G-13-08-08-E2 - 8/8/2013ORDINANCE NO. �� 13'00-0842 • AN ORDINANCE AMENDING CHAPTER 22, CODE OF ORDINANCES (2010 EDITION), CITY OF ROUND ROCK, TEXAS, BY ADDING SECTION 22-9 REGARDING JUVENILE CASE MANAGER POSITION, JUVENILE CASE MANAGER FEE AND JUVENILE CASE MANAGER FUND; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: That Chapter 2, Code of Ordinances (2010 Edition), City of Round Rock, Texas, is hereby amended by adding Section 22-9 to read as follows: Sec. 22-9. — Juvenile Case Manager, Fee and Fund. (a) Juvenile Case Manager. Pursuant to Article 45.056 of the Texas Code of Criminal Procedure, the City Council hereby authorizes the employment of one or more full-time or part-time juvenile case managers to provide services in cases involving juvenile offenders before the Municipal Court consistent with the Court's statutory powers and to assist the Court in administering the Court's juvenile docket and in supervising its court orders in juvenile cases. As required by Article 45.056 of the Texas Code of Criminal Procedure, the City Council has adopted by Resolution the Juvenile Case Manager Code of Ethics, the Educational Pre -service and In-service Training Standards and has required the juvenile case managers to receive training in the role of the juvenile case manager, case planning and management, applicable procedural and substantive law, courtroom proceedings and presentation, services to at -risk youth, local programs and services for juveniles and the detection and prevention of abuse, exploitations, and neglect of juveniles. (b) Juvenile Case Manager Fee. There is hereby created a Juvenile Case Manager Fee (the "Fee") as authorized by Article 102.0174 of the Texas Code of Criminal Procedure. The Fee shall be in the amount of $5.00. A defendant who is convicted of a fine -only misdemeanor offense in Municipal Court shall pay the Fee as a cost of court. A person is considered convicted of an offense if: (1) a sentence is imposed on the defendant; or (2) the person receives deferred disposition, including deferred proceedings under Article 45.052 or 45.053 of the Texas Code of Criminal Procedure. The Municipal Court Judge may waive the Fee in cases of demonstrated financial hardship on the part of a convicted defendant if the defendant is indigent. There is hereby created a Juvenile Case Manager Fund (the "Fund") as authorized by Article 102.0174 of the Texas Code of Criminal Procedure. All Juvenile Case Manager Fees collected by the Municipal Court shall be deposited into the Fund. The Fund may be used only to finance the salary, benefits, training, travel expenses, office supplies, and other necessary expenses relating to the position of a juvenile case manager. 11. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. In order to establish the fee and fund, the State requires adoption of an ordinance. A Juvenile Case Manager provides services in cases involving juvenile offenders before a court consistent with the court's statutory powers. Juvenile Case Managers assist the court in administering the court's juvenile docket and in supervising its orders in juvenile cases. This ordinance will enhance the duties of an existing FTE, retitle the position to Juvenile Case Manager, and allow the collection of a fee to supplement the salary of the existing position. A resolution will be presented that will adopt a code of ethics created by the Juvenile Case Managers Association of Texas, along with pre -service and in-service training requirements.
