O-2019-0137 - 3/14/2019I ORDINANCE NO. 0-2019-0137 2 3 4 AN ORDINANCE AMENDING ZONING AND DEVELOPMENT CODE, 5 CHAPTER 8, ARTICLE X, DIVISION 13, SECTION 163, CODE OF 6 ORDINANCES (2018 EDITION), CITY OF ROUND ROCK, TEXAS, 7 REGARDING MEMBERSHIP AND TERMS OF THE BUILDING 8 STANDARDS COMMISSION; AND PROVIDING FOR A SAVINGS 9 CLAUSE AND REPEALING CONFLICTING ORDINANCES AND 10 RESOLUTIONS. 11 12 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, 13 TEXAS: 14 I. 15 That Zoning and Development Code, Chapter 8, Article X, Division 13, Section 16 163, Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby 17 amended as follows: 18 DIVISION 13. BUILDING STANDARDS COMMISSION (BSC) 19 20 Sec. 8-163. — Building standards commission established. 21 22 (a) Creation. The city hereby implements Chapter 4, subchapter C of the Texas Local Government Code 23 (V.T.C.A., Local Government Code § 54.031 et seq.). Pursuant to such subchapter, the city council 24 shall provide for the appointment of a BSC, and the regulations and restrictions adopted shall be 25 pursuant to the provisions of applicable statutory requirements for a BSC under state law. 26 (b) Membership, terms and compensation 27 (1) Number, appointment. The BSC shall consist of five members. Appointment of members shall 28 be made by the city council at the first regular meeting of the city council in August. All members 29 shall reside within the corporate city limits or within the extraterritorial jurisdiction of the city 30 during the time in which they serve on the BSC. To the extent possible, the city council shall 31 appoint members to the BSC who have experience or expertise in the building trade. 32 (2) Terms. Terms for members shall be for two years, and shall expire on August 31; provided, 33 however, that the members shall continue to serve until their successors are appointed. 34 Members shall not serve on the BSC for more than eight consecutive years. 35 (3) Initial appointments. The initial appointments to the BSC shall have staggered terms so that two 36 members are appointed for one-year terms and three members are appointed for two-year 37 terms. 38 (4) Vacancies. Vacancies shall be filled by the city council for the unexpired terms of any member 39 whose term becomes vacant. 40 (5) Removal. A BSC member may be removed by the city council for cause on a written charge and 41 after a public hearing if so requested by the building standards commission member subject to 42 the removal action. 0112.1902; 00418936/ss2 1 (6) Compensation. Members shall serve without pay. Members may be reimbursed for actual 2 expenses incurred in the performance of their duties from available funds approved in advance. 3 4 s A. All ordinances, parts of ordinances, or resolutions in conflict herewith are 6 expressly repealed. 7 B. The invalidity of any section or provision of this ordinance shall not s invalidate other sections or provisions thereof. 9 C.
