A RESOLUTION OF THE CITY OF ROUND ROCK, TEXAS,
CALLING A BOND ELECTION FOR NOVEMBER 5, 2013;
DESIGNATING ELECTION PRECINCTS AND POLLING PLACES;
PROVIDING FOR EARLY VOTING AND ELECTION DAY VOTING;
PROVIDING FOR PERFORMANCE OF REQUIRED ADMINISTRATIVE
DUTIES; PROVIDING FOR CONDUCT OF THE ELECTION;
CERTIFYING PROVISION OF REQUIRED ACCESSIBLE VOTING
SYSTEMS AT EACH POLLING PLACE; AND PROVIDING FOR OTHER
MATTERS RELATED TO SUCH ELECTION.

CITY OF ROUND ROCK
WHEREAS, pursuant to the provisions of Chapters 1251 and 1331, Texas Government
Code, as amended, the Texas Election Code, as amended, and other related statutes the City
Council of the City of Round Rock, Texas (the "City") is authorized to call an election in order to
submit to the voters of the City various propositions regarding the issuance of general obligation
bonds; and
WHEREAS, the City Council deems it advisable to call a bond election for the
propositions hereinafter stated.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ROUND ROCK, TEXAS THAT:
Section 1. ELECTION DATE, POLLING PLACES AND ELECTION JUDGES.
Joint Election. The City is located in more than one County and therefore the
Williamson County Elections Administrator and Travis County Clerk are conducting the election
pursuant to election agreements (the "Election Agreements") between the City and Williamson
County and Travis County, respectively, as authorized under Section 31.092 of the Texas
Election Code. The election shall be held as a joint election pursuant to Chapter 271 of the
Texas Election Code and a joint election agreement to be entered into between the City and the
other participating entities located in Williamson County and Travis County, respectively, which
are holding an election on November 5, 2013.
Election Date. An election shall be held in the City as prescribed by applicable law
between the hours of 7:00 A.M. and 7:00 P.M. on November 5, 2013.

Precincts and Polling Places. The City election precincts and polling places within the
City designated for holding the election shall be determined by Williamson County and Travis
County, respectively, and conducted at the polling places used for the Williamson County
General Election and Travis County General Election, respectively, which will be attached hereto
as Exhibit "A" to this Resolution, and said exhibit is incorporated herein by reference for all
purposes. Williamson County's and Travis County's election equipment, respectively, shall be
used to conduct the election.
Election Judges. The election judges shall be appointed in accordance with the Election
Agreements and the Texas Election Code, as amended.
For voters in Williamson County, the Williamson County Elections Administrator is
conducting such election for the City pursuant to the terms of the Election Agreement. The City
Council hereby appoints, for the term of such election, the presiding election judge(s) and
alternate election judge(s) as being those designated by the Williamson County Elections
Administrator.
For voters in Travis County, the Travis County Clerk is conducting such election for the
City pursuant to the terms of the Election Agreement. The City Council hereby appoints, for the
term of such election, the presiding election judge(s) and alternate election judge(s) as being
those designated by the Travis County Clerk.
Section 2. ELECTION CLERKS.
Unless otherwise directed by the respective County, the Presiding Judge shall appoint not
less than two nor more than five resident qualified electors of the City to act as clerks to properly
conduct the election. However, if the Presiding Judge appointed actually serves, the Alternate
Presiding Judge shall serve as one of the clerks. The appointment of such clerks must include a
person fluent in the Spanish language to serve as a clerk to render oral aid in the Spanish
language to any voter desiring such aid at the polls on the Election Day. In the absence of the
Presiding Judge, the Alternate Presiding Judge shall perform the duties of the Presiding Judge.
Section 3. EARLY VOTING.
Dates, Times, and Places for Early Voting. Early voting in the election by personal
appearance shall be conducted at the dates, times, and polling places as provided for in the
Williamson County General Election and the Travis County General Election, respectively,
which will be attached hereto as Exhibit "B" to this Resolution, and said exhibit is incorporated
herein by reference for all purposes.
Early Voting Clerk. For voters in Williamson County, the City Council hereby
appoints the Williamson County Elections Administrator as the City of Round Rock Election
Officer and Early Voting Clerk. The Early Voting Clerk's mailing address to which applications
for ballots by mail may be sent, for voters residing in Williamson County, is as follows:

For voters in Travis County, the City Council hereby appoints the Travis County Clerk as
the City of Round Rock Election Officer and Early Voting Clerk. The Early Voting Clerk's

