O-2014-1309 - 4/10/20141 ORDINANCE NO. 0-2014-1309 2 3 4 AN ORDINANCE AMENDING CHAPTER 42, SECTIONS 42-42, 42-44, 5 42-45, 42-46, 42-101, 42-102, 42-157, 42-158, 42-191, 42-223, 42-224, 6 42-225, AND 42-315, CODE OF ORDINANCES (2010 EDITION), CITY 7 OF ROUND ROCK, TEXAS, REGARDING TRAFFIC AND VEHICLES; 8 AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING 9 CONFLICTING ORDINANCES AND RESOLUTIONS. 10 11 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, 12 TEXAS: 13 I. 14 That Chapter 42, Section 42-42, Code of Ordinances (2010 Edition), City of 15 Round Rock, Texas, is hereby amended to read as follows: 16 17 18 19 20 21 22 23 24 Sec. 42-42. Duty of traffic division. It shall be the duty of the traffic division, with such aid as may be rendered by other members of the police department, to enforce the street traffic regulations of this city and all of the state vehicle laws; to make arrests for traffic violations; to investigate accidents and to cooperate with the director of planningTransportation Director and other officers of the city in the administration of the traffic laws and in developing ways and means to improve traffic conditions; and to carry out those duties specially imposed upon said division by this chapter and the traffic ordinances of this city. 25 11. 26 That Chapter 42, Section 42-44, Code of Ordinances (2010 Edition), City of 27 Round Rock, Texas, is hereby amended to read as follows: 28 Sec. 42-44. Traffic accident studies. 29 30 Whenever the accidents at any particular location become numerous, the traffic division shall 31 I cooperate with the director of planningTransportation Director in conducting studies of such accidents and 32 determining remedial measures. 33 34 111. 35 That Chapter 42, Section 42-45, Code of Ordinances (2010 Edition), City of 36 Round Rock, Texas, is hereby amended to read as follows: 0112.1404; 00295709 1 Sec. 42-45. Traffic accident reports. 2 3 The traffic division shall maintain a suitable system of filing traffic accident reports. Accident reports 4 or cards referring to them shall be filed alphabetically by location. Such reports shall be available for the 5 use and information of the director of planningTransportation Director. 6 7 IV. 8 That Chapter 42, Section 42-46, Code of Ordinances (2010 Edition), City of 9 Round Rock, Texas, is hereby amended to read as follows: 10 Sec. 42-46. Emergency and experimental regulations. 11 12 1 (a) The chief of police, by and with the approval of the Transportation Director, is 13 hereby empowered to make regulations necessary to make effective the provisions of the traffic 14 ordinances of this city and to make and enforce temporary or experimental regulations to cover 15 emergencies or special conditions. No such temporary or experimental regulation shall remain in 16 effect for more than 90 days. 17 1 (b) The Transportation Director may test traffic control devices under actual 18 conditions of traffic. 19 20 V. 21 That Chapter 42, Section 42-101, Code of Ordinances (2010 Edition), City of 22 Round Rock, Texas, is hereby amended to read as follows: 23 Sec. 42-101. Authority to install traffic control devices. 24 25 1 The Transportation Director shall place and maintain official pavement markings, 26 traffic control signs, signals, and devices when and as required under the traffic ordinances of this city to 27 make effective the provisions of said ordinances, and may place and maintain such additional official 28 traffic control devices as he may deem necessary to regulate, warn, or guide traffic under the traffic 29 ordinances of this city or the state traffic laws. 30 31 VI. 32 That Chapter 42, Section 42-102, Code of Ordinances (2010 Edition), City of 33 Round Rock, Texas, is hereby amended to read as follows: 34 35 36 37 38 39 40 Sec. 42-102. Manual and specifications for traffic control devices. All pavement markings, traffic control signs, signals, and devices shall conform to most recent version and revision of the Texas Manual on Uniform Traffic Control Devices for Streets and Highways,approved by the Texas Transportation Commission, and the ordinances and specifications approved by the city council. All signs and signals required hereunder for a particular purpose shall, so far as practical, be uniform as to type and location throughout the city. All traffic control devices heretofore 2 1 erected and not inconsistent with the provisions of state law or this chapter shall be official traffic control 2 devices. 3 4 VII. 5 That Chapter 42, Section 42-157, Code of Ordinances (2010 Edition), City of 6 Round Rock, Texas, is hereby amended to read as follows: 7 Sec. 42-157. Authority to place devices altering normal course of turns. 