DECLARATION OF STORM SEWER AND DRAINAGE EASEMENT
THE STATE OF TEXAS
KNOW ALL BY THESE PRESENTS:
COUNTY OF WILLIAMSON
WHEREAS, the City of Round Rock is the owner of tract of land described as Lot 61,
Park Land (Drainage Easement) as shown on the Plat of Creek Bend Section 11, as recorded in
Cabinet F, Slide 144, of the plat records of Williamson County, Texas (the "City Property"); and
WHEREAS, the City of Round Rock desires to use a portion of the City Property for
location of a storm sewer and drainage easement ("Storm Sewer and Drainage Easement");
NOW, THEREFORE, in consideration of the foregoing premises, the City of Round
Rock makes the following Declaration of a Storm Sewer and Drainage Easement:
That the CITY OF ROUND ROCK, a Texas home -rule municipal corporation
(hereinafter called the "Declarant") has executed this Declaration ora Storm Sewer and Drainage
Easement for the purpose of establishing the following exclusive easement in and under the
following described property in Williamson County, Texas, to -wit:
Being 0.052 of one acre (2,264 square feet) tract of land in the City of
Round Rock, Williamson County Texas, in the D. Curry Survey, Abstract No.
130, being out of Lot 61, Park Land (Drainage Easement) as shown on the
plat of Creek Bend Section 11, as recorded in Cabinet F, Slide 144, of the
plat records of Williamson County, Texas; said 0.052 of one acre tract
being more fully described by metes and bounds and sketch in Exhibit "A"
attached hereto and made a part hereof for all purposes.
The perpetual easement, right-of-way, rights and privileges herein granted shall be used
for the purposes of location, placement, relocation, construction, operation, enlargement,
maintenance, alteration, repair, rebuilding, removal and patrol of storm sewer utilities and
drainage facilities, to wit: open drainage channel and storm sewers and collection facilities,
drainage pipes and all other surface and subsurface drainage structure lines, access facilities and

related equipment, all necessary conduits, valves, vaults, manholes, ventilators and
appurtenances, and any other necessary accessories thereto (collectively the "Facilities").
Declarant retains, reserves, and shall continue to enjoy the surface of such easement for
any and all purposes which do not interfere with and prevent the use of the easement. Declarant
will not be responsible or liable for any damage to utilities placed within the easement caused by
Declarant's use of the surface pursuant to this paragraph.
Except as otherwise stated, the easement and other rights and privileges hereby created
shall be perpetual. However, it is expressly provided that this Declaration may be modified,
amended, or terminated by Declarant at any time, and without any condition, requirement or
prerequisite to same.
The benefits and obligations of the easement created herein shall constitute benefits and
servitudes running with the land.

BEGINNING at a calculated point on the northeasterly right -of --way line of Hairy Man Road
(ROW varies) no reference found for the original right-of-way, widening documents recorded
in Document Numbers 2019085686, 2019090478, and 2019029939 of the Official Public
Records of Williamson County, Texas, the POINT OF BEGINNING and southwesterly corner
of the herein described tract, from which a 112 -inch iron rod with a cap stamped "BGE INC' set
at a common corner of the southwesterly right-of-way line of said Hairy Man Road and Lot 12,
Block "D" a Landscape & Drainage Area as shown on the plat ofHairy Man Subdivision, Phase
I, as recorded in Document Number 2019085686 of the Official Public Records of Williamson
County, rexas bears N 69°3243" W, a distance of 110.20 feet;
THENCE, departing said right-of-way line, over and across said Lot 61 the following rive (5)
courses;
1) N 40'15'32" E, a distance of 61.48 feet to a calculated point, an angle point of the
herein described tract;
2) N 04°44'28" W, a distance of 83.62 feet to a calculated point, the northwesterly
corner of the herein described tract;

curvilinear northeasterly right-of-way line of Hairy Man Road at the beginning of a
non -tangent curve, the southeasterly corner of the herein described tract, from which
a 112 -inch iron rod with a cap stamped "BGE INC' set at a point of curvature in the
common line of said right-of-way and said Lot 12, Block "D", Hairy Man
Subdivision, Phase 1, bears S 41 0513" W, a distance of 147.04 feet;
THENCE, coincident with said common line, curving to the right, with a radius of 550.00 feet,
an arc distance of 15.03 feet, a central angle of 01 °33'56", a chard bearing of N 53°18'20" W,
and a chord distance of 15.03 feet to the POINT OF BEGINNING and containing 0.052 of one
acre (2,264 square feet) of land, more or less.
