TEMPORARY CONSTRUCTION WORKSPACE EASEMENT

COUNTY OF WILLIAMSON g KNOW ALL MEN BY THESE PRESENTS:
That KENDELL BRENT CAMPBELL, referred to as "Grantor", in consideration of the
construction of certain roadway improvements and other good and valuable consideration by CITY OF
ROUND ROCK, TEXAS, ("GRANTEE") does hereby grant to GRANTEE, its agents, contractors,
successors and assigns, a temporary construction workspace easement for the purpose of additional
workspace and grading to allow construction and installation of proposed roadway, parking, sidewalk,
driveway, and grading facilities and other necessary structures and related appurtenance construction
("Project"), all to be located within adjacent easements or right of way owned or possessed by
GRANTEE, in, along, upon and across the property ("Property") located in the County of Williamson,
State of Texas, more fully described in Exhibits "A -B" attached hereto and made a part hereof for any
and all purposes. The facilities constructed by Grantee shall be in the general locations and according to
the plans and specifications as shown in Exhibit "C" attached hereto and incorporated herein.
For the consideration above recited and the mutual covenants and conditions herein contained the
parties further agree as follows: NIA.
Following completion of work within the temporary construction workspace easement area
described in Exhibits "A -B", if GRANTEE has removed or damaged improvements, herbage, or
landscaping within said easement area or otherwise on Grantor's property, GRANTEE shall at its
expense restore properties injured by GRANTEE's activities as closely as commercially possible to
substantially the same condition as existed previous to GRANTEE's entry upon the particular property,
taking into account the proposed modifications as described herein. GRANTOR shall be responsible for
the cost of reconstruction or replacement of any existing fencing which is removed from the Property by
GRANTEE for use of the Easement as set out herein.
To the extent allowed by law, GRANTEE shall indemnify Grantor against any loss and damage
which shall be caused by the exercise of the rights of ingress and egress or by any wrongful or negligent
act or omission of GRANTEE's agents or employees in the course of their employment.
This Easement and License shall be in full force and effect at all times during the
accomplishment and completion of the construction Project activities described above. Said Easement
shall terminate and all use rights within land area shall revert to the Grantor, their heirs, and assigns, and
all interest conveyed herein shall cease on the expiration of eight (8) months from the date of first entry
upon the property described in Exhibits "A -B" for the purposes set out herein, or on the date of
completion of construction of the bridge, roadway and channel facility Project activities described above,
whichever occurs first. Grantee shall only remove any hardwood trees larger than 6 (six) inches in
diameter from the temporary construction workspace easement areas if approved and determined by the
City Engineer in advance to be necessary and required for reasonable access to the Property to carry out
the purposes identified herein.

GRANTEE shall be allowed to extend the duration of the Temporary Workspace and Staging
Easement identified herein for up to six (6) additional thirty (30) day periods upon: (1) notification to
Grantor in writing of the requested extension period, and (2) tendering the additional sum of 5250 for
each additional extension period used.

Please allow this letter to set out my understanding regarding our agreement for
the City of Round Rock's ("City") acquisition of a temporary easement over a portion of
your ("Owner") property located at 503 Main Street which is to be used for construction
of proposed improvements to McNeil Road Ph. 2/Lewis Street ("Project").
The parties hereby agree as follows:
I. Owner shall convey a temporary construction workspace easement (the
"Easement") in and across those two certain parcels ("the Property") totaling 0.02
acres, and as described in greater detail by metes and bounds in Exhibits "A & B"
attached hereto and incorporated herein.
2. The form of the Easement for the temporary use of the Property shall be as shown
in Exhibit "C" attached hereto and incorporated herein.
3. As part of the proposed Project the City shall cause roadway improvements to be
constructed in the locations and in substantial accordance with the plans,
specifications, notes and requirements as shown in Exhibit "D" attached hereto
and incorporated herein subject only to final letting plan review, comment and
approval.
4. As part of the proposed Project the City shall construct a minimum of two (2)
ADA compliant parking spaces adjacent to the proposed Lewis Street
improvements, with locations to be determined as part of the final letting plan
review, comment and approval.

5. As part of the proposed Project the City shall cause concrete paving
improvements to be constructed along the width of the existing alley right of way
between the parcels of Owner. The paving shall extend approximately fifty (50)
feet along the proposed alley from the Property r.o.w. line, as further described
and shown in Exhibit "D (Page 2 of 2)" attached hereto and incorporated herein.
The proposed alley paving improvements shall be constructed in accordance with
all applicable City design standards and criteria for such improvements.
6. City agrees that it shall use all reasonable efforts to assist Owner in contact and
coordination with the City's Project construction contractor to facilitate the
Owner's negotiation for additional construction of any desired paving outside of
City right of way and on the remaining property of Owner simultaneously with
the construction of the Project and at the expense of Owner.
7. Owner shall be solely responsible for the removal, relocation or reconstruction of
any fencing or other improvements within the Easement Property which is agreed
to be conveyed herein, and any associated costs for such removal, relocation or
reconstruction. If any improvements within the Property are not removed within
thirty (30) days following the Owner's execution of the Easement for the Property
as set out herein, subject to extensions in writing from City, then they may be
subject to removal by the City's Project contractor.
This letter contains all of the provisions or agreements between the parties and
concerning the Property and the Project which are identified herein, and in any exhibits
attached hereto.
If this meets with your understanding please execute this letter where indicated
and return it to me, and we will have this approved and signed by the City and process
this for completion as quickly as possible.

