CONSIDERATION: TEN AND NO/IOO DOLLARS and other good and valuable
consideration.
PROPERTY (including any improvements):
Approximately 1.4o acres of land out of the John Powell Survey,
Abstract No. 491, Williamson County, Texas, being the same land
conveyed by HMR to the City by Dedication Deed dated August
28, 2013, recorded under Document No. 2013087001, Official
Public Records of Williamson County, Texas (the "Dedication
Deed").
RESERVATIONS FROM AND EXCEPTIONS TO CONVEYANCE AND WARRANTY:
(a) All restrictions, easements, reservations and restrictions of record in Williamson
County, Texas, or visible and apparent on the ground prior to August 28, 2013;
(b) Unpaid taxes for the current and all subsequent years, the payment of which is
hereby assumed by HMR; and
TERMINATION OF RESTRICTIVE COVENANTS AND RIGHT OF REVERTER:
Under the Dedication Deed, the Property was conveyed to the City subject to certain
restrictive covenants which, among other things, restricted the use of the Property to a water
storage tank site or another municipal purpose approved by HMR (the "Restrictive Covenants").

In addition, the Dedication Deed included a right of reverter providing that, if the City had not
completed the construction of a water storage tank upon the Property within seven years from
the date of the Dedication Deed, the Property would revert to and vest in HMR (the "Rit7ht o
Reverter"). The City has determined that it does not require the Property for the purposes for
which it was conveyed and wishes to reconvey the Property to HMR; further, HMR and the City
have mutually agreed to terminate the Restrictive Covenants and the Right of Reverter and
release the Property from the burdens thereof. Therefore, in consideration of the premises, and
other good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged, the City and HMR hereby terminate the Restrictive Covenants and the Right of
Reverter and release the Property and each other from all restrictions, claims, liabilities, rights
and obligations arising under or with respect to the Restrictive Covenants and the Right of
Reverter. The foregoing termination and release will be binding upon the City and inure to the
benefit of HMR and all future owners of the Property.
GRANT AND CODBMLANCE OF PROPERTY:
The City, for the consideration and subject to all of the terms set forth in this instrument,
grants, sells and conveys the Property to HMR, together with all rights and appurtenances
thereto, to have and hold unto HMR and HMR's successors and assigns forever. The City
hereby binds the City and its successors and assigns to WARRANT AND FOREVER DEFEND all
and singular the Property to HMR and HMR's successors and assigns, against every person
whomsoever lawfully claiming or to claim the same or any part thereof, by, through or under the
City but not otherwise, except as to the reservations from and exceptions to conveyance and
warranty set forth above.
COUNTERPARTS:
To facilitate execution, this instrument may be executed in any number of counterparts
and it will not be necessary that the signatures of both the City and HMR be contained on any
one counterpart. The signature pages taken from separate individually executed counterparts of
this instrument may be combined to form multiple fully executed originals. All executed
counterparts of this instrument will be deemed to be originals, but all such counterparts, when
taken together, will constitute one and the same instrument.
EXECUTED by the City and HMR on the separate counterpart signature pages attached to this
instrument, to be effective on the date the last party signs.
