R -13-12-19-E3 WHEREAS, the City of Round Rock ("City") approved an Interlocal Agreement regarding a request to disannex certain property from Georgetown's city limits and to release certain real property from Georgetown's extra -territorial jurisdiction ("ETJ") on December 5, 2013; and WHEREAS, the City of Georgetown approved said Interlocal Agreement and disannexed and released said real properties from its extraterritorial jurisdiction ("ETJ"), relinquishing all ETJ rights in said property to the City of Round Rock on December 10, 2013; and WHEREAS, the City wishes to accept that certain real property into its ETJ, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the City Council agrees to accept that certain real property into its ETJ, effective January 2014, a copy of said property description being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. The property is located on the south side of Westinghouse Road and to the east of A.W. Grimes Boulevard (FM 1460). An inter -local agreement, which was approved by both cities, provided for this acceptance of ETJ territory. The property owners of the 94 acres may now petition the City of Round Rock for annexation and zoning. An applicant -initiated petition will likely be filed in early 2014 to incorporate this land into the Avery North PUD.
