WHEREAS, the City of Round Rock has previously entered into a "City of Round Rock
Agreement for Professional Consulting Services for Construction Materials Testing Services with
Rock Engineering & Testing Laboratory, Inc." ("Agreement") for the Public Library Project; and
WHEREAS, Rock Engineering & Testing Laboratory, Inc. has submitted Supplemental
Agreement No. 1 to amend the scope of services to add additional services related to construction
materials testing and to increase the amount; and
WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 1 with
Rock Engineering & Testing Laboratory, Inc.,Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental
Agreement No. 1 to "City of Round Rock Agreement for Professional Consulting Services for
Construction Materials Testing Services with Rock Engineering & Testing Laboratory, Inc.," a copy of
same being attached hereto as Exhibit"A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

THIS SUPPLEMENTAL AGREEMENT NO. 1 to "City of Round Rock Agreement for
Professional Consulting Services for Construction Materials Testing Services with Rock
Engineering & Testing Laboratory. Inc."' for the Public Library Project, hereinafter called
..Supplemental Agreement No. L"' is made by and between the City of Round Rock. Texas. a
home-rule municipality. hereinafter called the "City" and Rock Engineering & Testing
Laboratory; Inc.. hereinafter called the "Consultant."
WHEREAS, the City and Consultant previously executed the referenced City of Round
Rock Agreement for Professional Consulting Services for Construction Materials Testing
Services." hereinafter called the "Agreement" for the Public Library Project ("Project") in the
amount of$48.959.85: and
WHEREAS, the City desires to amend the Scope of Services to add additional services
related to construction materials testing for the Project: and
WHEREAS, it is necessary to amend the Scope of Services and increase the Contract
Amount provided in the Agreement by $13.346.15 to a total of$62.306.00 as set forth herein:
NOW THEREFORE, in consideration of the mutual promises and obligations in the
Agreement and this Supplemental Agreement No. 1. the City and Consultant agree that said
Agreement is amended and supplemented as follows:
I.
Section 2.01 of the Agreement is lherebv amended to read as follows:
2.01 PROPOSAL FOR SERVICES
Consultant has issued its proposal for services for the tasks delineated therein. such
proposal for services being attached hereto as Exhibit "A" and the Addendum to Exhibit "A,"
entitled "Scope of Services." «hich document is incorporated herein for all purposes.

II.
Section 3.01 of the Agreement is hereby amended to read as follows:
3.01 SCOPE OF SERVICES
Consultant shall satisfactorily provide all seii.,ices described herein and as set forth in
Exhibit "A- and the Addendum to Exhibit "A." Such services shall be performed in the time
frame approved by the City. Consultant"s undertaking shall be limited to performing services for
City and/or advising City concerning those matters on ti hick Consultant has been specifically
engaged.
II.
Section 5.01 of the Agreement is herebv amended to read as folloxN-s:
5.01 CONTRACT AMOUNT
In consideration for professional consulting services to be performed by Consultant. City
agrees to pay Consultant in accordance with Exhibit -A" and the Addendum to Exhibit "A'* for
the deliverables as delineated in Exhibit"A"and the Addendum to Exhibit "A."'
A. Not-to-Exceed Total Pavment for Services: Consultant's total compensation
for consulting services related to the Project hereunder shall not exceed S

III.
This Supplemental Agreement No. 1 shall amend the original Agreement only as set forth
herein with no other changes in terms or conditions of the original Agreement.

Rock Engineering & Testing Laboratory, Inc. (RETL) was selected by the City of Round Rock to
provide Geotechnical Engineering Services for the New Round Rock Public Library project. RETL
received an executed copy of Professional Services Agreement CM-2017-1433 dated July 17,
2017. The total compensation for the Geotechnical Engineering Services for this project was set
