O-2019-0136 - 3/14/2019I ORDINANCE NO. 0-2019-0136 2 3 4 AN ORDINANCE AMENDING ZONING AND DEVELOPMENT CODE, 5 CHAPTER 10, ARTICLE IX, SECTION 10-66 (c) and (d), SECTION 10- 6 67 (c), AND SECTION 10-68, CODE OF ORDINANCES (2018 EDITION), 7 CITY OF ROUND ROCK, TEXAS, REGARDING MEMBERSHIP AND 8 TERMS OF THE HISTORIC PRESERVATION COMMISSION, THE 9 ZONING BOARD OF ADJUSTMENTS, AND THE PLANNING AND 10 ZONING COMMISSION; AND PROVIDING FOR A SAVINGS CLAUSE 11 AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. 12 13 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, 14 TEXAS: 15 I. 16 That Zoning and Development Code, Chapter 10, Article IX, Section 10-66 (c) 17 and (d), Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby 18 amended as follows: 19 CHAPTER 10. ZONING AND DEVELOPMENT REVIEW PROCEDURE AND BODIES 20 21 Sec. 10-66. - Historic preservation commission (HPC). 22 23 (c) Membership, terms and compensation. 24 (1) Number, appointment. The HPC shall consist of seven regular members. Appointment of 25 members shall be made by the city council at the first regular meeting of the city council in 26 August. Members shall be residents of the city for the last 12 months and eligible voters. 27 (2) Terms. Terms of members of the HPC shall be for two years, and shall expire on August 31; 28 provided, however, that members shall continue to serve until their successors are appointed. 29 Members shall not serve on the HPC for more than eight consecutive years. 30 (3) Qualifications. In making appointments to the HPC, the council shall attempt to maintain a 31 balance of interest and skills on the HPC by assessing the individual qualifications of the 32 candidates, including but not limited to, their knowledge and demonstrated interest in 33 preservation related fields such as architecture, history, archaeology, planning, or urban or 34 community design. All members shall have a knowledge and demonstrated interest in historic 35 preservation. 36 (4) Current members. Members of the HPC on the effective date of the ordinance from which this 37 chapter is derived shall continue to serve until their respective terms expire. 38 (5) Vacancies. Vacancies shall be filled by the city council for the unexpired term of any member 39 whose term becomes vacant. 40 (6) Removal. Any member who misses three consecutive meetings shall forfeit the position and a 41 replacement shall be appointed by the city council to fill the unexpired term. An HPC member 42 shall serve at the will of the city council. 01 12,1902; 00418934/ss2 1 (7) Compensation. Members shall serve without pay. Members may be reimbursed for actual 2 expenses incurred in the performance of their duties from available funds approved in advance. 3 (d) Procedures. 4 (1) Chairperson and vice chair. The chairperson of the HPC shall be elected from the membership 5 of the HPC by a majority of the members of the HPC. A vice chair to serve in the chairperson's 6 absence shall be likewise elected. 7 (2) Secretary. The zoning administrator shall designate a staff representative to act as secretary of 8 the HPC and attend and keep minutes of all meetings. The secretary shall act only in an 9 advisory capacity and shall participate in its discussions, but shall have no right to vote. The 10 secretary of the HPC shall also serve as the local preservation officer and fulfill all the duties as 11 may be required under the certified local government agreement with the Texas Historical 12 Commission. 13 (3) Regular posted meetings. The HPC shall meet at regular intervals with advance notice posted 14 according to the Texas Open Meetings Act, V.T.C.A., Local Government Code ch. 551. 15 (4) Special meetings. Special meetings may be called upon request of the chairperson of the HPC, 16 or upon written request of three members, or upon notice from the zoning administrator that a 17 matter requires the consideration of the HPC. 18 (5) Hearing for certificate of appropriateness. Upon the filing of an application for a certificate of 19 appropriateness in an historic district or historic landmark, the HPC shall hold a hearing to 20 render a decision on the application. 21 (6) Quorum. Four members shall constitute a quorum for transactions of business and no decision 22 shall be rendered without a concurring vote of at least four members. 23 (7) Robert's Rules of Order. ZONING AND DEVELOPMENT REVIEW PROCEDURE AND BODIES 30 Sec. 10-67. - Zoning board of adjustment (ZBA). 31 32 (c) Membership, terms and compensation. 33 (1) Number, appointment. The ZBA shall consist of five regular members and two alternate 34 members. Appointment of members shall be made by the city council at the first regular meeting 35 of the city council in August. Members shall be residents of the city for the last 12 months and 36 eligible voters. 37 (2) Terms. Terms of the ZBA shall be for two years, and shall expire on August 31; provided, 38 however, that members shall continue to serve until their successors are appointed. Members 39 shall not serve on the ZBA for more than eight consecutive years. 