TEMPORARY CONSTRUCTION WORKSPACE EASEMENT
Lewis Street Improvements
THE STATE OF TEXAS
COUNTY OF WILLIAMSON § KNOW ALL MEN BY THESE PRESENTS:
That KENDELL BRENT CAMPBELL, referred to as "Grantor", in consideration of the
construction of certain roadway improvements and other good and valuable consideration by CITY OF
ROUND ROCK, TEXAS, ("GRANTEE") does hereby grant to GRANTEE, its agents, contractors,
successors and assigns, a temporary construction workspace easement for the purpose of additional
workspace and grading to allow construction and installation of proposed roadway, parking, sidewalk,
driveway, and grading facilities and other necessary structures and related appurtenance construction
("Project"), all to be located within adjacent easements or right of way owned or possessed by
GRANTEE, in, along, upon and across the property ("Property") located in the County of Williamson,
State of Texas, more fully described in Exhibits "A -B" attached hereto and made a part hereof for any
and all purposes. The facilities constructed by Grantee shall be in the general locations and according to
the plans and specifications as shown in Exhibit "C" attached hereto and incorporated herein.
For the consideration above recited and the mutual covenants and conditions herein contained the
parties further agree as follows: NIA.
Following completion of work within the temporary construction workspace easement area
described in Exhibits "A -B", if GRANTEE has removed or damaged improvements, herbage, or
landscaping within said easement area or otherwise on Grantor's property, GRANTEE shall at its
expense restore properties injured by GRANTEE's activities as closely as commercially possible to
substantially the same condition as existed previous to GRANTEE's entry upon the particular property,
taking into account the proposed modifications as described herein. GRANTOR shall be responsible for
the cost of reconstruction or replacement of any existing fencing which is removed from the Property by
GRANTEE for use of the Easement as set out herein.
To the extent allowed by law, GRANTEE shall indemnify Grantor against any loss and damage
which shall be caused by the exercise of the rights of ingress and egress or by any wrongful or negligent
act or omission of GRANTEE's agents or employees in the course of their employment.
This Easement and License shall be in full force and effect at all times during the
accomplishment and completion of the construction Project activities described above. Said Easement

COUNTY OF WILLIAMSON § KNOW ALL MEN BY THESE PRESENTS:
That KENDELL BRENT CAMPBELL, referred to as "Grantor", in consideration of the
construction of certain roadway improvements and other good and valuable consideration by CITY OF
ROUND ROCK, TEXAS, ("GRANTEE") does hereby grant to GRANTEE, its agents, contractors,
successors and assigns, a temporary construction workspace easement for the purpose of additional
workspace and grading to allow construction and installation of proposed roadway, parking, sidewalk,
driveway, and grading facilities and other necessary structures and related appurtenance construction
("Project"), all to be located within adjacent easements or right of way owned or possessed by
GRANTEE, in, along, upon and across the property ("Property") located in the County of Williamson,
State of Texas, more fully described in Exhibits "A -B" attached hereto and made a part hereof for any
and all purposes. The facilities constructed by Grantee shall be in the general Iocations and according to
the plans and specifications as shown in Exhibit "C" attached hereto and incorporated herein.
For the consideration above recited and the mutual covenants and conditions herein contained the
parties further agree as follows: NIA.
Following completion of work within the temporary construction workspace easement area
described in Exhibits "A -B", if GRANTEE has removed or damaged improvements, herbage, or
landscaping within said easement area or otherwise on Grantor's property, GRANTEE shall at its
expense restore properties injured by GRANTEE's activities as closely as commercially possible to
substantially the same condition as existed previous to GRANTEE's entry upon the particular property,
taking into account the proposed modifications as described herein. GRANTOR shall be responsible for
the cost of reconstruction or replacement of any existing fencing which is removed from the Property by
GRANTEE for use of the Easement as set out herein.
To the extent allowed by law, GRANTEE shall indemnify Grantor against any loss and damage
which shall be caused by the exercise of the rights of ingress and egress or by any wrongful or negligent
act or omission of GRANTEE's agents or employees in the course of their employment.
This Easement and License shall be in full force and effect at all times during the
accomplishment and completion of the construction Project activities described above. Said Easement
shall terminate and all use rights within land area shall revert to the Grantor, their heirs, and assigns, and
all interest conveyed herein shall cease on the expiration of eight (8) months from the date of first entry
