DECLARATION OF WASTEWATER EASEMENT

KNOW ALL BY THESE PRESENTS:
WHEREAS, the City of Round Rock is the owner of a tract of land described as Block
E, Lot 5A of the Legends Village Section 2 Phase 4 Subdivision, as recorded in Document No.
2010074432 of the Official Public Records of Williamson County, Texas (the "City Property");
and
WHEREAS, the City of Round Rock desires to use a portion of the City Property for
location of a wastewater easement ("Wastewater Easement");
NOW, THEREFORE, in consideration of the foregoing premises, the City of Round
Rock makes the following Declaration of a Wastewater Easement:
That the CITY OF ROUND ROCK, a Texas home -rule municipal corporation
(hereinafter called the "Declarant") has executed this Declaration of a Wastewater Easement for
the purpose of establishing the following exclusive easement in and under the following
described property in Williamson County, Texas, to -wit:
Being 0.128 of one acre easement in the P.A. Holder Survey, Abstract No. 297 in
Williamson County, Texas, and being a portion of a Drainage and Storm Sewer
Easement Lot dedicated as Lot 5A, Block E, Legends Village, Section 2, Phase 4,
a subdivision of record in Document No. 2010074432 of the Official Public
Records of Williamson County, Texas; said 0.128 of one acre tract being more
fully described by metes and bounds and sketch in Exhibit "A" attached hereto
and made a part hereof for all purposes.
The perpetual easement, right-of-way, rights and privileges herein granted shall be used
to construct, install, operate, maintain, inspect, reconstruct, enlarge, relocate, rebuild, repair, and
remove a wastewater system and lines, together with all necessary lines, pipes, conduits, valves,
vaults, manholes, ventilators, and other equipment, improvements, accessories and
appurtenances or operations and any other necessary accessories thereto.

Declarant retains, reserves, and shall continue to enjoy .the surface of such easement for
any and all purposes which do not interfere with and prevent the use of the easement. Declarant
will not be responsible or liable for any damage to utilities placed within the easement caused by
Declarant's use of the surface pursuant to this paragraph.
Except as otherwise stated, the easement and other rights and privileges hereby created
shall be perpetual. However, it is expressly provided that this Declaration may be modified,
amended, or terminated by Declarant at any time, and without any condition, requirement or
prerequisite to same.
The benefits and obligations of the easement created herein shall constitute benefits and
servitudes running with the land.
