Code of Ordinances (2010 F Edition), City of Round Rock, Texas, is hereby amended so that the land use designation of the property described in Exhibit "A" is hereafter Business Park. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. F B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. (First Reading) 3 Meeting Date: October 11, 2012 ( Department: Planning and Development Services f: Staff Person making presentation: Peter Wysocki f I r Planning and Development Services Director ( G i E Item Summary: This item seeks to amend General Plan 2020 to revise the Future Land Use Map to change the land use designation of 24.8 acres of land from Residential to Business Park. Approving this item will facilitate the next item,which seeks to rezone the same tract of land from MF(Multifamily)to BP(Business Park). Surrounding land uses are as follows: ? x North-C-1(vacant and built)and Old Settlers Blvd. right-of-way East-MF zoning,but occupied by Williamson County offices South-Creek/open space with SF-2(Jester Farms neighborhood)across West-Sunrise Road right-of-way,with MF and C-1 across. Business Park is intended to accommodate a limited group of light industrial, research and development, and administrative facilities in a campus setting. Other supporting uses such as retail sales and service, day care, and small restaurants are permitted as well to serve those who work in the business park as well as those who live nearby. All activities must be carried out in a fully enclosed building. There is a single family neighborhood to the south of this tract, across a creek and some open space, but the General Plan states that Business Park uses are permitted near single family uses. In this case, it will make for a good transitional use between the neighborhood and the Old Settlers Blvd.corridor. I The site is served by two arterials roadways, Sunrise Road on the west and Old Settlers Blvd. on the north. Water and wastewater utilities are available to serve it, but any off-site improvements are the responsibility of the developer and will be discussed during the site plan review process once uses are identified. Staff considered many factors while evaluating the proposal, including changing market conditions, changing demographics, availability of utilities, and surrounding land use changes. Replacing land designated as Residential with land designated as Business Park would maintain consistency with existing development along Old Settler's Blvd. Additionally,there is a significant amount of entitled multifamily land already in the immediate area (over 1,100 units)to mitigate the loss of this land as entitled multifamily residential. The tract has been designated Residential for almost twenty years, yet remains vacant. A change to Business Park will facilitate development and provide for potential economic development and employment opportunities. i The Planning and Zoning Commission unanimously recommended approval of this General Plan Amendment at its September 5, 2012 meeting.