Section 4. EARLY VOTING BALLOT BOARDS.
Early voting ballot boards are hereby created to process early voting results, and the
Presiding Judge of the boards will be appointed by the Williamson County Elections
Administrator and Travis County Clerk, respectively. The Presiding Judge shall appoint not less
than two nor more than eighteen resident qualified electors to serve as members of the Early
Voting Ballot Boards.
Section 5. VOTERS.
All resident, qualified electors of the City of Round Rock, Texas shall be entitled to vote
at the election.
Section 6. CUSTODIAN OF ELECTION RECORDS.
The Williamson County Elections Administrator and Travis County Clerk, respectively,
shall serve as the custodian of voted ballots, and the City Clerk of Round Rock, Texas shall be
appointed as custodian of all other election records.
Section 7. NOTICE.
Posting. A substantial copy of this Resolution, with such omissions authorized by law,
shall serve as a proper notice of the election. This Resolution, including a Spanish translation
thereof, shall be posted on the bulletin board used by the City to post notices of meetings, City
Hall and three (3) public places within the City not less than twenty-one (21) days prior to the

date the election is to be held, and shall remain posted through election day in accordance with
Section 1251.008, Texas Government Code, as amended.
Publication. A substantial copy of this Resolution, with such omissions allowed by law,
shall serve as a proper notice of the election. This Resolution, including a Spanish translation
thereof, shall be published in a newspaper of general circulation in the City, on the same day in
each of two successive weeks not earlier than the thirtieth (30th) day or later than the fourteenth
(14th) day before election day.
Authorization to City Clerk. The City Clerk is hereby authorized and directed to
publish and post the required notices in the manner and for the time periods required by law.
Section 8. VOTING DEVICES.
Electronic optical scan voting devices may be used in conducting the election. The
Williamson County Elections Administrator and the Travis County Clerk, respectively, may also
utilize a central counting station as provided by Section 127.000 et seq., as amended, Texas
Election Code. Any central counting station presiding judge and the alternate presiding judge
shall be appointed in accordance with the Election Agreement and the Texas Election Code. The
Williamson County Elections Administrator and Travis County Clerk are currently using election
systems and software certified by the Texas Secretary of State.
The City Council of the City of Round Rock, Texas, finds as follows:
Section 61.012, Texas Election Code, requires that at least one accessible voting station
must be provided in each polling place used in a Texas election. Such system must comply with
state and federal laws setting the requirements for voting systems that (i) fully comply with
applicable laws relating to accessible voting systems which make voting accessible for disabled
voters; and (ii) provide a practical and effective means for voters with physical disabilities to cast
a secret ballot. The Office of the Texas Secretary of State has certified that the DRE - Election
Systems and Software iVotronic is an accessible voting system that may legally be used in Texas
elections.
Sections 123.032 and 123.035, Texas Election Code, authorize the acquisition of voting
systems by local political subdivisions and further mandate certain minimum requirements for
contracts relating to the acquisition of such voting systems. For voters in Williamson County and
for voters in Travis County, as chief elections officer for the City of Round Rock, the Williamson
County Elections Administrator and Travis County Clerk shall provide at least one DRE -
Election Systems and Software iVotronic in each polling place at every polling location used to
conduct any election. The DRE - Election Systems and Software iVotronic may be acquired by
any legal means available to the City of Round Rock, including but not limited to lease or rental
from Williamson County or Travis County or from any other legal source, as authorized or
required by Sections 123.032 and 123.035 of the Texas Election Code.

Section 9. PROPOSITIONS.
At the election, the following PROPOSITIONS shall be submitted in accordance with
PROPOSITION I
Shall the City Council of the City of Round Rock, Texas, be authorized to issue
the bonds of the City, in one or more series, in the aggregate principal amount of
$16,500,000 with the bonds of each such series, respectively, to mature serially
within not to exceed thirty years from their date, and to be sold at such prices and
bear interest at such rates, as shall be determined within the discretion of the City
Council, in accordance with law at the time of issuance, for the purpose of
constructing, improving, renovating and equipping City fire department facilities
including the acquisition of any necessary sites and fire apparatus and related
water, wastewater, drainage, streets, sidewalks, parking infrastructure and other
related costs; and shall said City Council be authorized to levy and cause to be
assessed and collected annual ad valorem taxes on all taxable property in the City
in an amount sufficient to pay the annual interest on said bonds and provide a
sinking fund to pay the bonds at maturity?
PROPOSITION II
Shall the City Council of the City of Round Rock, Texas, be authorized to issue
the bonds of the City, in one or more series, in the aggregate principal amount of
$56,500,000 with the bonds of each such series, respectively, to mature serially
within not to exceed thirty years from their date, and to be sold at such prices and
bear interest at such rates, as shall be determined within the discretion of the City
Council, in accordance with law at the time of issuance, for the purpose of
constructing, acquiring, improving, renovating, equipping, and/or developing
land, buildings and facilities for City park and recreational purposes; and shall
said City Council be authorized to levy and cause to be assessed and collected
annual ad valorem taxes on all taxable property in the City in an amount sufficient
to pay the annual interest on said bonds and provide a sinking fund to pay the
bonds at maturity?
PROPOSITION III
Shall the City Council of the City of Round Rock, Texas, be authorized to issue
the bonds of the City, in one or more series, in the aggregate principal amount of
$23,200,000 with the bonds of each such series, respectively, to mature serially
within not to exceed thirty years from their date, and to be sold at such prices and
bear interest at such rates, as shall be determined within the discretion of the City
Council, in accordance with law at the time of issuance, for the purpose of
constructing, renovating, improving, and equipping existing and/or additional City

