4 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE IV, DIVISION 3,
5 SECTION 2-271, CODE OF ORDINANCES (2018 EDITION), CITY OF
6 ROUND ROCK, TEXAS, REGARDING MEMBERSHIP AND TERMS OF
7 THE CAPITAL IMPROVEMENT ADVISORY COMMITTEE; AND
8 PROVIDING FOR A SAVINGS CLAUSE AND REPEALING
9 CONFLICTING ORDINANCES AND RESOLUTIONS.

11 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
12 TEXAS:
13 I.
14 That Chapter 2, Article IV, Division, 3, Section 2-271, Code of Ordinances (2018
15 Edition), City of Round Rock, Texas, is hereby amended as follows:
16 DIVISION 3. CAPITAL IMPROVEMENT ADVISORY COMMITTEE (CIAC)

18 Sec. 2-271. — Membership, terms and compensation
19
20 (a) Appointment. The P&Z members shall serve as the CIAC, and the city council's action of appointing
21 the P&Z members shall be deemed to be their simultaneous appointment as members of the CIAC.
22 If the P&Z does not have at least one representative from the real estate, development, or building
23 industries, then one such representative shall be appointed by the city council as an ad hoc voting
24 member of the CIAC. If the impact fee is to be applied in the extraterritorial jurisdiction (ETJ) of the
25 city, the CIAC membership must include a representative from that area.
26 (b) Terms. Terms for CIAC members that are P&Z members shall cease or expire when their P&Z term
27 ceases or expires. The term for an ad hoc voting member or member residing in the ETJ, who is not
28 a member of the P&Z, shall be for two years, and shall expire on August 31; provided, however, that
29 the members shall continue to serve until their successors are appointed. Members shall not serve
30 on the CIAC for more than eight consecutive years.
31 (c) Vacancies. Vacancies shall be filled by the city council, as necessary, for the unexpired term of any
32 member whose term becomes vacant.
33 (d) Removal. CIAC members who are P&Z members shall be removed in accordance with the
34 conditions of removal for a P&Z member. A CIAC member who is not a member of the P&Z shall
35 serve at the will of the city council.
36 (e) Compensation. Members shall serve without pay. Members may be reimbursed for actual expenses
37 incurred in the performance of their duties from available funds approved in advance.

3 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
4 expressly repealed.
s B. The invalidity of any section or provision of this ordinance shall not
6 invalidate other sections or provisions thereof.
7 C. The City Council hereby finds and declares that written notice of the date,
s hour, place and subject of the meeting at which this Ordinance was adopted was posted
9 and that such meeting was open to the public as required by law at all times during
10 which this Ordinance and the subject matter hereof were discussed, considered and
11 formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas
12 Government Code, as amended.

14 By motion duly made, seconded and passed with an affirmative vote of all the
15 Council members present, the requirement for reading this ordinance on two separate
16 days was dispensed with.
