Section 10-33 of the Subdivision Ordinance allows a landowner to request the vacation of an easement established by an approved plat or by separate instrument. The temporary construction easement, which is approximately 60 feet in width and 832 feet in length, was created in 1986 in the same vicinity as a permanent public utility easement. Typically, upon conclusion of construction or installation of utility infrastructure (and especially given an existing permanent easement), the temporary construction easement automatically expires or is no longer in effect. For unknown reasons, the temporary construction easement from 1986 still appears on surveys and other land documents. In an effort to permanently and officially nullify the temporary construction easement, this request is for a formal release by the City. The City of Round Rock Utilities and Environmental Services Department has consented to the proposed vacation. Staff recommends approval of the temporary construction easement vacation.
