RESOLUTION NO. R-12-10-25-1111
WHEREAS, South and North Mays Street, from Hesters Crossing Boulevard to U.S. 79, also
known as U.S. Highway 81, is a primary thoroughfare through the City of Round Rock (the "City");
and

WHEREAS, Round Rock Avenue, from IH-35 to U.S. Highway 81 (North Mays Street), also {
known as RM 620, is a primary thoroughfare through the City; and

WHEREAS, the City has been in discussions with the Texas Department of Transportation
(TxDOT) regarding the transfer of jurisdiction and conveyance of the rights-of-way for portions of

South and North Mays Street, and Round Rock Avenue (the "Right-of-Way"), as described in Exhibits
e
A-G, attached hereto and incorporated herein,Now Therefore

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,

THAT:

1. The facts and recitations in the preamble of this Resolution are hereby found and
declared to be true and correct, and are incorporated herein and expressly made a part

hereof.

2. The City finds that it is in the best interest of the citizens of Round Rock to request
TxDOT to transfer the jurisdiction and convey the Right-of-Way to the City.
3. The City acknowledges that TxDOT will convey the right-of-way pursuant to Section
202.021 of the Texas Transportation Code. The State will convey the tracts described in
Exhibits A, B, D, E and F by Deed without Warranty. The State will provide the City
with a Quitclaim Deed for the tracts described in Exhibits C and G.
4. Maintenance of Right-of-Way shall commence after said transfer.

The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was

Item Summary:
On September 8, 2011, the City Council passed a resolution (R-11-09-08-10E1) requesting that the Texas f
Department of Transportation (TxDOT) consider allowing the City of Round Rock to assume maintenance and
operation responsibilities for Mays Street (131-35) between US 79 and Hester's Crossing and Round Rock Avenue (RM ;
620) between IH-35 and Mays Street.

Since that time, surveys and appraisals of the subject rights-of-way have been completed, and TxDOT has now asked '
for a formal resolution requesting that the rights-of-way for Mays Street and Round Rock Avenue be conveyed to
the City of Round Rock. Execution of this resolution will initiate the formal review of the survey and appraisal
documents,with the final step in the conveyance being consideration by the Texas Transportation Commission.
