AGREEMENT FOR MUSICIAN MANAGEMENT
SERVICES FOR SCULPT FEST 2019
This is an Agreement for Musician Management Services for SculptFest 2019 between
the City of Round Rock (the "City"), whose address is 221 East Main Street, Round Rock,
Texas 78664, and James Linton (dba Linton Music) (the "Provider"), whose address is 18709
Double Canyon Drive, Jonestown, Texas 78645.
1. SculptFest 2019
Festival: Local singer -songwriters play during the three (3) day annual
sculpture exhibition co-sponsored by The Sculpture Society of Texas
and the City of Round Rock.
Location: Centennial Plaza in Round Rock, Texas
Dates and Times: April 26, 2019 — 5:00 p.m. to 9:00 p.m.
April 27, 2019 11:00 a.m. to 9:00 p.m.
April 28, 2019 — 11:00 a.m. to 4:00 p.m.
2. Scope of Work
Provider to schedule all musicians for SculptFest 2019 and manage the stage during said
festival. Musicians who performed at SculptFest 2018 shall be contacted first by
Provider regarding performing at SculptFest 2019 prior to additional area musicians
being added to the roster.
3. Compensation
Musicians scheduled by Provider shall play nineteen (19) one-hour shows during
SculptFest 2019. Provider shall be paid a total compensation of Three Thousand and
No/100 Dollars ($3,000.00) no later than the close of the event at 4:00 p.m. on April 28,
2019.
Provider's compensation shall be used to pay the musicians as follows:
(a) One Hundred and No/100 Dollars ($100.00) for solo acts; and
(b) Two Hundred and No/100 Dollars ($200.00) for groups.
Provider shall retain Four Hundred and No/100 Dollars ($400.00) for scheduling
musicians and maintaining the stage for all three (3) days of SculptFest 2019.

4. Sound and Lighting
Sound and lighting for performances will be provided by Interactive Entertainment
Systems, Round Rock, Texas.
5. Cancellation
City advises Provider that the performances may be cancelled, with the duty of City to
pay extinguished, only as follows: by City, with or without cause, if written cancellation
notice is given to Provider not less than thirty (30) days prior to the performance date.
b. Independent Contractor
Provider is an independent contractor, and is not City's employee. This document does
not create a partnership relationship, employer:"employee relationship, joint venture
relationship, principal;'agent relationship, or any other relationship of similar kind, and no
party shall represent itself to third parties as having such relationship.
7. Insurance
City has general liability insurance relative to potential third -party claims arising from the
performance.
City will not provide insurance coverage, such as health, accident or worker's
compensation coverage, for the Provider, his agents, employees, volunteers, members of
the performing group, or anyone else connected, and City will not provide insurance
coverage for any musical instruments, equipment or vehicles.
8. Inclement Weather
In an outdoor venue, City will determine in good faith whether any inclement weather
conditions will render the performance impossible, hazardous or unsafe. In the event of
weather cancellation by City, payment in full will be made by City.
9. Compliance with Laws
In accordance with Chapter 2270, Texas Government Code, a governmental entity may
not enter into a contract with a company for goods and services unless the contract
contains written verification from the company that it: (1) does not boycott Israel; and (2)
will not boycott Israel during the term of the contract. The signatory executing this
Agreement on behalf of Artist verifies that Artist does not boycott Israel and will not
boycott Israel during the term of this Agreement.
