R-2018-5682 - 8/9/2018 RESOLUTION NO. R-2018-5682 WHEREAS, North Mays Street, from a point just south of U.S. 79 to Old Settlers/IH 35 Northbound Frontage Road, also known as Loop 384 and U.S. Highway 81, is a primary thoroughfare through the City of Round Rock (the "City"); and WHEREAS, FM 3406, from IH 35 Southbound Frontage Road to a point just west of Tonkawa Trail is also a primary thoroughfare through the City; and WHEREAS, the City has been in discussions with the Texas Department of Transportation (TxDOT) regarding the transfer of jurisdiction and conveyance of the rights-of-way for those portions of North Mays Street, and FM 3406 (the "Right-of-Way"), as described in Exhibits A &B, attached hereto and incorporated herein,Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: 1. The facts and recitations in the preamble of this Resolution are hereby found and declared to be true and correct, and are incorporated herein and expressly made a part hereof. 2. The City hereby requests that TxDOT transfer to the City the jurisdiction and convey the Right-of-Way to the City. 3. The City acknowledges that TxDOT will convey the Right-of-Way pursuant to Section 202.021 of the Texas Transportation Code. 4. The City shall accept maintenance of Right-of-Way after TxDOT completes, to the City's satisfaction, a mill/seal overlay of the North Mays Street Right-of-Way. 0112.1804;00406366/CDC The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended.
