WHEREAS, Section 43.065(a) of the Texas Local Government Code requires that, within `

certain specified statutory timeframes, the City Council of the City of Round Rock must direct the

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the City Council hereby directs the City's Planning Director to prepare a service plan that
provides for the extension of full municipal services to the following area proposed for annexation,
said property being further described in Exhibit "A" attached hereto and incorporated herein for all

The City Council hereby finds and declares that written notice of the date, hour, place and

subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended. r

Item Summary:
This annexation is being proposed by staff based on the Management Agenda adopted by the Council as part of the
Strategic Plan, which gives staff the direction to identify feasible and logical lands to be annexed. The subject area is
located on the east side if IH35-N frontage road, just north of Greenlawn Boulevard. The area currently contains a r
landscaping nursery and recently opened Planet K store. The area is approximately 14.8 acres and consists of 6
separate lots. The surrounding areas have been annexed a number of years ago, but this "triangle" remained
unincorporated. Given the area's high visibility from I1-135, direct access from the frontage road and availability of
nearby city utilities, staff believes that this area is ripe for annexation. Furthermore, this area is the southern
gateway to the City of Round Rock and warrants future redevelopment.
Pursuant to State Law, the City Council is required to officially direct staff to prepare a service plan for land to be
annexed unilaterally. Once directed, staff will prepare and present a service plan to the Council identifying the
needed infrastructure and costs to extend city water and sewer to the parcels (by State Law, city water and sewer
must be extended to an area unilaterally annexed within 2 1/2 years). Upon the Council acceptance of the service
plan, a series of notices and public hearings will be held.
Two public hearings are scheduled for December 6, 2012, and December 20, 2012. On October 29, 2012, written
notices will be sent by certified mail to the property owners of the land proposed to be annexed, and to all public
and private utility providers that could be affected. Published notice of December 6, 2012, and December 20, 2012,
hearings will appear in the Round Rock Leader on Saturday, November 17, 2012, and Saturday, December 8, 2012,
and will be posted on the City's website on November 14, 2012 and December 5, 2012, respectively.

If ultimately annexed, the properties will be zoned. Existing uses will be allowed to operate, but any change in use,
new development or expansion will need to comply with zoning and development standards.