40 (3) Current members. Members of the existing development review board on the effective date of 41 the ordinance from which this chapter is derived shall continue to serve on the ZBA until their 42 respective terms expire. N 1 (4) Vacancies. Vacancies shall be filled by the city council for the unexpired term of any member 2 whose term becomes vacant. 3 (5) Removal. A ZBA member may be removed by the city council for cause, on a written charge, 4 after a public hearing. 5 (6) Compensation. Members shall serve without pay. Members may be reimbursed for actual 6 expenses incurred in the performance of their duties from available funds approved in advance. 7 8 9 That Zoning and Development Code, Chapter 10, Article IX, Section 10-68, Code 10 of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 11 follows: 12 CHAPTER 10. ZONING AND DEVELOPMENT REVIEW PROCEDURE AND BODIES 13 Sec. 10-68. - Planning and zoning commission (P&Z). 14 15 (a) Creation. The city, as a home rule city, has by city Charter all the powers authorized by Texas Local 16 Government Code, which are hereby adopted, which authorize the appointment of a P&Z, and which 17 set out certain authority and responsibilities for such a P&Z. 18 (b) Powers and duties. The P&Z shall have the following powers and duties pursuant to the provisions of 19 applicable statutory requirements for a P&Z: 20 (1) General plan. The P&Z shall prepare and modify the general plan for the city, for approval and 21 adoption by the city council. 22 (2) Text amendments. The P&Z shall review and make recommendations to the city council in 23 regard to amendments to the text of this code. 24 (3) Application for original zoning. The P&Z shall review and make recommendations to the city 25 council in regard to applications for original zoning. 26 (4) Zoning map amendments. The P&Z shall review and make recommendations to the city council 27 in regard to amendments to the official zoning map. 28 (5) Planned unit development (PUD). The P&Z shall review and make recommendations to the city 29 council in regard to applications for planned unit developments. 30 (6) Historic (H) overlay designation. The P&Z shall review and make recommendations to the city 31 council in regard to applications for designation of Historic (H) overlay districts. 32 (7) Subdivision and plat review. The P&Z shall study plans and plats of proposed subdivisions, 33 determine whether such subdivisions meet all the standards and requirements as required by 34 Chapters 4 and 6 of the code, and shall be responsible for rendering decisions on proposed 35 subdivisions. 36 (8) Other duties as assigned by the city council. The P&Z shall perform such other functions as 37 may be duly delegated to them from time to time by the city council. 38 39 (c) Membership, terms and compensation. 3 (1) Number, appointment. Members of the P&Z on the effective date of the ordinance from which this 10 chapter is derived shall continue to serve until their respective terms expire. 11 (4) Vacancies. Vacancies shall be filled by the city council for the unexpired term of any member 12 whose term becomes vacant. 13 (5) Removal. The chairperson of the P&Z shall be elected from the membership of the P&Z by a 20 majority of the members. A vice chair to serve in the chairperson's absence shall be likewise 21 elected. 22 (2) Meetings. Meetings of the P&Z shall adopt and publish an annual calendar with corresponding 23 submittal dates. The chairperson shall designate the time and place of such meetings. All 24 meetings of the P&Z shall be open to the public. In addition to its regular meetings, meetings 25 also may be called upon request of the chairperson of the P&Z, or upon written request of three 26 members, or upon notice from the zoning administrator that a matter requires the consideration 27 of the P&Z. 28 (3) Quorum. A quorum shall consist of a majority of the entire membership of the P&Z and any 29 issue to be voted on shall be resolved by a majority of those present. 30 (4) Notice of meetings. Public notice of all meetings of the P&Z shall be posted according to the 31 Texas Open Meetings Act. 32 (5) Rules of proceeding. The P&Z shall adopt its own rules of procedure, provided that such shall 33 not be in conflict with laws applicable to the P&Z or any provisions of the city Charter. 34 (6) Minutes. The P&Z shall keep minutes of its proceedings, showing the vote of each member 35 upon each question, or, if absent or failing to vote, indicating that fact. 36 37 38 IV. 39 40 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are 41 expressly repealed. 42 B. The invalidity of any section or provision of this ordinance shall not 43 invalidate other sections or provisions thereof. CI I C. The City Council hereby finds and declares that written notice of the date, 2 hour, place and subject of the meeting at which this Ordinance was adopted was posted 3 and that such meeting was open to the public as required by law at all times during 4 which this Ordinance and the subject matter hereof were discussed, considered and 5 formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas 6 Government Code, as amended. 7 Alternative 1. s By motion duly made, seconded and passed with an affirmative vote of all the 9 Council members present, the requirement for reading this ordinance on two separate r 12 13 14 15 16 17 1s 19 20 21 22 23 24 25 26 27 days was dispensed with.
