KNOW ALL BY THESE PRESENTS:
THIS SUPPLEMENTAL AGREEMENT NO. I to "City of Round Rock Agreement for
Professional Consulting Services for Construction Materials Testing Services with Rock
Engineering & Testing Laboratory, Inc.," hereinafter called "Supplemental Agreement No. l," is
made by and between the City of Round Rock, Texas, a home -rule municipality, hereinafter
called the "City" and Rock Engineering & Testing Laboratory, Inc., hereinafter called the
"Consultant."
WHEREAS, the City and Consultant executed the referenced "city of Round Rock
Agreement for Professional Consulting Services for Construction Materials Testing Services,"
hereinafter called the "Agreement," on March 22, 2018 by Resolution No. R-2018-5269; and
WHEREAS, the City desires to amend the Scope of Services to add additional services
related to construction materials testing for the Luther Peterson Service Center Project; and
WHEREAS, it is necessary to amend the Scope of Services, the Fee and the Term of
services provided in the Agreement;
NOW THEREFORE, in consideration of the mutual promises and obligations in the
Agreement and this Supplemental Agreement No. I, the City and Consultant agree that said
Agreement is amended and supplemented as follows:
I.
Section 1.01 of the A reement is hereby amended to read as follows:
1.01 EFFECTIVE DATE, DURATION, AND TERM
This Agreement shall be effective on the date this Agreement has been signed by each
party hereto, and shall remain in full force and effect until it expires by operation of the term
indicated herein, or is terminated or extended as provided herein.

The term of this Agreement shall be until full and satisfactory completion of the work
specified herein is achieved which is not estimated to exceed tie -(12 fourteen (14) months.
H.
Section 3.01 of the Agreement is hereby amended to read as follows:
3.01 SCOPE OF SERVICES
Consultant shall satisfactorily provide all services described herein and as set forth in
Exhibit "A" and the Addendum to Exhibit "A," which document is incorporated herein for all
purposes. Consultant's undertaking shall be limited to performing services for the City and/or
advising City concerning those matters on which Consultant has been specifically engaged.
Consultant hall perform services in accordance with this Agreement, in accordance with the
appended proposal for services and addendum to Proposal for services Addendum to
Exhibit "A"), and in a professional and workmanlike manner.
Section 5.0I of the Agreement is hereby amended to read as follows:
5.01 CONTRACT AMOUNT
In consideration for professional consulting services to be performed by Consultant, City
agrees to pay Consultant in Accordance with Exhibit "B" entitled "Fee Schedule," and the
Addendum to Exhibit "A," which documents is are attached hereto and incorporated herein for
all purposes, in payment for services and the Scope of Services deliverables as delineated in
Exhibit "A" and the Addendum to Exhibit "A."
Not -to -Exceed Total Payment for Services: Consultant's total compensation for
consulting services hereunder shall not exceed
Four- and 40/100 Dallar-s (555,884.40) Sixty -Four Thousand Two Hundred Ninety -Three
and No/100 Dollars ($64.293.00).
IV.
This Supplemental Agreement No. 1 shall amend the original Agreement only as set forth
herein with no other changes in terms or conditions of the original Agreement.

Introduction
Rock Engineering & Testing Laboratory, Inc. (RETL) was selected by the City of Round Rock to
provide Construction Materials Engineering Services for the Luther Peterson Service Center
project. RETL received an executed copy of Resolution No. R-2018-5269 dated March 22, 2018.
The total compensation for the Construction Materials Engineering Services provided for this
project was set at $55,884.00.
Budget Review
As of February 28, 2019, our records indicate the following:

Scope of Services Remaining to Project Completion
RETL representative Mr. Bryan Angelo met with Lee Lewis Project Personnel and has determined
that the following type and amount of Construction Materials Engineering Services remain to
complete this project.

Earthwork Inspection and Testing
Perform field moisture content and density testing on lime stabilized
subgrade soils and aggregates placed as base course materials.

Additional construction testing is required for the Luther Peterson Service Center project.
Throughout the duration of the project, failed or rescheduled construction testing has been back
charged to the General Contractor. Additional testing is required for soil analysis, reinforcing
steel, concrete, masonry, and asphalt to ensure compliance with the contract documents. It is
the responsibility of the Owner, per contract to provide additional testing.