8 9 The Transportation Director is authorized to place official traffic control devices 10 within or adjacent to intersections indicating the course to be traveled by vehicles turning at such 11 intersections, and such course to be traveled as so indicated may conform to or be other than as 12 prescribed by law. 13 14 VIII. 15 That Chapter 42, Section 42-158, Code of Ordinances (2010 Edition), City of 16 Round Rock, Texas, is hereby amended to read as follows: 17 Sec. 42-158. Authority to place restricted turn signs. 18 19 1 The Transportation Director is hereby authorized to determine those intersections 20 at which drivers of vehicles shall not make a right, left, or U-turn, and shall place proper signs at such 21 intersections. The making of such turns may be prohibited between certain hours of any day and 22 permitted at other hours, in which event the same shall be plainly indicated on the signs. 23 24 IX. 25 That Chapter 42, Section 42-191, Code of Ordinances (2010 Edition), City of 26 Round Rock, Texas, is hereby amended to read as follows: 27 28 29 30 31 32 33 34 Sec. 42-191. Authority to sign one-way streets and alleys. Whenever any ordinance of this city designates any one-way street or alley, the director of fflanaiagTransportation Director shall place and maintain signs giving notice thereof, and no such regulation shall be effective unless such signs are in place. Signs indicating the direction of lawful traffic movement shall be placed at every intersection where movement of traffic in the opposite direction is prohibited. 3 1 X. 2 That Chapter 42, Section 42-223, Code of Ordinances (2010 Edition), City of 3 Round Rock, Texas, is hereby amended to read as follows: 4 Sec. 42-223. Stop and yield intersections. 5 6 The city council may by ordinance designate any street intersection as a stop intersection and 7 designate the streets upon which vehicles shall stop before entering such intersections. In addition, the 8 city council may designate that traffic on any street shall yield to traffic on an intersecting street. 9 I Whenever any intersection has been so designated, the director—of-planning.Transportation Director shall 10 supervise the erection and maintenance of stop signs or yield signs as specified by the city council and 11 maintain an inventory of such signs. Ordinances designating stop and yield intersections have not been 12 included in this Code and are on file in the office of the city secretaryclerk. 13 14 XI. 15 That Chapter 42, Section 42-224, Code of Ordinances (2010 Edition), City of 16 Round Rock, Texas, is hereby amended to read as follows: 17 Sec. 42-224. Traffic signal controlled intersections. 18 19 The city council may designate, by ordinance or agreement with the state department of highways 20 and public transportation, intersections at which traffic shall be controlled by electronic traffic control lights 21 or signals. Whenever any intersection has been so designated, the director of planningTransportation 22 Director shall supervise the erection and maintenance of traffic control signals or lights as specified by the 23 state or city council and maintain an inventory of such signs. Ordinances and agreements designating 24 traffic signal controlled intersections have not been included in this Code and are on file in the office of 25 the city secretaryclerk. 26 27 XII. 28 That Chapter 42, Section 42-225, Code of Ordinances (2010 Edition), City of 29 Round Rock, Texas, is hereby amended to read as follows: 30 Sec. 42-225. Crosswalks, safety zones, and traffic lanes. 31 32 1 The Transportation Director is hereby authorized to supervise the designation 33 and maintenance, by appropriate devices, markings or lines upon the surface of the roadway, of 34 crosswalks at any intersection where, in his opinion, there is particular danger to pedestrians crossing the 35 roadway, and at such other places as he may deem necessary; to supervise the establishment of safety 36 zones of such kind and character and at such places as he may deem necessary for the protection of 37 pedestrians; and to supervise the marking of lanes for traffic on the street pavement at such places as he 38 may deem advisable, consistent with this chapter and state law. 39 4 1 XIII. 2 That Chapter 42, Section 42-315, Code of Ordinances (2010 Edition), City of 3 Round Rock, Texas, is hereby amended to read as follows: 4 Sec. 42-315. Parking near hazardous or congested places. 5 6 (a) The directoringTransportation Director is hereby authorized to determine and designate by 7 proper signs, places not exceeding 4801000 feet in length in which the stopping, standing, or parking 8 of vehicles would create an especially hazardous condition or would cause unusual delay to traffic. 9 (b) When official signs are erected at hazardous or congested places as authorized herein, no person 10 shall stop, stand, or park a vehicle in any such designated place. 11 12 XIV. 13 14 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are 15 expressly repealed. 16 B. The invalidity of any section or provision of this ordinance shall not 17 invalidate other sections or provisions thereof. 18 C.
