GLASSCOCK SURVEY, ABSTRACT NO. 267, IN ROUND ROCK, WILLIAMSON COUNTY, TEXAS, FROM DISTRICT MF (MULTIFAMILY) TO DISTRICT BP (BUSINESS PARK). WHEREAS, an application has been made to the City Council of the City of s Round Rock, Texas to amend the Official Zoning Map to rezone 24.8 acres of land, out 1 of the George W. Glasscock Survey, Abstract No. 267, in Round Rock, Williamson County, Texas, being more fully described in Exhibit "A" attached hereto, from District { MF (Multifamily) to District BP (Business Park), and WHEREAS, the City Council has submitted the requested change in the Official Zoning Map to the Planning and Zoning Commission for its recommendation and report, and WHEREAS, the Planning and Zoning Commission held a public hearing concerning the requested change on the 5th day of September 2012, following lawful publication of the notice of said public hearing, and WHEREAS, after considering the public testimony received at such hearing, the Planning and Zoning Commission has recommended that the Official Zoning Map be amended so that the property described in Exhibit "A" be zoned District BP (Business Park), and WHEREAS, on the 11th day of October, 2012, after proper notification, the City Council held a public hearing on the requested amendment, and 0:Awdox\SCC1nts\0112\1204\MUNICEPALV00259368 DOC/rmc Rev.12/11 WHEREAS, the City Council determines that the zoning provided for herein promotes the health, safety, morals and protects and preserves the general welfare of the community, and WHEREAS, each and every requirement set forth in Chapter 211, Sub-Chapter A., Texas Local Government Code, and Section 46-92 and Section 46-105, Code of Ordinances (2010 Edition), City of Round Rock, Texas concerning public notices, hearings, consideration, findings, and other procedural matters has been fully complied with, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: That the City Council has considered and hereby makes the following findings regarding this amendment: 1. It is consistent with the general plan; 2. It is compatible with the present zoning and conforming uses of nearby { property and with the character of the neighborhood; 3. The affected property is suitable for uses that are and would be permitted by District BP (Business Park); and 4. Water, wastewater, and stormwater facilities are suitable and adequate and are available for the permitted uses in District BP (Business Park). II. That the Official Zoning Map adopted in Section 46-132(b)(1), Code of Ordinances (2010 Edition), City of Round Rock, Texas, is hereby amended so that the zoning classification of the property described in Exhibit "A" is hereafter designated as District BP (Business Park). 2 t S III. Old Settlers Blvd. and Sunrise Road), from MF (Multifamily) district to BP (Business Park) Agenda Caption: district. (First Reading) t Meeting Date: October 11, 2012 Department: Planning and Development Services Staff Person making presentation: Peter Wysocki Planning and Development Services Director Item Summary: This item seeks to rezone 24.8 acres of land from MF (Multifamily) to BP (Business Park). Rezoning the site to BP would allow a similar land use intensity while maintaining consistency with existing uses along Old Settlers Blvd. If approved,this rezoning will eliminate 496 potential apartment units. Surrounding land uses are as follows: North -C-1 (vacant and built) and Old Settlers Blvd. right-of-way East- MF zoning, but occupied by Williamson County offices(which are developed in a Business Park style) k South -Creek/open space with SF-2 (Jester Farms neighborhood)across West-Sunrise Road right-of-way,with MF and C-1 across. F Water and wastewater are available to serve the site. Any off-site water and wastewater improvements are the responsibility of the developer, and will be discussed during the platting or site plan review process. The site has frontage along two arterial roadways:Sunrise Road on the west and Old Settler's Blvd. on the north. The BP (Business Park) zoning district allows manufacturing and assembly, office, day care, and wholesale trade uses by right, and restaurants, retail sales and service, and research and development with conditions. All activities, including manufacturing and assembly, shall be carried out within a fully enclosed building. All development must meet the building standards outlined in the Code, including building articulation, wall materials of brick, stone, simulated stone, stucco, and other approved masonry materials, exterior color compatibility, screening of equipment, and prohibited outdoor storage and display. The site abuts single family development to the south, creating more restrictive height standards along this property line. For every foot over twenty feet in height, the buildings must be set back an extra foot in addition to the standard requirement. Pursuant to Section 46-105, zoning map amendments must meet the following findings: 1. Consistency (or lack thereof) with the General Plan: The proposed land use is not currently consistent with the General Plan, but will be upon adoption of the related amendment to the Future Land Use Map. 2. Suitability of the property affected by the amendment for uses permitted by the district that would be made applicable by the proposed amendment: The property is suitable for uses permitted by the Business Park zoning district. The BP district enables a greater range of use than the MF district, all of which are suitable for this location. ' It is well served by the existing infrastructure and maintains land use intensity very similar to the present MF zoning. 4.Suitability of the property affected by the amendment for uses permitted by the district applicable to the property at the time of the proposed amendment: The property is suitable for Multifamily uses in its current state, however the MF zoning district permits a smaller range of uses than the BP district. Additionally there is already a significant amount of entitled Multifamily property in the area,which will mitigate the impact of the proposed rezoning. E 5. Availability of water, wastewater and stormwater facilities suitable and adequate for the proposed use: Water Y and wastewater facilities are present and adequate for the proposed Business Park uses. Any off-site improvements to the water or wastewater system will be the responsibility of the developer and will be addressed once specific uses are identified. The Planning and Zoning Commission unanimously recommended approval of this zone change at its September 5, 2012 meeting. One resident from an adjoining neighborhood spoke during the public hearing. The residents' comments revolved around drainage at the neighborhood's amenity park (not on the subject site) and questions regarding the development standards that would apply to the site.
