DECLARATION OF WASTEWATER EASEMENT

§ KNOW ALL BY THESE PRESENTS:
COUNTY OF WILLIAMSON §
WHEREAS, the City of Round Rock is the owner of a tract of land described as Lot IE,
Block A, Round Rack Express, Section Three, Lot 6, BIock C, Replat, a subdivision in
Williamson County, Texas, according to the map or plat thereof recorded under Document
Number 2016006145, Official Public Records of Williamson County, Texas (the "City
Property"); and
WHEREAS, the City of Round Rock desires to use a portion of the City property for
location of a wastewater easement;
NOW, THEREFORE, in consideration of the foregoing premises, the City of Round
Rock makes the following Declaration of Wastewater Easement:
That the CITY OF ROUND ROCK, a Texas home -rule municipal corporation
(hereinafter called the "Declarant") has executed this Declaration of Wastewater Easement for
the purpose of establishing the following exclusive easement in and under the following
described property in Williamson County, Texas, to -wit:
Being 0.02 acres of land out of Lot IE, Block A, Round Rock Express, Section
Three, Lot 6, Block C, Replat, a subdivision in Williamson County, Texas,
according to the map or plat thereof recorded under Document Number
2016006145, Official Public Records of Williamson County, Texas; said 0,02
acre tract being more fully described by metes and bounds and sketch in Exhibit
"A" attached hereto and made a part hereof for all purposes.
The perpetual easement, right-of-way, rights and privileges herein granted shall be used
for the purposes of constructing, installing, operating, maintaining, inspecting, reconstructing,
enlarging, relocating, rebuilding, repairing, and removing a wastewater system and lines,
together with all necessary Iines, pipes, conduits, valves, vaults, manholes, ventilators, and other
equipment, improvements, accessories and appurtenances or operations thereto.
Declarant retains, reserves, and shall continue to enjoy the surface of such easement for
any and all purposes which do not interfere with and prevent the use of the easement. Declarant
will not be responsible or liable for any damage to utilities placed within the easement caused by
DecIarant's use of the surface pursuant to this paragraph.
Except as otherwise stated, the easement and other rights and privileges hereby created
shall be perpetual. Flowever, it is expressly provided that this Declaration may be modified,

amended, or terminated by Declarant at any time, and without any condition, requirement or
prerequisite to same.
The benefits and obligations of the easement created herein shall constitute benefits and
servitudes running with the land.

Consideration and possible execution of a Declaration of Wastewater Easment related to
the Dlamond Oaks Residential project.
The wastewater line was installed on private property very near the property line of a City
owned lot. A portion of the wastewater easement for the new line is on the city -owned lot.
This declaration will serve with the rest of the easement to ensure the City always has
access to the main for maintenance if needed.