library facilities including acquisition of any necessary sites and related water,
wastewater, drainage, streets, sidewalks, parking infrastructure and other related
costs; and shall said City Council be authorized to levy and cause to be assessed
and collected annual ad valorem taxes on all taxable property in the City in an
amount sufficient to pay the annual interest on said bonds and provide a sinking
fund to pay the bonds at maturity?
PROPOSITION IV
Shall the City Council of the City of Round Rock, Texas, be authorized to issue
the bonds of the City, in one or more series, in the aggregate principal amount of
$27,400,000 with the bonds of each such series, respectively, to mature serially
within not to exceed thirty years from their date, and to be sold at such prices and
bear interest at such rates, as shall be determined within the discretion of the City
Council, in accordance with law at the time of issuance, for the purpose of
constructing, improving, renovating and equipping joint City police and fire
department training facilities including the acquisition of any necessary sites and
related water, wastewater, drainage, streets, sidewalks, parking infrastructure and
other related costs; and shall said City Council be authorized to levy and cause to
be assessed and collected annual ad valorem taxes on all taxable property in the
City in an amount sufficient to pay the annual interest on said bonds and provide a
sinking fund to pay the bonds at maturity?
Section 10. OFFICIAL BALLOT.
The official ballot for the election shall be prepared in accordance with the Texas
Election Code so as to permit the electors to vote "FOR" or "AGAINST" on the
PROPOSITIONS, with the ballots to contain such provisions, markings and language as required
by law, and with such PROPOSITIONS to be expressed substantially as follows:
PROPOSITION I

PROPOSITION II

Section 11. CONDUCT ACCORDING TO TEXAS ELECTION CODE.
In all substantive respects, the election shall be conducted in accordance with the Texas
Election Code and any other applicable statutes.
Section 12. ELECTION RESULTS.
The Williamson County Elections Administrator and Travis County Clerk, respectively,
shall conduct an unofficial tabulation of results after the closing of the polls on November 5,
2013. The official canvass and tabulation of the results of the Bond Election shall be conducted
in accordance with the Election Code.
Section 13. MISCELLANEOUS PROVISIONS.
The provisions of this Resolution are severable; and in case any one or more of the
provisions of this Resolution or the application thereof to any person or circumstance should be
held to be invalid, unconstitutional, or ineffective as to any person or circumstance, the
remainder of this Resolution nevertheless shall be valid, and the application of any such invalid
provision to persons or circumstances other than those as to which it is held invalid shall not be
affected thereby.
The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting
was open to the public as required by law at all times during which this Resolution and the
subject matter hereof were discussed, considered and formally acted upon, all as required by the
Open Meetings Act, Chapter 551, Texas Government Code, as amended.

CERTIFICATE FOR RESOLUTION
The undersigned City Clerk of the City of Round Rock, Texas (the "City"), hereby certify
as follows:
1. The City Council of the City convened in a REGULARLY SCHEDULED
MEETING ON THE 22ND DAY OF AUGUST, 2013, at the designated meeting place (the
"Meeting"), and the roll was called of the duly constituted officers and members of the Council,
to -wit:

CALLING A BOND ELECTION FOR NOVEMBER 5, 2013;
DESIGNATING ELECTION PRECINCTS AND POLLING PLACES;
PROVIDING FOR EARLY VOTING AND ELECTION DAY VOTING;
PROVIDING FOR PERFORMANCE OF REQUIRED ADMINISTRATIVE
DUTIES; PROVIDING FOR CONDUCT OF THE ELECTION;
CERTIFYING PROVISION OF REQUIRED ACCESSIBLE VOTING
SYSTEMS AT EACH POLLING PLACE; AND PROVIDING FOR
OTHER MATTERS RELATED TO SUCH ELECTION
was duly introduced for the consideration of the City Council. It was then duly moved and
seconded that the Resolution be passed; and, after due discussion, said motion carrying with it
the passage of the Resolution, prevailed and carried by the following vote:

2. A true, full and correct copy of the Resolution passed at the Meeting described in
the above and foregoing paragraph is attached to and follows this Certificate; that the Resolution
has been duly recorded in the City Council's minutes of the Meeting; that the above and
foregoing paragraph is a true, full and correct excerpt from the City Council's minutes of the
Meeting pertaining to the passage of the Resolution; that the persons named in the above and
foregoing paragraph are the duly chosen, qualified and acting city officials as indicated therein;
that each of the elected officials and members of the City Council was duly and sufficiently
notified officially and personally, in advance, of the time, place and purpose of the Meeting, and
that the Resolution would be introduced and considered for passage at the Meeting, and each of
the elected officials and members consented, in advance, to the holding of the Meeting for such
purpose, and that the Meeting was open to the public and public notice of the time, place and
purpose of the meeting was given, all as required by Chapter 551, Government Code, as
amended.
3. The Mayor of the City has approved and hereby approves the Resolution and the
Mayor and the City Clerk of the City have duly signed the Resolution.
