CITY OF ROUND ROCK § STATE OF TEXAS § COUNTY OF TRAVIS § COUNTY OF WILLIAMSON § KNOW ALL BY THESE PRESENTS: THIS SUPPLEMENTAL AGREEMENT NO. 2 to "City of Round Rock Agreement for Professional Consulting Services for Construction Materials Testing Services with Rock Engineering & Testing Laboratory, Inc.," hereinafter called "Supplemental Agreement No. 2," is made by and between the City of Round Rock, Texas, a home -rule municipality, hereinafter called the "City" and Rock Engineering & Testing Laboratory, Inc., hereinafter called the "Consultant." WHEREAS, the City and Consultant executed the referenced "City of Round Rock Agreement for Professional Consulting Services for Construction Materials Testing Services," hereinafter called the "Agreement," on March 22, 2018 by Resolution No. R-2018-5269; and WHEREAS, the parties previously executed Supplemental Agreement No. 1 to amend the Scope of Services to add additional services and increase the fee by an additional Eight Thousand Four Hundred Nine and No' 100 Dollars ($8,409.00); and WHEREAS, the City desires to further amend the Scope of Services to add additional services related to construction materials testing for the Luther Peterson Service Center Project and increase the fee by an additional Nine Hundred Thirty -Seven and 30.100 Dollars ($937.30); and WHEREAS, it is necessary to amend the Scope of Services, the Fee and the Term of services provided in the Agreement; NOW THEREFORE, in consideration of the mutual promises and obligations in the Agreement, Supplemental Agreement No. 1, and this Supplemental Agreement No. 2, the City and Consultant agree that said Agreement is amended and supplemented as follows: 004342351ss2 eA1_.2rx9- 0355 I. Section 3.01 of the Agreement is hereby amended to read as follows: 3.01 SCOPE OF SERVICES Consultant shall satisfactorily provide all services described herein and as set forth in Exhibit "A" and the Addendum to Exhibit "A." which document is incorporated herein for all purposes. Consultant's undertaking shall be limited to performing services for the City and: or advising City concerning those matters on which Consultant has been specifically engaged. II. Section 5.01 of the Agreement is hereby amended to read as follows: 5.01 CONTRACT AMOUNT In consideration for professional consulting services to be performed by Consultant, City agrees to pay Consultant in Accordance with Exhibit "B" entitled "Fee Schedule," and the Addendum to Exhibit "A," which documents its are attached hereto and incorporated herein for all purposes, in payment for services and the Scope of Services deliverables as delineated in Exhibit "A" and the Addendum to Exhibit "A." Not -to -Exceed Total Payment for Services: Consultant's total compensation for consulting services hereunder shall not exceed} Three —m}d—NeA0($64,293.00) Sixty -Five Thousand Two Hundred Thirty and 301100 Dollars ($65,230.30). This Supplemental Agreement No. 2 shall amend the original Agreement only as set forth herein with no other changes in terms or conditions of the original Agreement. Earthwork Inspection and Testing o Perform field moisture content and density testing on lime stabilized subgrade soils and aggregates placed as base course materials. c: Perform laboratory testing of soils to include: ■ Atterberg Limit (ASTM D4318) ■ Sieve Analysis (ASTM C136) ■ Percent Finer than No. 200 Sieve (ASTM D1140) • Moisture Density Relationship (ASTM D1557) • Foundation Inspection Continuous observation of drilled pier foundation excavations for confirmation of bearing materials and removal of loose soils. c Observe placement of reinforcing steel (bar size/spacing/lap).
