CM-2018-1858 - 9/18/2018ELECTRONICALLY RECORDED 2018083996 Williamson County, Texas Total Pages: 9 Parccl 2 AMENDED DECLARATION OF RIGHT OF WAY North Mays Boulevard THE STATE OF TEXAS § § KNOW ALL BY THESE PRESENTS: COUNTY OF WILLIAMSON § That the CITY OF ROUND ROCK, a Texas home -rule municipal corporation (hereinafter called the "Declarant") has executed this Amended Declaration of Right of Way for the purpose of establishing the location of a portion of Declarant's property to be used for construction, reconstruction, widening, and maintaining proposed North Mays Boulevard roadway improvements and related drainage and utility relocations in, across and under the following described property in Williamson County, Texas, to -wit: All of that certain 2.659 acre (115,821 Sq. Ft.) tract of land in the David Curry Survey, Abstract No. 130, Williamson County, Texas; being more fully described by metes and bounds in Exhibit "A", attached hereto and incorporated herein Parcell The aforementioned described property is hereinafter referred to as the "Right of Way". The Right of Way is subject to any easements, restrictions, reservations, covenants, conditions, oil and gas [eases, mineral severances, and encumbrances for taxes and assessments (other than Iiens and conveyances) presently of record in the Official Public Records of Williamson County, Texas, that affect the property, but only to the extent that said items are still valid and in force and effect at this time. The Right of Way parcel hereby designated shall be used for the purpose of placing, constructing, operating, repairing, maintaining, rebuilding, replacing, relocating, and removing North Mays roadway improvements and related appurtenances, together with all necessary drainage, utility or any other public uses and purposes as further designated or desired by Declarant. Except as otherwise stated, the Right of Way and other rights and privileges hereby created shall be perpetual. However, it is expressly provided that this Declaration may be modified, amended, or terminated by Declarant at any time, and without any condition, requirement or prerequisite to same. This Amended_ Declaration is intended by Declarant to replace the previous Declaration which recorded in Document No. 2017055627 of the Official Public Records of Williamson County. Texas. The benefits and obligations of the Right of Way created herein shall constitute benefits and servitudes running with the land. A portion of the North Mays roadway extension and widening project being constructed by Williamson County is located along the frontage of the City's Public Safety Training (PST) facility. On June 16, 2017 the City Manager executed a Declaration of Right of Way identifying the 1.772 acre portion of the PST site which was to be used for the Mays interim construction project. Since that time it has been determined that the "ultimate" lane widening will be constructed, and the Amended Declaration identifies the 2.659 acre parcel which will be used for road r.o.w.
