4 AN ORDINANCE AMENDING ZONING AND DEVELOPMENT CODE,
5 CHAPTER 4, ARTICLE VIII, SECTION 4-95 REGARDING SUBDIVISION
6 IMPROVEMENT CONSTRUCTION PERMITS, CODE OF ORDINANCES
7 (2018 EDITION), CITY OF ROUND ROCK, TEXAS; AND PROVIDING
8 FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING
9 ORDINANCES AND RESOLUTIONS.

11 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
12 TEXAS:

14 That Zoning and Development Code, Chapter 4, Article VIII, Section 4-95, Code
15 of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as
16 follows:

19 Sec. 4-95. Subdivision improvement construction permits.

21 (a) Submittal. Applications for subdivision improvement construction permits shall be submitted for
22 review and acceptance by the PDS director for all development for which public improvements are
23 required.
24 (b) Developer must retain engineer. The developer must retain the services of a civil engineer,
25 registered in the state, whose seal shall be placed on the subdivision improvement construction
26 plans in accordance with the Texas Engineering Practice Act. The engineer shall be responsible for
27 the services as described in the Design and Construction Standards. The services performed by the
28 engineer shall be as designated in the latest edition of the Manual of Professional Practice—General
29 Engineering Services, published by the Texas Society of Professional Engineers, and shall include
30 both design and inspection as defined therein.
31 (c) Submittal content. Except as provided herein, after preliminary plat approval, an application for a
32 subdivision improvement construction permit may be submitted to the PDS director for approval. The
33 application for the subdivision improvement construction permit shall include all of the information
34 specified in the development packet.
35 (d) State review. All subdivision improvement construction plans must comply with the Texas
36 Accessibility Standards administered by the Texas Department of Licensing and Regulation and the
37 Americans with Disabilities Act of 1990, as amended. The developer shall submit applicable portions
38 of the subdivision improvement construction plans to the Texas Department of Licensing and
39 Regulation for review. Upon the completion of construction, the developer shall request inspection of
40 all pedestrian facilities by the Texas Department of Licensing and Regulation and pay all necessary
41 fees. The city will not accept the public improvements until the developer provides evidence that the
42 plans have been reviewed and approved by the Texas Department of Licensing and Regulation and
43 that payment of the required inspection fees has been made.

I (e) Expiration of subdivision improvement construction permits. The subdivision improvement
2 construction permit will expire two years from the date of approval by the PDS director if construction
3 has not commenced. Even after construction has commenced, the subdivision improvement
4 construction permit will expire three years from the date of issuance. If a subdivision improvement
5 construction permit expires, the application shall be resubmitted for review and acceptance to
6 ensure compliance with the current Design and Construction Standards.
7 (f) Preconstruction conference. After the issuance of the subdivision improvement permit, a
8 preconstruction conference shall be required prior to commencement of construction of the public
9 improvements. The preconstruction conference shall be held with the PDS director and include the
10 following people: Developer, developer's contractor, developer's engineer and other parties as
11 determined by the PDS director.

17 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
18 expressly repealed.
19 B. The invalidity of any section or provision of this ordinance shall not
20 invalidate other sections or provisions thereof.
21 C. The City Council hereby finds and declares that written notice of the date,
22 hour, place and subject of the meeting at which this Ordinance was adopted was posted
23 and that such meeting was open to the public as required by law at all times during
24 which this Ordinance and the subject matter hereof were discussed, considered and
25 formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas
26 Government Code, as amended.
