AGREEMENT REGARDING NORTH MAYS EXTENSION PROJECT — PARCEL 7
DETENTION POND
The City of Round Rock, Texas (the "City") has previously provided, for the benefit of
CHANDLER CREEK, LP ("Chandler Creek"), that certain letter dated June 21, 2018, a copy of
which is attached to this Agreement as Exhibit "A" and is incorporated herein by reference (the
"June 21 Letter"). The June 21 Letter relates to proposed modifications to a detention pond (the
"Parcel 7 Detention Pond") by Williamson County, Texas (the "County") being undertaken by
the County in connection with a roadway improvement project known as the "North Mays
Extension Project" (herein so called). The Parcel 7 Detention Pond is located within the
"Reconstruction Area" (herein so called) depicted on Exhibit `B" attached to this Agreement and
incorporated herein by reference (the "Reconstruction Areal% on property owned by Chandler
Creek.
The City and Chandler anticipate, in connection with the North Mays Extension Project:
(1) the removal of certain existing landscaping and screening improvements within the
Reconstruction Area as depicted on Exhibit "C" attached to this Agreement and incorporated
herein by reference; and (2) the installation of replacement Iandscaping and improvements as
depicted on Exhibit "D" attached to this Agreement and incorporated herein by reference (the
"Replacement Landscaping and Screening Improvements".
The City hereby: (1) ratifies and confirms the June 21 letter; and (2) agrees that it will, at
its own expense, complete the construction and installation of the Replacement Landscaping and
Screening Improvements within 60 days after the completion by the County of the
modifications to the Parcel 7 Detention Pond.

The purpose of this letter is to provide Information regarding landuzW requirements al the Parcel 7
detention pond located on the property of The Oaks at Chandler Creek Commercial Condominiums (Dor.
Na 20070-1M2) as related to the construction or the North Mays Street Extension project
The alignment of North Mays St as it intersects with Oakmont Drive will likely impact the existing
perimeter oIt he detention por=d and a portion of the existfrtg pond perimeter screen planting. Please
note that the work that is necessary to complete construdion of this City of Round Rock / Wilco street
extension project may necessitate removal of, or damage to. existing landscape plant material.
The property owner of the property on which the Parcel 7 detention pond is situated Is not, and will not
be, held responsible for the damaged or removed landscaping that has resulted from construction of
this project; will not be fined or penalized for this damage/ removal, and will not be required to make
any replacement of this material in the future
In addition, If any of the existing landscape Irrigation is damaged by work related to the referenced
project, it will be repaired within the scope of the contract for the protect.
