PARTIAL RELEASE OF WASTEWATER EASEMENT

COUNTY OF WILLI A.MSON § KNOW ALL BY THESE PRESENTS:
That the CITY OF ROUND ROCK, TEXAS, a municipal corporation situated in the Counties
of Travis and Williamson, State of Texas ("Releasor"), with mailing address of221 East Main Street, Round
Rock, Texas 78664, for and in consideration of the sum of Ten and No/ 100 Dollars ($10.00) and other good
and valuable consideration paid by PRIMAX PROPERTIES, LLC, a Texas limited liability company,
whose address is 1100 East Moorehead Street, Charlotte, North Carolina 28204, the receipt and sufficiency
of which is hereby acknowledged, does hereby ABANDON, RELEASE and DISCHARGE the portions of
a Wastewater Easement encumbering the below -described property, to -wit:
Being a 0.0740 acre tract of land situated in the Memucan Hunt Survey, Abstract Number
314, City of Round Rock, Williamson County, Texas, and being part of Lot 1, Block D of
the Final Plat for Warner Ranch Subdivision, Phase 1, Block D, and addition to the City of
Round Rock as recorded in Instrument Number 2019012026 of the Official Public Records
of Williamson County, Texas (O.P.R.W.C.T), and being part of that called 18.998 acre
tract of land as described in deed to BCAA Grimes, LLC, as recorded in Instrument
Number 201704357, O.P.R.W.C.T.; said 0.0740 acre tract of land being more fully
described by Metes and Bounds and sketches attached hereto as Exhibits "A", and
incorporated herein by reference for all purposes
This instrument is given specifically to partially release the described said easements to the extent
Releasor is Grantee of said easement, which easement is partially terminated by abandonment, termination,
vacation, and cessation of purpose, and which portion of said easement will be of no further effect, whether
legal or equitable.

recorded in Instrument Number 2019012026 of the Official Public Records of Williamson County,
Texas (O.P.R.W.C.T.), and being part of that called 18.998 acre tract of land as described in deed
to BCCA Grimes, LLC, as recorded in Instrument Number 201704357, O.P.R.W.C.T., and being
more particularly described by metes and bounds as follows:
COMMENCING at the most northerly comer of said Lot 1, said corner being on the southeasterly
right-of-way line of State Highway 45 (a/k/a/ Louis Henna Boulevard, a variable width right-of-
way), said corner being the beginning of a non -tangent circular curve to the left, having a radius
of 5,710.00 feet, whose chord bears South 69 degrees 34 minutes 26 seconds West, a distance
of 14.25 feet;
THENCE Southwesterly, along the common northerly line of said Lot 1 and said southeasterly
right-of-way line and along said curve, through a central angle of 00 degrees 04 minutes 30
seconds, an arc distance of 14.25 feet to a point for corner at the intersection of the west line of
said 25-Foot Wastewater Easement with said common line;
THENCE South 24 degrees 16 minutes 07 seconds West, departing said common line and along
said west line, a distance of 80.90 feet to a point for the POINT OF BEGINNING of the herein
described tract;
THENCE South 17 degrees 34 minutes 27 seconds East, a distance of 37.48 feet to a point for
comer;
THENCE South 24 degrees 16 minutes 07 seconds West, a distance of 102.81 feet to a point
