For valuable consideration, the receipt of which is hereby acknowledged, Releasor City of
Round Rock does abandon, release, discharge, and quitclaim all of its right, title, and interest in
the TCE described herein.
This Release of Temporary Construction Easement is given specifically to release only the
temporary construction easement rights across the Property shown on Exhibit "A" held by the City
of Round Rock. The permanent easement as described in the easement document from Palm Valley
Lutheran Church of Round Rock, Texas to the City of Round Rock, Texas, as recorded in Volume
1347, Page 575, Official records of Williamson County shall remain in full force and effect.,

This is an application to vacate a temporary construction easement across property owned by
the Palm Valley Lutheran Church. Section 10-33 of the Subdivision Ordinance allows a
landowner to request the vacation of an easement established by an approved plat or by
separate instrument. The temporary construction easement, which is approximately 60 feet in
width and 832 feet in length, was created in 1986 in the same vicinity as a permanent public
utility easement. Typically, upon conclusion of construction or installation of utility infrastructure
(and especially given an existing permanent easement), the temporary construction easement
automatically expires or is no longer in effect. For unknown reasons, the temporary construction
easement from 1986 still appears on surveys and other land documents. In an effort to
permanently and officially nullify the temporary construction easement, this request is for a
formal release by the City.
The City of Round Rock Utilities and Environmental Services Department has consented to the
proposed vacation.
Staff recommends approval of the temporary construction easement vacation.
