Capital of Texas Highway, Buildi2, Suite 100, Austin, TX 78746 PROJECT: Kensin ton Detention and Channel Improvements This Supplemental Contract No. 5 to Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and K Friese & Associates, Inc., hereinafter called the "Engineer". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract", on the 22nd day of October, 2015 for the Kensington Detention and Channel Improvements Project in the amount of $169,843.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on October 2, 2017 to amend the scope of services and to increase the compensation by $10,478.11 to a total of $180,32 1.11; and WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on November 3, 2017 to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $4,000.00 to a total of $184,321.11; and WHEREAS, the City and Engineer executed Supplemental Contract No. 3 on February 9, 2018 to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $4,199.89 to a total of $188,521.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. 4 on May 25, 2018 to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $2,675.00 to a total of $191,196.00; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $36,000.00 to a total of $227,196.00; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: Article 2. Sheets, City Attorney ADDENDUM TO EXHIBIT B Engineering Services The City is expanding the scope of the Supplemental Contract No. 4 between the City of Round Rock and K Friese + Associates dated May 25, 2018. Sections 2.6 and 2.7 in the original contract shall add the following: 2.6.6 REDESIGN OF PLANS Due to unanticipated USACE permitting, the scope of work outlined in the original contract was exceeded requiring redesign of the proposed Kensington Detention Pond. The Engineer redesigned the proposed Kensington Detention Pond to reduce anticipated wetlands impacts to be under 0.1 total acres and less than 300 linear feet in order to eliminate mitigation due to USACE permitting. Detailed grading, structural, and outlet structure revisions to the plans was necessary to reduce impacts to delineated wetlands, in addition to additional H&H modeling to optimize pond storage performance. 2.7 BID AND CONSTRUCTION PHASE SERVICES 11. Engineer shall conduct 6 site visits (in addition to 6 under item 2.7.8) to observe the progress and quality of the work. 12. Engineer shall manage structural, geotechnical, environmental, and survey sub - consultants throughout duration of construction. 2.7.1 CONSTRUCTION PHASE SERVICES, STRUCTURAL Aguirre & Fields, LP shall provide structural construction phase services on the City of Round Rock Kensington Detention Pond Project. Proposed structural construction phase services effort shall include engineering support for the construction of the North Berm Outlet Structure, North Wall, and South Wall. Tasks shall include: 1. Construction Phase Services a. Coordination with the City and KFA (Meetings, Phone Calls, etc.) b. Request for Information (RFI) response (up to 4 @ 2 hrs each) c. Engineering support for construction activities as needed d. Shop drawing review and approval as needed i. Temporary Special Shoring (if required by Contractor) ii. Alternate Box Culvert Designs (if required by Contractor) e. Oversight support for the City as needed f. Minor redesign as needed g. Site Visits (up to 2 @ 2 hrs, 2 staff each) 2.7.2 CONSTRUCTION PHASE SERVICES, STRUCTURAL RABA KISTNER Consultants, Inc. (RKCI) shall provide the construction materials observation and testing services for the City of Round Rock Kensington Detention Pond Project. The anticipated effort summarized below is based on the understanding of the project, an estimate of quantities, and past experience with similar projects. Construction sequencing, delays, and the number of times that the client or their representative requests our services will affect the suggested budget. Services will be provided on a call -out basis. The scope of work includes the observation and testing of the following construction materials: B-1 of 2 ADDENDUM TO EXHIBIT B Engineering Services 1. Laboratory testing, in-place field nuclear density testing a. Anticipated a total of 16 lab tests and 46 in-place field tests and observations 2. Reinforcing steel observations, and a. The City previously entered into an Engineering Services Contract with K. Friese & Associates, Inc. to design a regional stormwater detention pond and channel repairs for the Dry Branch Tributary 1 traversing through the Kensington Place neighborhood. The scope of services for the original contract included the design of the detention pond facility, the design of the channel improvements, and repairs to the existing drop structures located within the channel for the Dry Branch Tributary 1. The design of the channel repairs and improvements have already been completed and constructed. This Supplemental Contract No. 5 is to provide construction phase services for the Kensington Detention Improvements portion of this project. There will need to be site visits conducted to observe progress and work quality during construction. Support will be needed for laboratory and field testing as well as engineering support during construction of the North Berm Outlet Structure and the two walls. The current Engineering Services Contract provided for a maximum payment of $191,196. This supplement is for $36,000 which will increase the contract to a maximum of $227,196.
