Colleyville, Texas 76034 Re: Kenney Fort Boulevard Driveway construction Dear Angela: Please allow this letter to set out my understanding regarding our agreement for the proposed construction of a driveway from the proposed Kenney Fort Boulevard roadway adjacent to your property. The terms of the agreement are as follows: As part of the construction of the proposed Kenney Fort Blvd. roadway facilities, the City of Round Rock ("City") shall cause the construction of a concrete driveway between the edge of the roadway improvements and the edge of the new right of way line. The driveway shall be a minimum of twenty-five (25) feet in width, and shall otherwise be constructed in the location as previously agreed to in that certain Real Estate Contract between the parties, and in substantial compliance with the specifications and notes as shown in Exhibit "A" attached hereto and incorporated herein. 2. As prerequisite to the City's obligation of construction as set out above, you shall pay the amount of $1,875 to the City of Round Rock within twenty-one (21) days after full execution of this agreement. 3. By execution of this agreement you agree to allow City, its agents and contractors to temporarily enter your property for the sole purpose of carrying out the driveway construction obligations of this agreement if necessary. If this meets with your understanding please have this letter approved and executed where indicated and return it to me, and we will in turn then have this approved and signed by the City as soon as possible. 00427626.
