Section 10-33 of the Subdivision Ordinance allows a landowner to request the vacation of an easement established by an approved plat or by separate instrument. This request was first submitted in 1999. During that period, easement vacation requests were reviewed by the Planning and Zoning Commission and recorded by the County Clerk, when approved. It was discovered the original request was approved by the Planning and Zoning Commission but never recorded. Further review noted the wrong document had been used so a new vacation document is being processed. The purpose of the original requested vacation was to allow the homeowner additional space for the construction of a pool. The pool was constructed in a portion of the easement thought to have been vacated. The City of Round Rock Utilities and Environmental Services Department has consented to the proposed vacation.
