WHEREAS, on the 13t1i day of March, 2020, Donald J. Trump, President of the United
States, declared that the COVID-19 outbreak in the United States constitutes a national
emergency, and
WHEREAS, federal procurement standards set forth at 2 C.F.R., Section 200.320(f)(2)
allow non-state entities, including cities, to noncompetitively procure contracts under certain
emergency or exigent circumstances, and
WHEREAS, FEMA defines emergency or exigent circumstances as unexpected and
unusually dangerous situations requiring immediate action or an urgent need for assistance or
relief, and
WHEREAS, emergencies typically involve a threat to life, public health or safety,
improved property or some other form of dangerous situation, and
WHEREAS, exigencies typically involve an urgent need to avoid, prevent, or alleviate
serious harm or injury, financial or otherwise; and
WHEREAS, under both an emergency and exigency, using a competitive procurement
process could prevent a city from taking immediate action to address the situation, and
WHEREAS,both emergency and exigent circumstances continue to exist, and
WHEREAS, the City finds it in the best interest to invoke the exigency/emergency
procurement procedures set forth in 2 C.F.R., Section 200.320(f)(2) for purchases related to the
City's response to the COVID-19 outbreak, and
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,

A. That the City Council invokes the public exigency/emergency procurement
procedures set forth in set forth in 2 C.F.R., Section 200.320(f)(2) for purchases specifically
related to the City's response to the COVID-19 outbreak.
B. The City Council hereby finds and declares that written notice of the date, hour,
place and subject of the meeting at which this Resolution was adopted was posted and that such
meeting was open to the public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted upon, all as required by
the Open Meetings Act, Chapter 551, Texas Government Code, as amended.
